The council next proceeded to consider a proposed City Ordinance No• OlO1,,.~,
entitled "An ordinance vacatin a art of Ash Street, in the City of Ashland, Jackson g P
County, Oregon." The ordinance having been read the first time, o~ motion, the rules
were suspended, t~vo-thirds voting in favor thereof and the ordinance was passed to the
second reading. Having been read the Second time,ro11 call was ordered on the adoption
of the ordinance. The vote was as folloti~rs: Ayes Frost, McGee, Shinn; nay. Ba~n.ta.
Thereupon :;.the Chairman declared the ordinance duly adopted.
The council next proceeded to consider a proposed City Ordinance No. Z~ entitled
"An ordinance levying an assessment for special benefits to accrue to oTxners of property
abutting on the bit~.alithic paving improvement of that part of the Boulevard extending
from the east end of the present paver.~ent on said ~ulevard to Ashland Street and also
that part of Ashland Street extending; from the -Boulevard tp balker Avenue in the City of Ashland, Oregon." The ordinance having been read the first

The council met in special session at the call of the ~~ayor at 9 o'clock A.M. on
this date for the purpose of considering thc~rnatter of disposing of the Houck lot at the
corner of N. Main Street and the Playa. Present Mayor Lamkin Councilmen Banta, Nininger, Shinn; absent Frost,~icGee, Turner

After some discussion, on motion, a. tom minute recess eras had for the purpose of

The council was again called to order and it was moved by Banta, seconded by Nininger,
that
WHH~B, after careful consideration and due attention to the best business interests
of the City of Ashland,, it appears that the sai-A city should re-sell the prc~pert~r°~known as
the "iiouck Block" located at the corner of Plaza and North T~:ain Street in said city,
~P~A'~, it appears that one C. H Pierce offers the best price and terms therefor,
That the City of 1ahland sell to said C. H. Pierce said "Houck Block" reserving a 10
foot strip along the westerly lids for street purposes, and sufficient amount of land from
the southerly skis in order to make the street ~.ide lips describe;~!a ct~.rve from the corner
of the Farlow Building northerly. That said sale shall transfer to said C. H. Pierce the
entire building, excepting the south and westerly foundation walls, which shall remair.

The council next discussed the matter of ~rantin~ F• v~. Landing permission to erect
a barn x±x xx=xxRxxa± on his property on Iowa a-reet betireen Garfield and Palm. Ave
and the matter was referred to the Sanitary Committee with power to act.
-X nin;Lr, the City Attorney was instructed to prepare a notice
and the Mayor and Recorder instructed to execute same at once, giving r. Stearns thirty
days notice to vacate the property occupied by him at the corner of the Plaza and
North Main Street in said city.

,.G Butterfield an offer of X25.00 for a deed to hey property on the Boulevard, if
deeded to the City by Jan. 1, 1~j21, and that said deed had been prepared and tivas
ready for delivery. ~~r. Banta asked far an expression fror:~ the council as to whether
or not the City should pay ~~rs. Butterf field the ~25.OO. On motion, the matter was referred to the Realty Committee witr. power to act.

~ P~~r• J. McCoy addressed the council stating that residents on the west side of
Terrace Street had never been adequately served with water and asked that the council
talcs steps to improve the service in this section.
~:r• Nininger entered the room and was acknowledged present. F
On motion of Mr• Shinn, the matter of improving the service on Terrace Street was
referred to the water Committee with poW:r to act. The vote on the motion was as
fo110ws: Ayes Banta, McGee, Nininger, Shinn; nays none. Carried.
1~~±rs. Butterfield addressed the council in regard to the paving assessment against
her property~or. i.he southerly side of tY:e Boulevard and asking that the City take one- '
third or one-half of her property in payment of the assessment and leave her that
portion of said tract 150 feet back from the Boulevard. After some discussion, on
motion of Mr• Banta, the matter was laid on tree table until the next council meeting
in order that the City,Attorney might have an opportunity of looking into tyre matter.
Mr• Frost entered the room: and was acknowledged present, A communication from the County Court was rt,ad stating that the Sheriff had
collected th~~tgh error Cit3~ liens against the Margaret Butterfield Tract on the Boule-
vard amounting to ~g0.26 and recommending that the City refund Mrs. Butterfield said
amount. Moved by Shinn, s~condPd by Frost that the City refund Mrs. Butterfield
~g0.26 erroneously collected~ag~~nst her property described as folloWrs: A tract of
Land at the corner of Palm Avenue and the Boulevard fronting 217.3 feet an the Blvd.,
further described in Vol. 50, Page 501, D. R. of Jackson Co., Oregon. The vote on the motion was as follows: Ayes Banta, McGee, Frost,, Nininger,
Shinn; nays none.
Carried.
I~~r• T. E. Hadfield, Jr•, through Mayor Zamkin asked that the City refund hi~I. the
amount of the penalty paid on his paving assessment. On motion of Mr• Banta the
Recorder arras instructed t~: refund the .penalty, amounting to X9.84, when Mr. Hatfield • ~ } e r a kir~ f r o refund. .

?fir. Edward Carey addressed the council objecting to the sever assessment against
his property in South Granite Street Sevrer District on the groundq that the sever was
not a benefit to his property. The council informed ~Ir• Carey that he had lost his
day in Court as he did. not appear and make objection to the assessment on the date set
for the hearing of all obj ecticns ~--s-ari~._-assessr~ents.'
~~r. George Yates was present and asked that the City ref~d him the amount of
penalties paid on delinquent paving assessments. The City Attorney stated that this
refund could not legally be granted.
Reports of ~~1. H. Gowdy, City Judge, and C, ~V. Fraley, Street Commissioner, for
the month of August, 1)2n, were read and an motion, accepted and ordF:r~d placed on file
Bills O.K'd by the Finance Committee and amounting to X4,317.04 were road in
total amount only. Motion made and sec ~ ended that said bills be allowed and ~Tarrants
be ordered drapm in pa~.►ment of same. The vote was as follat~rs: Ayes Banta, Frost,
McGee, Nininger, Shinn; rays none; Carried.
