by the City of Ashland, and agree to bear the proportionate payment of associated costs. This Agreement is to be binding upon
myself/ourselves, my/our heir(s), executors, and assigns, and it is my/our express intention that this Agreement shall run with the land, so
that fulfillment of the items listed below shall be binding upon future owners of the property.
ACTION: Agree to participate in the local improvement districts for the future improvement of Tolman Creek Road (sidewalks,
curbs, gutters and paving), and agree not to remonstrate to the formation of such local improvement district; and agree to pay
assigned share of such designated improvement costs.

1 East of the Willamette Meridian, Jackson County, Oregon; thence North 89049'45" West along the
North line of Section 23, 696.85 feet to a point on the Westerly right of way of Tolman Creek Road; thence
along said Westerly right of way, South 0105'47" East (Record South 0°7' East) 361.01 feet to the true
point of beginning; thence continue South 0105'47" East (Record South 0°07' East) along said right of
way, 250.66 feet to the Southeast corner of the tract described in Document No. 72-12011 of the Official
Records of Jackson County, Oregon; thence along the Southerly boundary of said tract, North 89°48'17"
