Present Mayor Lamkin; Councilmen Banta, P~cGee, Shinn; absent Frost, Nininger, Turner. ~yinutes of the ~reviaus meeting were read and approved as read. Mr• J. W. McCoy addressed the council stating that residents on the west side of Terrace Street had never been adequately served with water and asked that the council taxe steps to improve the service in this section. Mr• Nininger entered the room and was acknowledged present. On motion of Mr• Shinn, the matter of improving t~.e service on Terrace Street was referred to the water Committee with po~r~-r to act. The vote on the motion was as follows: Ayes Banta, ~~cGee, Nininger, Shinn; nays none. Carried. ~~irs. Butterfield addressed the council in regard to the paving a5sesfirr~ent against her property on the southerly side of tY:e Boulevard and asking that the City take one- ' third or one-half of her property in payment of the assessment arld leave her that portion of said tract 150 feet back from the Boulevard. After some discussion, an motion of fir. Banta, the matter was laid on the table until the next council meeting in order that the City ,Attorney might have an opportunity of looking into t?~~e matter. Mr• Frost entered the roorrl and was acknowledged present. A communication from the County Court was read stating that the Sheriff had collected th?~tgh error City liens against the Margaret Butterfield Tract on the Boule- vard amounting to ~g0.26 and recommending that the City refund Mrs. Butterfield said amount. Moved by Shinn, s~:condPd by Frost that the City refund Mrs. Butterfield ~g0.2G erroneously collected ~ag~;inst her property described as follo~rs: A tract of Land at the corner of Palm Avenue and the Boulevard fronting 217.3 feet on the Blvd., further described in Vol. 50, Page 501, D. R. of Jackson Co., Oregon. The vote on the motion was as follo~ps: Ayes Banta, ~ulcGee, Frost,, Nininger, Shinn; nays none. Carried. S~~r• T. E. Hadfield, Jr• , through B~a~or Zamkin asked that the City refund hip. the amount of the penalty paid on his paving assessment. On motion of Mr• Banta the Recorder ~rra,s instructed t~_ refund the .penalty, amounting to ~'g.84, when Mr. Hatfield shall have signed a written statement ~st~ting his reasons for askir~g for a refund. ~~r. Edwaxd Carey addressed the council objecting to the sewer assessment against his property in South Granite Street Seger District on the grounds that the set=,~er was not a benefit to his property. The council informed ptr• Carey that he had lost his day in Court as die did. not appear and make objection to the assessment on the date get fox the hearing of all objections -~i----e"a-id~.assgssments: PEr. George Yates was present and asked that the City refund him the amount of penalties paid on delinquent. paving assessments. The City Attorney stated that this refund could not legally be granted. Reports of `~l. H. Gowdy, City Judge, and C. ~V. Fraley, Street Commissioner, for the month of August, lg2n, ~►ere read and on motion, accepted and ord~:rEd placed on file Bills O.K'd by the Finance Committee and amounting to X4,317.04 were road in total amount only. Motion made and sec~~nded that said bills be allowed and ~larrants be orderod drav~m in pa~►ment of same. The vote was as follotas: Ayes Banta, Frost, McGee, Nininger, Shinn; rays none; Carried. On motion of ~~ar. Nininger, the Mayor and Recorder were authorized to 7ign a quit-claim deed for Balfour Gutherie Tract, being Block 38, Coalid;e Addition, and the ofi'er submitted by i'l~ir• Briggs was accepted. The vote an the motion was as follows: Ayez Banta, Frost, ~~cGee, Nininger, Shinnl nays none. Carried, Councilman Banta stated that certain parties had been hauling away sand belonging to the city ar.d which he thought the city would- have use for irl the future. On motion, the matter of giving away or selling sand was referred to the Realty Committee. Engineer V~alker addressed the council in regard to the proposed resErvoir site and a the result of his investigation. The council next proceeded to consider a proposed resolution ealling~:.a"special t~~ Qlection to be held on the 18th day of September, 1920, for the purpose of submitting to the voters the following proposition: Shall the Common Council of the City of Ashland, Jackson County, State of Oregoh, in order to provide funda far the purpose of building reservoirs and cams in Ashland Creek Canyon, and for the puxpose of bettering and in- creasing the water supply of said city, issue bonds of said city to such an Y amount as may be necessary and not exceeding ~100,0O0.OC', said sum or such amount as the Common Council may consider necessary to be expended ag said Common Council deems best for said purposes; the said bonds to be dated and to be of the denomination as may be decided upon by said Common Council as the best financial interests of said city may require; said bonds to bear interest at the rate of not to exceed six per cent per annum, interest payable semi- annually, Maid interest to be evidenced by coupons to be attached to said bonds; provided the right to take up and cancel such bonds upon payment of the face value thereof, ti~rith interest accrued to date of payment at any semi- annual coupon period at or after Ten Years from date of such bonds, shall be and hereby is vested in the City of Ashland; provided, further that said bonds shall be made paya~~~.e at the office of the City Treasurer of the City ~ of Ashland, and shall mature at such time and times, not exceeding 30 years, as the Common Counci 1 may determine to be best, and ~ SHALL the said Common Council borrow money on behalf of said city by selling or disposing; of the said bonds upon due advertise;~ient, for the highest price obtainable,. the proceeds, or so much thereof as ma3T be necessary to be ~ applied for the purposes herein~.~efore stated. The resolution having been read the first time, on motion, the rules were sus- pended, two•thirda vo~ng in favor thereof, and the resolution was passed to the second reading. They°eupon the ~~ayor declared the resolution adoptcd~ The Recorder laid before the council an Initiative Petition de:anding that a proposed charter aYr~endment adding a section to be known as Secti ::n 19 1-2 of Article VII to the city charter be submitted to the legal voters of the Cit~r of Ashland, Oregon; ,for their approval or rej ectign, at a special city election to be called by the common council of said city Sept, 23rd, 1920. The petition having been found to contain the r~quir~ed number of signatures of legal voters of the City of Ashln,nd, under the requirements of City Ordinance No. 357 of the City of Ashland to call such special election as petitioned for, the council thereupon proceeded to consider a xesolution providing ~ or a special election of the qualified electors of the City of Ashland, Oregon, to be held on the 23rd day of September „ 1920, 3t which shall be subr+~itted the aforesaid charter amendment. The resul:!tion having been read, ran motion, the rules were suspend~.d, t'•~o-thirds- voting in favor thereof, and tine resolution 7ras passed to the second reading. The City Attorney submitted the following, ballot title far the charter aanendment to be voted on Sept, 23rd, 1920: "Shall the City Charter be amended by adding thereto a Section to be knct~~n as Section 19~ of Article VII, directing the city council to issue bonds up to ~100,0~0.00, and further directing the expwnditure of so xluch of said sum as may be necessary in the purchase of a reservoir and l~vater-works site known as the "Buck La'~ce Ranch", in hlarnath County, Oregon?" p I+otion made and seconded that said ballot title be approved by tre council. The vote was as follows: Ayes Banta, Frost, ~[cGee, Nininger, Shinn; nays none. Carried. Councilman Nininger ~~sked to be excused and his request eras granted.
