NOTICE OF RECEIPT OF BALLOT TITLE
FILED IN THE CITY OF ASHLAND
August 2, 2016
NOTICE IS HEREBY GIVEN that a ballot title meeting the requirements of section
1(2)(d), Article IV of the Oregon Constitution (one subject) has been filed with the City
Recorder.
The ballot title has been prepared by the City Attorney and is as follows:
CAPTION: Approving use of food and beverage tax for street maintenance
QUESTION: Shall Ashland voters enact a Council-approved ordinance to use food and
beverage tax revenue for street repair and rehabilitation?
SUMMARY: The Ashland City council approved an ordinance increasing the share of Ashland
Parks and Recreation Commission food and beverage tax revenue and dedicating
a share of food and beverage tax revenue to a street repair and rehabilitation
program. The ordinance becomes effective upon approval by the voters of
Ashland. The ordinance does not change the current tax rate of 5% and does not
change the tax's current sunset date of December 31, 2030.
The City's current food and beverage tax ordinance directs 20% of all tax
revenues to park land acquisition and development, and 80% of all tax revenues to
debt service on the City's waste water treatment plant. The ordinance for which
the City seeks approval would increase the share of tax revenue for parks to 25%
and would set aside a fixed amount of revenue for waste water debt, with any
revenues not required for that debt directed to the Street Fund for a pavement
management program.
ANY ELECTOR DISSATISFIED WITH THE BALLOT TITLE may petition the Circuit Court
seeking a different title and stating the reasons the title filed is insufficient, not concise or unfair.
Petition must name as respondent the City Attorney and must be filed no later than the 7th day
after ballot title is filed with the City Recorder. Deadline is August 12, 2016 at 5:00 p.m. The
court shall review the title and measure to be initiated or referred, hear arguments, if any, and
certify to the city elections officer a title for the measure which meets the requirements of ORS
250.035.
AN ELECTOR FILING A PETITION shall notify the city elections officer in writing that the
petition has been filed. The notice shall be given NO LATER THAN 5 p.m. on the next business
day following the day the petition is filed with the Circuit Court. ORS 250.296 ' 2.
