Present w Mayor Thornton; Councilmen Bergner, Bla.~e, K eters, oJhite, 'Hoods; absent none. ~~ainutes of the previous meeting we d an approved as corrected. Report of Engineer Dillard was re and o motion, accepted and ordered placed on file. Freight bills amounting to ~ ,087.2 were presented. ~Mo.tion was made and seconded that said bills be allow-ed su ~ ct to e approval of Engineer Dillard. Carried unani~ously. Councilman Blake e d th the Fire Chief had been granted authority to attend the Fire Chiefs Conve i to b held in Sacramento Oct. 1st to 6th inclusive. M Ashland, Oregon, Sept. 25, 1928. The council met at the call of the ~4~ayor at 7:30 o'clock P.~~. on this date. Present Mayor Thornton; Councilmen Bergner: Blake, Kay, Feters, t'~nite, Moods; absent none. ~~inutes of the previous meeting v~~ere read and approved as corrected. H. C. Daley, representing the Carter Zand Co. and other interested property owners, addressed the council requesting that they place upon the ballot a charter amendment gran'ing the council authority to sell water for domestic purposes only to residents ...3 LL outside the city limits. Afte~~, s me iscu~sion they interested property owners were requested to bring in a petition"s~.~`~'~t~a~3 S`~i~' emendment be placed mpon the ballot. r n # ~ L The council proceeded to consider a proposed city ordinance entitled " Ordinance amending Section 1 of Ordinance ~`o. 841 as amended by Ordinance No. 864 in order to pro- vide for the issuance of the full amount of bonds authorized by Article XXIV of the t Charter of the City of Ashland." The ordinance having been read the first time, on motion, the rules were suspended, six voting in favor thereof, and the ordinance was passed to the ;=~econd reading. Having beer. read the second time, roll call was ordered on its adoption. The vote was as follows: Ayes Bergner, Blake, Kay, Peters, ~f~hite, ~~'oods; nays none. Thereupon the Mayor decl~~red City Ordinance No. 85~ adopted. Pw~otion was made and seconded that the remaining x'125,000.00 dyater Bonds be advertised for sale, the time for the opening of the bids to be S o'clock F.M., Oct. 23rd, 1928. i Ca~~ried unanimously. The council next proceeded to consider a resolution entitled " Resolution proposing an amendment to the Charter of the City of Ashland, Jackson County, Oregon, to be known as Article KXVII of said charter, authorizing the r~dayor and Common Council to include in the a-rnual tax levy a sum equal to not to exceed one mill on each dollar of assessed valuation of property within the city, which sum shal~be used for the purpose of main- tenance and upkeep of cemeteries held by, or under the control of the City of Ashland, and for the purpose of efeating a trust fund for upkeep of said cemeteries; and further authorizing the Common Council to receive control for and on behalf of said city of any privately owned cemeteries thereon; and further authorizing the Common Council to create any fund or funds, either of a general or trust nature, for the purpose of maintaining the cemeteries under the jurisdiction of said Common Council; and further authorizing the Common Council to receive bequests and donations for purpose of assisting in carrying out intention hereof• and further rovidin that said ro osed charter amendment be submitted ~ p g P p to the electors of said city for their approval or rejection in the general election to be held on the 5th day of T~ovember, 1928; and further providing a ballot title for said measure." The resolution having been reed th? first time, on motion, the rules ~dere suspended, six voting in favor thereof, and the resolution was passed to tam second reading. Thereupon the i~~ayor declared the resolution adopted. v'~ The council next proceeded to consider a resolution entitled "Resolution proposing an amendment to the charter of the City of Ashland, Jackson County, Oregon, to be known as Section 5 of Article XIS of said charter, authorizing the Ashland Park Commission with the consent off' the Common Council to lease, on such terms as they deem best, but nor for a term of longer than ten years, that part of the Ashland Public Park System, known as the ~~~unicipal Auto Camp Ground, including that part used and required for auto camp cabins, providing that any such lease shall contain a clause prohibiting tie carrying on of any .y mercantile or garage business on said leased premises without first obtaining the unan- imous consent of the said Commission and the Common Council, and further providing th~.t said proposed charter amendment be submitted to the electors of said City for their approval or rejection at the general election to be held on the 6th day of November, 1928; and further providing a ballot title for said measure." Aw .±rav'..nmYw t~Y?rear~a„wm~m «.P~.... s. r ~~~t,~ The council next proceeded to consider a resolution entitled "Resolution proposing an amendment to the charter of the City of Ashland, Jackson County, Cregon, to amend Section 2 of Article II of said charter in order to fix the term of office of the Mayor and Councilmen for a four year period instead of the two year period as said terms now are, and further providing that the three candidates for councilmen receiving the hi hest number of votes as the eneral election to be held Tovember 6th, 1928, g g shall be deemed to be elected for a period of four years, and the three candidates for councilmen receiving tr.e next highest number of votes in said election shall be deemed to be elected for a period of two years, the intention being to cause the election of three councilmen only at every biennial general election hereafter; and further providing that said proposed charter amendment be submitted to the electors of said City for their approval or rejection at the general election to be held on the 6th day of November, 1928; and further providing a ballot title for said measure, and declaring an emergency." The resolution having been read the first time, on motion, the rules were suspended, ~'ix voting in favor thereof, and the resolution was passed to the second reading. Having been read the second time, roll call was ordered on its adoption. The vote on the motion was as follows: Ayes Bergner, Kay, Peters, `~Jhite, '~OOdS;Blake; nays none. Thereupon the ~riayor declared the resolution adopted. The council next proceeded to .consider an ordinance entitled "Ordinance levying special benefit assessments against property benefited by the construction of a sewer in what is known as Sewer District No. 30: in the City of Ashland, Oregon." The ordin- ance having been read the first time, on motion, the rules were suspended, six voting in favor thereof: and the ordinnce was passed to the second reading. Having been read the second time, roll call was ordered on its adoption. The vote was as follows: Ayes, Bergner, Blake, Kay, Peters, 'White, Moods; nays none. Thereupon the Mayor declared City 8rdinance No. 869 adopted. Motion was made and seconded that the back water and light bills of Mrs. M. A. Baldwin and ~Jrthur Tompkins be remitted and that they be granted free water and lights to Jan 1, 1929. Carried. rRoved by ~~Joods seconded by a~hite that the City engineer be instructed to prepare plans and specifications for the proposed cement sidewalks, curb and gutter to be constructed on North main and Bush Streets. A. ~~alone for the month of Se t., 1928, w<=s read and, on motion, p p accepted and ordered placed on file. j I Bills O.K'd by the Finance Committee, amounting to x;70,272.89, were read in total amount only. PRotion was made and seconded that said bills be allowed and warrants ordered drawn in~favor the~~eof. The vote was as follows: Ayes, Bergner, Blake, Kay, Peters, '~~Voods; nays none. Carried. was presented. Petition signed by residents outsieie the city limits, asking that the council place upon the ballot at the coming November election a charter amendment granting the council authority to sell water for domestic purposes outside the city limits. Mr. Galey, who presented the petition, was advised that the council desire a petition signed by citizens residing within the city limits. The l,~ayor declared the petition presented to be out of order and tasked that it be returned to the petitioners. Councilman Kay repo~tdd on the progress of the new street lighting system and stated that the lamps have been ordered from the ~~~'estinghouse Company. to Mr. Fred Snyder The utter of renting the Fourth Street Fire Station Building was referred to the Realty Committee with power to act. ~ the Recorder was instructed to communicate with the Park Commission, asking them to meet with the Council Thursday evening, Oct, 4th, for the purpose of duscussing the matter of the Root Bequest and the proposed charter amendment affecting the Park.
