AN ORDINANCE OF THE CITY OF ASHLAND DECLARING A MORATORIUM ON THE DEMOLITION OR MOVING OF CERTAIN BUILDINGS IN ASHLAND'S HISTORIC INTEREST AREA, AND DECLARING AN EMERGENCY WHEREAS, The City has recognized that the historic buildings of the city are an important and irreplaceable resource, and WHEREAS, the Council has finds that these buildings are threatened by moving or demolition, and there is a need for adoption of procedures and ordinances for review of these irreversible acts, to protect the p;:b-ILic interest in preserving its historic heritage, and, WHEREAS, these new ordinances will take up to 120 days to adopt and become effective, and buildings may be demolished or removed during this period, and lost to the community, NOW THEREFORE THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: Section 1 Title. This ordinance shall be known as the Demolition Moratorium Ordinance and may be so cited and pleaded. Section 2 Purpose and Intent. The purpose and intent of this ordinance is to prevent demolition or moving of historic buildings in the Historic Interest Area of the City, as defined in the Comprehensive Plan, and to provide for a time period whereby the city may develop permanent measures to review demolition and moving development in the City. Section 3 Scope. This ordinance shall be in effect for those buildings identified in the list of Historic Residences (excepting those buildings identified as "compatible" or "non-contributing") adopted as Exhibit "A", and those Commercial buildings identified in the list adopted as Exhibit "B", both of which are attached to this ordinance and by this reference herein incorporated. This ordinance shall control the issuance of all moving and demolition permits for the buildings in the lists adopted. When this ordinance is found to conflict with any other applicable ordinances and laws, the stricter of the two shall apply. Section 4 Moving and Demolition Permits. No permits may be issued for the moving or demolition of structures on the lists adopted as Exhibit "A" and "B" in section 3 of this ordinance. Section 5 Applications to Move or Demolish. No applications for moving or demolition of structures affected by this ordinance may be processed during the time this ordinance is in effect. Section 6 Exemptions Exemptions to the provisions of this ordinance may be granted by the Council when, after proper notice and a public hearing, they find that the moving or demolition of a structure meets the criteria contained in Section 15.04.210 (E) (3). Section 7 Duration This ordinance shall be in effect for 120 days from effective date of the ordinance. Section 8 Emergency Clause There being an immediate danger to the public peace, health, safety, and general welfare, an emergency is hereby declared to exist , and this Ordinance shall take effect immediately upon passage by the City Council and approval by the Mayor.
