ORDINANCE NO. AN ORDINANCE VACATING AN ALLEY LOCATED BETWEEN SCENIC DRIVE AND ALTA STREET, SOUTHERLY OF WEST STREET, IN THE CITY OF ASHLAND, OREGON, AND DECLARING AN EMERGENCY. WHEREAS, there is presently on file with the City of Ashland from the owners of all the land abutting on the subject alley the consent to the vacation of such alley; and WHEREAS, notice of the public hearing and proposed vacation of the subject alley has been given in accord with the provisions of O.R.S. 271.110; NOW, THEREFORE, THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. That it is determined that the public interest will be best served by the vacation of the alley located in the City of Ashland, County of Jackson, State of Oregon, and more particularly described as follows: All that part of an alley, 20 feet in width, lying between the Easterly line of Alta Avenue and the Westerly line of Scenic Drive, and more particularly described as follows: Beginning at the Southwest corner of Lot 9 in Block 39 of the Woolen's addition to the City of Ashland, Jackson County, Oregon; thence, South 20 feet to the Northwest corner of Lot 10 of said block; thence, East along the North line of said Lot 10,200 feet to the West line of Scenic Drive; thence, 0° 30' W along said line 20 feet to the South line of the aforesaid Lot 9; thence, West along said South line 200 feet to the point of beginning. SECTION 2. That, for the foregoing reasons, the alley located on the land described in the preceeding Section is hereby vacated. However, RESERVING THEREFROM for the benefit of said City a perpetual Easement for the installation and maintenance of all present and future municipal utilities and that, for mainten- ance purposes, it is provided that a building shall not be constructed on the land described in the preceeding Section so as to interfere with the installation and maintenance of such utilities. '721125:3 SECTION 3. That inasmuch as it is deemed necessary for the public health, peace and safety of the citizens of the City of Ashland that the provisions shall be made immediately operative, it is hereby declared that an emergency exists and this Ordinance shall be in full force and effect from and after its passage by the Council and approval by the Mayor. The foregoing Ordinance was first read at a regular meeting of the Common Council held on the 15th day of August 1972, and passed on its second reading and duly adopted on the 22nd day of August 1972, the vote being as follows: Ayes: 5 Nays: 0 Dated this 22nd day of August 1972.
