As grantor and owner of the property listed above, I hereby consent to the following improvements, dedication, or other actions as required
by the City of Ashland, and agree to bear the proportionate payment of associated costs. This Agreement is to be binding upon
myself/ourselves, my/our heir(s), executors, and assigns, and it is my/our express intention that this Agreement shall run with the land, so
that fulfillment of the items listed below shall be binding upon future owners of the property.
Action: The owner shall not install kitchen facilities into the garage. The existing property contains only one
single family residence and the garage will not be utilized as a separate residential unit. A separate, second
residential unit is not permitted without obtaining a conditional use permit approval, and therefore use of this
space as a separate dwelling would be a violation of the Ashland Municipal Code and subject to all penalties
thereof.

THIS INDENTURE, Made this 1 lth day of October, 2016, by and between Corey Fails, Sheriff of Jackson County, Oregon,
hereinafter called the grantor, and ROBERT CASSIDY, hereinafter called the grantee; WITNESSETH:
RECITALS: In a suit in the Circuit Court of the State of Oregon for Jackson County, Case No. 13CV03204, in which
JPMORGAN CHASE BANK, NATIONAL ASSOCIATION, was plaintiff and JONATHAN LEVANN; INDYMAC BANK F.S.B.;
OCCUPANTS OF THE PROPERTY, was/were defendant(s), for the foreclosure of a mortgage or trust deed on the real property
described below. A Writ of Execution of Foreclosure, which was issued on the 29th day of April, 2016, directing the sale of that real
property, pursuant to which, on the 2nd day of August, 2016, the real property was sold, subject to redemption, in the matter provided
by law, for the sum of $315,700.00 to ROBERT CASSIDY, who was the highest and best bidder, that sum being the highest and best
sum bid therefore. At the time of the sale, the purchaser paid the amount bid for the property to the grantor or grantor's predecessor in
office. At the sale a certificate of sale, as required by law, was duly executed and delivered to the purchaser.
The real property has not been redeemed from the sale, and the time for so doing has now expired. The grantee herein is the
owner and holder of the Certificate of Sale.
NOW, THEREFORE, in view of the premises, in order to complete the sale pursuant to law, and in consideration of the sum
paid for the real property at the sale, the grantor has granted, bargained, sold and conveyed and by these presents does grant, bargain,
sell and convey unto the grantee, grantee's heirs, successors, and assigns, that certain real property situated in Jackson County,
Oregon, described as follows, to-wit:
A tract or parcel of land, situated In the Northwest Quarter of Section 5, Township 39 South, Range 1 East,
Willamette Meridian in Jackson County, Oregon and being more fully described as follows: Commencing
at the 1 inch galvanized Iron pipe, with a 2'h Inch Diameter bronze cap, monumenting the Section
corner common to Sections 31 and 32, Township 38 South, Range 1 East, and Sections 5 and 6,
Township 39 South, Range 1 East, Willamette Meridian In Jackson County, Oregon; thence South, 578.71
feet, and East, 1703.05 feet, to a 1 inch galvanized Iron pipe, situated on the Southwesterly right of
way of North Main Street, as now monumented; thence along said right of way, South 43e 34' 55" East
(record South 43° 23' East, 76.57 feet), 76.925 feet, to a 5/8 Inch Iron pin; thence South 69e 48' 55" East
(record South 69e 40' East), 2,605 feet, to a 5/8 Inch Iron pin; thence leaving said right of way, South
40° 23' 53" West, 86.07 feet, to a 5/8 Inch Iron pin, situated on that certain Boundary Line Agreement,
recorded as Document No. 75-15347, Official Records of Jackson County, Oregon; thence along said
Agreement line, South 66° 55' 45" East, 37.415 feet, to a found % Inch galvanized Iron pipe, for the
true point of beginning; thence continue South 66e 55' 45" East, 70.96 feet, to a 5/8 Inch Iron pin; thence
South 40e 16' 31" East, 101.785 feet, to a 5/8 Inch Iron pin, situated on the Northwesterly right of way of
Ashland Mine Road (also known as Fox Street), as now monumented; thence along said right of way,
South 37e 57' 36" West, 54.00 feet, to a point on that Boundary Line Agreement, recorded as Document
No. 75-15347, said Official Records; thence leaving said right of way, and along said Agreement line,
North 40e 16' 31" West, 1.34 feet, to a found 1/2 Inch Iron pipe; thence continuing North 40° 16'31"
West, 103.70 feet, to a found'/. Inch pipe; thence Northwesterly, In a straight line, to the true point of
beginning.
Commonly known as 1131 N Main Street, Ashland, Oregon 97520.
Together with all of the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining and all of the
interest of the defendant(s) (and each of them) in and to the real property;
TO HAVE AND TO HOLD the same unto the grantee and grantee's heirs, successors, and assigns forever.
