ORDINANCE NO.
AN ORDINANCE OF THE CITY OF ASHLAND ANNEXING A CONTIGUOUS
AREA TO THE CITY OF ASHLAND, OREGON AND PROVIDING FOR AN
EFFECTIVE DATE. (MCFADDEN ANNEXATION)
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The land described in Exhibit "A" attached hereto and
made a part hereof is contiguous to the City of Ashland and is
located in Jackson County, Oregon, and is hereby annexed to the
City of Ashland as provided in Section 2 of this ordinance.
SECTION 2. Upon the effective date of this ordinance, the City
Recorder, in accordance with ORS 222.177, is hereby authorized and
directed to make and submit to the Secretary of the State of
Oregon, a copy of this ordinance, a copy of the Statement of
Consent from the electorate of the tract annexed, and a copy of the
ordinance dispensing with the election on the proposed annexation,
and also upon the effective date hereof, the City Recorder is
authorized and directed to submit a copy of this ordinance to the
County Assessor and County Surveyor of Jackson County, Oregon.
The foregoing Ordinance was first read on the day of
1989, and duly PASSED and ADOPTED this day of
1989.

AREA TO BE INCLUDED IN ANNEXATION
Commencing at the South one-quarter (1/4) corner of Section 14 in
Township 39 South, Range 1 East of the Willamette Meridian in Jackson County,
Oregon; thence, along the South line of said Section, North 89° 49' 45" West
640.00 feet (record South 89° 41' West 621.5 feet) to the East right-of-way
line of Tolman Creek Road; thence North 00° 02' 25" West (record North 0° 15'
West) 1235.00 feet to the Northwest corner of tract described in Deed recorded
in Volume 363, page 256 of the Deed Records of Jackson County, Oregon; thence,
along the North line of- said tract, South 89° 49' 45" East 287.00 feet to the
POINT OF BEGINNING; thence continue South 89° 49' 45" East 22.19 feet, to the
East line of the West one-half (1/2) of the East one-half (1/2) of the
Southeast one-quarter (1/4) of the Southwest one-quarter (1/4) of Section 14;
thence North 00° 01' 27" East (record North 00° 02' West), along said East
line, 85.94 feet (record 86.01 feet), to the Northeast corner thereof; thence
along the South line of the Northeast one-quarter (1/4) of the Southwest one-
quarter (1/4) of said Section 14, South 89° 56' 51" East 24.44 feet (record
South 89° 47' 44" East .24.40 feet), to the Southerly right-of-way of Siskiyou
Boulevard; thence along said right-of-way, North 56° 06' 05" West, 221.45 feet
(record 221.43 feet); thence leaving said right-of-way, South 00° 02' 25" East
194.01 feet to the Northerly line of tract, as described in Jackson County
Instrument No. 77-21817; thence North 86° 00' 00" East, along said Northerly
line, 137.34 feet to the Northeast corner thereof; thence South, along the
Easterly line of said tract, 24.93 feet to the point of beginning. Containing
0.51 acres, more or less.
ALSO; that portion of Siskiyou Boulevard being more particularly

05" East, along said Southerly right-of-way, 221.45 feet; thence North 33° 53'
55" East 100.00 feet to the Northerly right-of-way of said Siskiyou Boulevard;
thence North 56° 06' 05" West, along said Northerly right-of-way, 288.75 feet
to a point that bears North 00° 02' 25" West from the point of beginning;

Notice is hereby given that a PUBLIC HEARING on the following
request with respect to the ASHLAND LAND USE ORDINANCE will be held
before the ASHLAND PLANNING COMMISSION on the 8th day of February,
1989 at 7:00 p.m. at the ASHLAND CIVIC CENTER, 1175 East Main
Street, Ashland, Oregon. At such Public Bearing, any person is
entitled to be heard.
The ordinance criteria applicable to this application are
attached to this notice. Oregon law states that failure to raise
an objection concerning this application, either in person or by
letter, precludes your right of appeal. Failure to specify which
ordinance criteria the objection is based on also precludes your
right of appeal.
If you have any questions or comments concerning this request,
please feel free to contact, the Ashland Planning Department, City
Ball, at 488-5305.
NOTE: This request will also be reviewed by the Citizens
Planning Advisory Committee at 7:30 p.m. on February 2, 1989, at
the Ashland Pioneer Hall, 73 Winburn Way, (American Legion
Building) Ashland, Oregon.

PLANNING ACTION 89-015 is a request for a Comprehensive Plan Map
Change, Zone Change, and Annexation of 0.51 acres of land southeast
of the intersection of Siskiyou Boulevard and Tolman Creek Road.
Proposed zoning for laid after annexation is multi-family
residential. Proposed Comprehensive Plan Map Change is from open
space to multi-family residential. Comprehensive Plan Designation:
Open Space; Zoning: F-5 (Jackson County); Assessor's Map W: 14CD;
Tax Lot: 400.
