Present Mayor Thornton; Councilmen Bergner, Blake, Kay, Peters, White, Woods; absent none. ~~inutes of the meetings of Sept. 4th and 6th were read and> approved. „ Freight bills amounting to X1,087.24 were presented. Motion was made and seconded that said bills be allowed subject to the O.K. of Engineer Dillard. Carried unanimously. Councilman Blake reported that the Fire Chief had been granted authority to attend the Fire Chief's convention to be held in California on Oct. 1st to 6th. Councilman White reported that he and the City Engineer had investigated the Scenic Drive proposition. They found that some of the property owners were willing to ' give aright of way for the extension and others vaere not. None of the property owners were willing to bear a part of the expense of the improvement, which would amount to approximately X750.00. Councilman '~hite reported that ~ number of citizens had expressed themselves as ~a being in favor of cutting off the corner at the Swedenburg Building but stated that he had .not interviewed Dr. Swedenburg. The hour of 8 o'eiock having arrived the council proceeded with the heGring of any suggestions or objections to the proposed construction of cement sidewalks on Bush Street and sidewalks, curb and gutter on North Main Street. Mrs. Elir~a Hicks: Mrs. Ada Gandee, R~rs. Reigle and Mrs. Jane Thompson spoke objecting to the proposed improvement. Mrs. A Brannan stated that she would be in favor of building the walks in the spring. '~~hen assured that the city would guarantee a good job if constructed this Fall she stated she would make no objection. bar. J. M. Ross and G. W. Goldy spoke in favor of the improvement. G. H. Billings was also in favor of theconstruction of sidewalks, curbs and gutters but asked that he be allowed to build his own. A written protest was read from Herbert ~?cCarthy. No action was taken at this time, the council deciding to settle the matter at a special meeting to be held Tuesday S~pt.25th: ~~28. Mr. Heard and Henry Bailey requested that the City grade Otis Street. This matter was referred to the t et ~I S re Commissioner to be dttended.to: at the proper time. A communication from Engineer Dillard was-.next read in which he stated that he had rechecked his figures on the concrete yardage for the Reeder Gulch Dam and found the total would be approximately 17,500 cubic yards instead of 15,000 as previously reported. He estimated that practically all of the proceeds from the bond sale will be needed and suggested that the remaining X125,000 block of bonds be sold for Nov. 1st delivery. Moved by U~oods seconded by Bergner that the X125:000.00 issue of ~+`ater Bonds be advertised for sale, as suggested by Engineer Dillard, the date of sale, etc. to be fixed by the City Attorney. The vote on the motion was as follows: Ayes Bergner, Blake, Kay, Peters, ~~dhite, ~doods; nays none. Carried. The City Attorney next read a proposed charter amendment to be submitted to the voters by the Council, providing for an annual tax levy for the maintenance of the cemeteries. After some discussion it was decided to defer action on this matter until ~ next Tuesday. Councilman White asked that the City Attorney prepare a charter amendment changing the term of office of Councilmen from two to four years. The ~~ayor stated that he thought the City was entitled to a rebate of 3 cents per gallon on all gas purchased. The City Attorney was requested to investigate the matter. Daley, representing the Carter Zand Co. and other interested property owners, addressed the council requesting that they place upon the ballot a charter amendment gran'ing the council authority to sell water for domestic purposes only to residents ...3 LL outside the city limits. Afte~~, s me iscu~sion they interested property owners were requested to bring in a petition"s~.~`~'~t~a~3 S`~i~' emendment be placed mpon the ballot. r n # ~ L The council proceeded to consider a proposed city ordinance entitled " Ordinance amending Section 1 of Ordinance ~`o. 841 as amended by Ordinance No. 864 in order to pro- vide for the issuance of the full amount of bonds authorized by Article XXIV of the t Charter of the City of Ashland." The ordinance having been read the first time, on motion, the rules were suspended, six voting in favor thereof, and the ordinance was passed to the ;=~econd reading. Having beer. read the second time, roll call was ordered on its adoption. The vote was as follows: Ayes Bergner, Blake, Kay, Peters, ~f~hite, ~~'oods; nays none. Thereupon the Mayor decl~~red City Ordinance No. 85~ adopted. Pw~otion was made and seconded that the remaining x'125,000.00 dyater Bonds be advertised for sale, the time for the opening of the bids to be S o'clock F.M., Oct. 23rd, 1928. i Ca~~ried unanimously. The council next proceeded to consider a resolution entitled " Resolution proposing an amendment to the Charter of the City of Ashland, Jackson County, Oregon, to be known as Article KXVII of said charter, authorizing the r~dayor and Common Council to include in the a-rnual tax levy a sum equal to not to exceed one mill on each dollar of assessed valuation of property within the city, which sum shal~be used for the purpose of main- tenance and upkeep of cemeteries held by, or under the control of the City of Ashland, and for the purpose of efeating a trust fund for upkeep of said cemeteries; and further authorizing the Common Council to receive control for and on behalf of said city of any privately owned cemeteries thereon; and further authorizing the Common Council to create any fund or funds, either of a general or trust nature, for the purpose of maintaining the cemeteries under the jurisdiction of said Common Council; and further authorizing the Common Council to receive bequests and donations for purpose of assisting in carrying out intention hereof• and further rovidin that said ro osed charter amendment be submitted ~ p g P p to the electors of said city for their approval or rejection in the general election to be held on the 5th day of T~ovember, 1928; and further providing a ballot title for said measure." The resolution having been reed th? first time, on motion, the rules ~dere suspended, six voting in favor thereof, and the resolution was passed to tam second reading. Having been read the second time, roll call was ordered on its adoption. The. vote was as follows; Ayes Bergner, Blake, Kay, Peters, u~hite, `~`~oods; nays none. Thereupon the i~~ayor declared the resolution adopted. v'~ The council next proceeded to consider a resolution entitled "Resolution proposing an amendment to the charter of the City of Ashland, Jackson County, Oregon, to be known as Section 5 of Article XIS of said charter, authorizing the Ashland Park Commission with the consent off' the Common Council to lease, on such terms as they deem best, but nor for a term of longer than ten years, that part of the Ashland Public Park System, known as the ~~~unicipal Auto Camp Ground, including that part used and required for auto camp cabins, providing that any such lease shall contain a clause prohibiting tie carrying on of any .y mercantile or garage business on said leased premises without first obtaining the unan- imous consent of the said Commission and the Common Council, and further providing th~.t said proposed charter amendment be submitted to the electors of said City for their approval or rejection at the general election to be held on the 6th day of November, 1928; and further providing a ballot title for said measure."
