SERVICES TO BE PROVIDED: Biological Evaluation of Imperatrice Property per Exhibit B
ADDITIONAL TERMS:
In the event of conflicts or discrepancies among the contract documents, the City of Ashland Contract for Personal Services will be primary and take
precedence, and any exhibits or ancillary contracts or agreements having redundant or contrary provisions will be subordinate to and interpreted in a
manner that will not conflict with the said rima Cit of Ashland Contract.
FINDINGS:
Pursuant to AMC 2.50.120, after reasonable inquiry and evaluation, the undersigned Department Head finds and
determines that: (1) the services to be acquired are personal services; (2) the City does not have adequate personnel nor
resources to perform the services; (3) the statement of work represents the department's plan for utilization of such
personal services; (4) the undersigned consultant has specialized experience, education, training and capability sufficient
to perform the quality, quantity and type of work requested in the scope of work within the time and financial constraints
provided; (5) the consultant's proposal will best serve the needs of the City; and (6) the compensation negotiated herein
is fair and reasonable.
NOW THEREFORE, in consideration of the mutual covenants contained herein the CITY AND CONSULTANT AGREE as
follows:
1. Findings 1 Recitations. The findings and recitations set forth above are true and correct and are incorporated herein
by this reference.
2. All Costs by Consultant: Consultant shall, at its own risk and expense, perform the personal services described
above and, unless otherwise specified, furnish all labor, equipment and materials required for the proper performance
of such service.
3. Qualified Work: Consultant has represented, and by entering into this contract now represents, that all personnel
assigned to the work required under this contract are fully qualified to perform the service to which they will be
assigned in a skilled and worker-like manner and, if required to be registered, licensed or bonded by the State of
Oregon, are so registered, licensed and bonded.
4. Completion Date: Consultant shall start performing the service under this contract by the beginning date indicated
above and complete the service by the completion date indicated above.
5. Compensation: City shall pay Consultant for service performed, including costs and expenses, the sum specified
above. Payments shall be made within 30 days of the date of the invoice. Should the contract be prematurely
terminated, payments will be made for work completed and accepted to date of termination.
6. Ownership of Documents: All documents prepared by Consultant pursuant to this contract shall be the property of
City.
7. Statutory Requirements: ORS 279C.505, 279C.515, 279C.520 and 279C.530 are made part of this contract.
8. Living Wage Requirements: If the amount of this contract is $20,283.20 or more, Consultant is required to comply
with chapter 3.12 of the Ashland Municipal Code by paying a living wage, as defined in this chapter, to all employees
performing work under this contract and to any Subcontractor who performs 50% or more of the service work under
this contract. Consultant is also required to post the notice attached hereto as Exhibit B predominantly in areas where
it will be seen by all employees.
9. Indemnification: Consultant agrees to defend, indemnify and save City, its officers, employees and agents harmless
from any and all losses, claims, actions, costs, expenses, judgments, subrogations, or other damages resulting from
injury to any person (including injury resulting in death), or damage (including loss or destruction) to property, of
whatsoever nature arising out of or incident to the performance of this contract by Consultant (including but not
limited to, Consultant's employees, agents, and others designated by Consultant to perform work or services
attendant to this contract). Consultant shall not beheld responsible for any losses, expenses, claims, subrogations,
actions, costs, judgments, or other damages, directly, solely, and proximately caused by the negligence of City.
10. Termination:

a. Mutual Consent. This contract may be terminated at any time by mutual consent of both parties.
b. City's Convenience. This contract may be terminated at any time by City upon 30 days' notice in writing
and delivered by certified mail or in person.
c. For Cause. City may terminate or modify this contract, in whole or in part, effective upon delivery of
written notice to Consultant, or at such later date as may be established by City under any of the following
conditions:
i. If City funding from federal, state, county or other sources is not obtained and continued at levels
sufficient to allow for the purchase of the indicated quantity of services;
ii. If federal or state regulations or guidelines are modified, changed, or interpreted in such a way
that the services are no longer allowable or appropriate for purchase under this contract or are
no longer eligible for the funding proposed for payments authorized by this contract; or
iii. If any license or certificate required by law or regulation to beheld by Consultant to provide the
services required by this contract is for any reason denied, revoked, suspended, or not renewed.
d. For Default or Breach.
i. Either City or Consultant may terminate this contract in the event of a breach of the contract by
the other. Prior to such termination the party seeking termination shall give to the other party
written notice of the breach and intent to terminate. If the party committing the breach has not
entirely cured the breach within 15 days of the date of the notice, or within such other period as
the party giving the notice may authorize or require, then the contract may be terminated at any
time thereafter by a written notice of termination by the party giving notice.
ii. Time is of the essence for Consultant's performance of each and every obligation and duty under
this contract. City by written notice to Consultant of default or breach may at any time terminate
the whole or any part of this contract if Consultant fails to provide services called for by this
contract within the time specified herein or in any extension thereof.
iii. The rights and remedies of City provided in this subsection (d)are not exclusive and are in
addition to any other rights and remedies provided by law or under this contract.
e. ObligationlLiability of Parties. Termination or modification of this contract pursuant to subsections a, b, or
c above shall be without prejudice to any obligations or liabilities of either party already accrued prior to such
termination or modification. However, upon receiving a notice of termination (regardless whether such notice is
given pursuant to subsections a, b, c or d of this section, Consultant shall immediately cease all activities under
this contract, unless expressly directed otherwise by City in the notice of termination. Further, upon termination,
Consultant shall deliver to City all contract documents, information, works-in-progress and other property that are
or would be deliverables had the contract been completed. City shall pay Consultant for work performed prior to
the termination date if such work was performed in accordance with the Contract.
11. Independent Contractor Status: Consultant is an independent contractor and not an employee of the City.
Consultant shall have the complete responsibility for the performance of this contract. Consultant shall provide
workers' compensation coverage as required in ORS Ch 656 for all persons employed to perform work pursuant to
this contract. Consultant is a subject employer that will comply with ORS 656.017.
12. Assignment and Subcontracts: Consultant shall not assign this contract or subcontract any portion of the work
without the written consent of City. Any attempted assignment or subcontract without written consent of City shall be
void. Consultant shall be fully responsible for the acts or omissions of any assigns or Subcontractors and of all
persons employed by them, and the approval by City of any assignment or subcontract shall not create any
contractual relation between the assignee or subcontractor and City.
13. Default. The Consultant shall be in default of this agreement if Consultant: commits any material breach or default
of any covenant, warranty, certification, or obligation it owes under the Contract; its QRF status pursuant to the QRF
Rules or loses any license, certificate or certification that is required to perform the Services or to qualify as a QRF if
consultant has qualified as a QRF for this agreement; institutes an action for relief in bankruptcy or has instituted
against it an action for insolvency; makes a general assignment for the benefit of creditors; or ceases doing business
on a regular basis of the type identified in its obligations under the Contract; or attempts to assign rights in, or
delegate duties under, the Contract.
14. Insurance. Consultant shall at its own expense provide the following insurance:
a. Worker's Compensation insurance in compliance with ORS 656.017, which requires subject employers to
provide Oregon workers' compensation coverage for all their subject workers
b. Professional Liability insurance with a combined single limit, or the equivalent, of not less than Enter one:
$250,000, $500,000, $1,000,000, $2,000,000 or Not Applicable for each claim, incident or occurrence. This is to
cover damages caused by error, omission or negligent acts related to the professional services to be provided
under this contract.
c. General Liability insurance with a combined single limit, or the equivalent, of not less than Enter one:
$200,000, $500,000, $1,000,000, $2,000,000 or Not Applicable for each occurrence for Bodily Injury and Property
Damage.
d. Automobile Liability insurance with a combined single limit, or the equivalent, of not less than Enter one:
$100,000, $500,000, $1,000,000, or Not Applicable for each accident for Bodily Injury and Property Damage,

e. Notice of cancellation or chance. There shall be no cancellation, material change, reduction of limits or
~ 'intent not to renew the insurance coverages) without 30 days' written notice from the Consultant or its insurer(s) to
the City.
f. Additional InsuredlCertificates of Insurance. Consultant shall name The City of Ashland, Oregon, and its
elected officials, officers and employees as Additional Insureds on any insurance policies, excluding Professional
Liability and Workers' Compensation, required herein, but only with respect to Consultant's services to be provided
under this Contract. The consultant's insurance is primary and non-contributory. As evidence of the insurance
coverages required by this Contract, the Consultant shall furnish acceptable insurance certificates prior to
commencing work under this contract. The certificate will specify all of the parties who are Additional Insureds.
Insuring companies or entities are subject to the City's acceptance. If requested, complete copies of insurance
policies; trust agreements, etc. shall be provided to the City. The Consultant shall be financially responsible for all
pertinent deductibles, self-insured retentions andlorself-insurance.
15. Governing Law; Jurisdiction; Venue: This contract shall be governed and construed in accordance with the laws
of the State of Oregon without resort to any jurisdiction's conflict of laws, rules or doctrines. Any claim, action, suitor
proceeding (collectively, "the claim") between the City (andlor any other or department of the State of Oregon) and
the Consultant that arises from or relates to this contract shall be brought and conducted solely and exclusively within
the Circuit Court of Jackson County for the State of Oregon. If, however, the claim must be brought in a federal
forum, then it shall be brought and conducted solely and exclusively within the United States District Court for the
District of Oregon filed in Jackson County, Oregon. Consultant, by the signature herein of its authorized
representative, hereby consents to the in personam jurisdiction of said courts. In no event shall this section be
construed as a waiver by City of any form of defense or immunity, based on the Eleventh Amendment to the United
States Constitution, or otherwise, from any claim or from the jurisdiction.
16. THIS CONTRACT AND ATTACHED EXHIBITS CONSTITUTE THE ENTIRE AGREEMENT BETWEEN THE
PARTIES. NO WAIVER, CONSENT, MODIFICATION OR CHANGE OF TERMS OF THIS CONTRACT SHALL
BIND EITHER PARTY UNLESS IN WRITING AND SIGNED BY BOTH PARTIES. SUCH WAIVER, CONSENT,
MODIFICATION OR CHANGE, IF MADE, SHALL BE EFFECTIVE ONLY IN THE SPECIFIC INSTANCE AND FOR
THE SPECIFIC PURPOSE GIVEN. THERE ARE NO UNDERSTANDINGS, AGREEMENTS, OR
REPRESENTATIONS, ORAL OR WRITTEN, NOT SPECIFIED HEREIN REGARDING THIS CONTRACT.
CONSULTANT, BY SIGNATURE OF ITS AUTHORIZED REPRESENTATIVE, HEREBY ACKNOWLEDGES THAT
HEISHE HAS READ THIS CONTRACT, UNDERSTANDS IT, AND AGREES TO BE BOUND BY ITS TERMS AND
CONDITIONS.
17. Nonappropriations Clause. Funds Available and Authorized: City has sufficient funds currently available and
authorized for expenditure to finance the costs of this contract within the City's fiscal year budget. Consultant
understands and agrees that City's payment of amounts under this contract attributable to work performed after the
last day of the current fiscal year is contingent on City appropriations, or other expenditure authority sufficient to allow
City in the exercise of its reasonable administrative discretion, to continue to make payments under this contract. In
the event City has insufficient appropriations, limitations or other expenditure authority, City may terminate this
contract without penalty or liability to City, effective upon the delivery of written notice to Consultant, with no further
liability to Consultant.

EXHIBIT A
CERTIFICATIONS/REPRESENTATIONS: Contractor, under penalty of perjury, certifies that (a) the
number shown on the attached W-9 form is its correct taxpayer ID (or is waiting for the number to be
issued to it and (b) Contractor is not subject to backup withholding because (i) it is exempt from
backup withholding or (ii) it has not been notified by the Internal Revenue Service (IRS) that it is
subject to backup withholding as a result of a failure to report all interest or dividends, or (iii) the IRS
has notified it that it is no longer subject to backup withholding. Contractor further represents and
warrants to City that (a) it has the power and authority to enter into and perform the work, (b) the
Contract, when executed and delivered, shall be a valid and binding obligation of Contractor
enforceable in accordance with its terms, (c) the work under the Contract shall be performed in
accordance with the highest professional standards, and (d) Contractor is qualified, professionally
competent and duly licensed to perform the work. Contractor also certifies under penalty of perjury
that its business is not in violation of any Oregon tax laws, and it is a corporation authorized to act on
behalf of the entity designated above and authorized to do business in Oregon or is an independent
Contractor as defined in the contract documents, and has checked four or more of the following
criteria:
(1) I carry out the labor or services at a location separate from my residence or is in a
specific portion of my residence, set aside as the location of the business.
(2) Commercial advertising or business cards or a trade association membership are
purchased for the business.
(3) Telephone listing is used for the business separate from the personal residence listing.
(4) Labor or services are performed only pursuant to written contracts.
(5) Labor or services are performed for two or more different persons within a period of one
year.
(6) I assume financial responsibility for defective workmanship or for service not provided

Introduction
A biological evaluation (Evaluation) is requested by the City of Ashland, Oregon (City) to be conducted on
the City's Imperatrice Property (Property), with the purpose of aiding the City indecision-making processes
for future uses of the Property. Pacific Crest Consulting, LLC (Pacific Crest), proposes to conduct the
Evaluation as follows.
The Evaluation would include:
• Pre-field project review and assessment of existing reports, spatial data, target species lists, and other
resources applicable to the Property, originating from:
o Government agencies:
■ US Fish and Wildlife Service (USFWS)
■ US Bureau of Land Management (BLM)
■ US Forest Service (USES)
■ Oregon Dept. of Agriculture (ODA)
■ Oregon Dept. of Fish and Wildlife (ODFW)
o The Oregon Biodiversity Information Center (ORBIC)
o University herbaria and databases (Southern Oregon University, Oregon State University, and
others)
o Knowledge of Pacific Crest staff, university experts, and other local biologists
• .The following target species lists would be implemented, species on which are hereafter collectively
referred to as Special Status Species (SS Species):
o USFWS Threatened and Endangered Species including Candidate species and Species of Concern
o Interagency Special Status and Sensitive Species Program, Regional Forester's Special Status
Species List for Region 6
o Medford District BLM and Rogue River-Siskiyou National Forest Sensitive/Strategic lists

As part of this proposal, Pacific Crest agrees to implement any feasible changes made to the above SS
Species lists during the performance time of the Botanical Study. Pacific Crest also agrees to physically
mark SS Species populations in the field using pin flags, if desired by the client.
Protocol surveys (often referred to as full surveys) for SS Species of plant, lichen, and fungi surveys would
follow Intuitive and Complete methods established and currently implemented by the BLM and USFS. This
methodology involves traversing the survey area in transects approximately 60-75 meters apart. When
special habitats are encountered, a more intensive search is conducted.
Protocol surveys for Grasshopper Sparrows would follow gridded transects that traverse the survey area
with 100 meter spacing between transects. Point-counts would be conducted along each transect at 50
meter intervals.
Informal surveys for SS Species of birds other than Grasshopper Sparrows, invertebrates, reptiles, and
amphibians would be conducted along protocol surveys. Although these species would be actively

searched for, the actual survey timing and implemented protocols may or may not be specific to certain
species of these animal groups.
In addition to dense concentrations of noxious weeds, documentation would be provided for all noxious
weed species identified as high priority by ODA or new invaders to the region; the latter being important
due to the adjacent I-5 corridor functioning as a prime dispersal vector of weeds from other regions.
Crew Structure and Schedule
Crew Structure
Scot, Loring, botanist/mycologist and an owner of Pacific Crest, would function as Project Supervisor. He
would conduct all communications with the client(s), lead the field effort, perform internal inspections,
and write the final reports. In the field, he would be accompanied by one other Pacific Crest biologist,
Jason Brooks. Mr. Brooks would also assist in the pre-field project assessment and final reports. Both
personnel are available for full-time work on this project during the proposed schedule below.
Biological SurveySchedule
Surveys for SS Species of vascular plants would commence in April 2017, immediately after contract award,
in order to catch early-season flowering species such as the Endangered Fritillaria gentneri. A pre-bid site
visit conducted by Scot Loring revealed multiple populations of the SS Species Ranunculus austro-oreganus
already in flower; two sites of California macrophylla were also detected but not yet flowering. Surveys for
SS species of non-vascular plants, lichens, and spring fungi would be performed concurrently with the early
season vascular plant surveys and would add relatively little survey time due to them occurring in the same
habitats visited for vascular plants. Early-season vascular plant surveys would be completed by early May
2017. Surveys for later-season SS Species of vascular plants would be performed concurrently with
Grasshopper Sparrow surveys (see below). Inventories of unique biological features, inventories of all
plant species encountered on the Property, and informal surveys for the additional taxa groups mentioned
above would be performed concurrently with the SS Species surveys.
Surveys for Grasshopper Sparrows would take place during mid to late May in order to coincide with the
breeding season of this bird. These surveys would span approximately one to two weeks.
Reporting /Final Documentation
All deliverables would be submitted to the City no later than August 15, 2017. This date is flexible,
depending on the needs of the client.

Overview
Pacific Crest Consulting, LLC, is a small business providing environmental consulting services throughout
the western United States, primarily Oregon, Washington, and northern California. The majority of their
work has been performed in southwestern Oregon. They are based in Ashland, Oregon, with all staff
residing in the Ashland area. For the past 19 years, they have been providing their services to federal
agencies, universities, private sector, and other clients. Pacific Crest personnel each have many years of
biological work experience and have an intimate knowledge of the biology and ecology of southwestern
Oregon. They offer competitive rates and have built a solid reputation for providing quality services and
products in a timely manner.

Pacific Crest personnel specialize in the following services:

surveyed. Over 650 Special Status and Survey & Manage species sites were located, including Bridgeoporus

PROFESSIONAL EXPERIENCE
Mr. Brooks is a consulting botanist with seventeen years of experience implementing botanical studies and
wildlife investigations. During his career, he has conducted field investigations throughout the states of
Oregon, California, Washington, Arizona, Utah, Wyoming and Nevada in a variety of biological communities.
These include valley grassland, oak woodland, riparian woodland, coastal sage scrub, interior chaparral, vernal
pool, tidal salt marsh, alpine barrens and mountain ranges including the Cascades, Klamaths, Siskiyous, and
Sierra Nevada. Desert investigations include Mojave, Great Basin and Sonoran deserts. He has conducted site
investigations, investigated rare plant occurrences, evaluated habitat for special status plant and animal species,
performed habitat analyses and evaluations, performed restoration verification and mapped vegetation types.

CASCADE SISKIYOU KLAIVIATH AND SIERRA NEVADA MOUNTAIN RANGES
~Current''`Rare Plant and Lichen Surveys, OR. Ongoing contracts with the Grants Pass, Butte Falls,
Eugene, Salem and Ashland BLM districts I RA's. As a member of a small team of botanists Mr. Brooks has
been surveying small to large forested areas over all of western Oregon for the past 15 years. Target species
are vascular and nonvascular species as well as lichens. During this work, many new state records and range
extensions have been found including the lichen species Ramalina internzedia (previously unknown in the

lower 48 states). Outstanding bryophyte discoveries include Gymnostomum calcareum var. viridula (ORBIC
3), Tortella tortuosa (ORBIC 3), Ditrichum flexicaule (ORBIC 3), Ditrichum `nova", Campylopodiella
flagellacea (OIZBIC 3), Plagiothecium piliferum (ORBIC 3), and Pseudoleskeella "nova". Outstanding
vascular discoveries include many new populations of the federally endangered Fritillaria gentneri (FE), and
the only known population of Arctostaphylos hispidula (ORBIC 2) and the only extant population of California
macrophyllum (ORBIC 1) known in t11e state of Oregon.
XCurrentXRare plant and Lichen Surveys, Gifford Pinchot National Forest, WA. Part of a small team of
botanists working on an on call contract with the forest to locate rare plant and lichen species for a variety of
projects. Duties include identifying to species all vascular, bryophyte and lichen species found within project
areas as well as noxious weed mapping. Notable taxa discovered thus far include the pin lichen species
Caliciur~~ adequatum and old growth forest obligates such as Pseudocyphellaria rainierensis and Nephroma
occultum.
Rare plant surveys, Tehachapi 1Vlountains, CA. Performed protocol level rare plant surveys in support of a
Cal-Portland expansion project near Mojave, CA. During the survey a new population of the extremely rare
Opuntia basilaris var. treleasei (GNPs IB.1) was discovered, as well as a small population of Saltugilia
latimeri (GNPs 1B.2). The latter represents a significant range extension from previous known occurrences
near the San Bernardino Mountains and the Mojave National Preserve.
Rare bryophyte and lichen surveys, Mt. Hood National Forest. Surveyed two miles along Whitewater
Creek in the north Oregon Cascade Mountains for rare species of bryophytes and lichens. During this survey
Mr. Brooks discovered two new populations of Tetj°aplodon mnioides and one new population of lljephroma
occultum, along with many new sites of Peltigera pacifica and Chaenotheca spp.
Noxious weed surveys, Willamette and NIt. Hood National Forests. In support of Pacific Power's FERC
relicensing project, Mr. Brooks and a team of botanists surveyed for the noxious weeds Cirsium a~vense,
Hypericum perforatzcm and Cytisus scoparius. During this survey the team recorded and mapped hundreds of
new locations of these noxious weeds.
Riparian restoration verification, Rogue Valley OR. In 2014 Mr. Brooks received training as a restoration
project verifier within the ecological account crediting system (ECAS) framework in conjunction with the non-
profit group Willamette Partnership. This work includes on ground verification of riparian restoration for use
in the sale of shade credits as mitigation for thermal load fluctuations caused by releasing treated water into
salmon bearing streams and rivers by municipalities. Duties include verification of restoration planting and
verification of ownership and legal rights of access for manipulation and use of restoration property.
Rare bryophyte surveys, Spring Gap-Stanislaus Project, Strawberry, CA. Conducted rare bryophyte
surveys for Pacific Gas and Electric Company's Spring Gap-Stanislaus Hydroelectric Project. During this
project Mr. Brooks identified all bryophytes and lichens found within sample locations throughout the project
area.
Rare plant and fungi surveys, Willamette and 1VIt. Hood National Forests. Member of a large team of
botanists conducting field surveys for Portland Gas & Electric for a new transmission line through the Cascades
in northern Oregon. Duties include identification of all vascular, nonvascular, lichen and fungi located.
Additional duties include field coordination of crews, compilation of data, and compound microscopy. In
addition Mr. Brooks conducted a separate investigation to collect and identify all bryophytes ofthe Breiteinbush
drainage to add to the collections at the herbarium at Southern Oregon University. Notable bryophyte
collections inchide Forest Sensitive species, 1~lyurella julacea, Plagiothecium piliferum, Tetrapolodon

mnioides, and Taylor~ia se~r~ata. h1 addition a new species of the liverwort Mai°supella nova in
ed. "(cascadensis)"ryas discovered. Also two new species from the fungi genus Ramaria.were discovered by
the team though these have yet to be described. Notable range extensions noted from the survey include the
lichen species Melanelia comixta, Umbilica~ia ~igida, and Umbilicaria havaasii.
Bryophyte identification, Tahoe, Sierra, Inyo, Humboldt National Forests. Responsible for identification
of all bryophyte field collections from a variety of consulting firms. Bryophytes are collected over many
habitats and over many different mountain ranges throughout California and Nevada. Duties include compound
microscopy, and report writing.
Rare plant surveys, Piute Mountains, Southern Sierra Nevada, CA. Member of a small team of botanists
working over a two year period to determine feasibility of a new wind facility in the Piute Mountains near
Tehachapi, CA. Duties included identification of all vascular and bryophyte plant species found within the
project area as well as cataloging and mapping of all rare taxa. During the survey Mr. Brooks discovered what
is now a new species to California Triteleia piutensis. In addition the team discovered the third known
population of Eriogonum kennedyi var. pinicola {CNPS 1B.1) known in California. Additional species of note
include Allium shevockii (CNPS 1B.3) and Eriast~um tracyi (CNPS 1B.2).
]Environmental assessment, biological evaluation, Shasta Trinity National Forest. Was a member of an
interdisciplinary team in conjunction with the Shasta Trinity National Forest to write an environmental
assessment for road closures on the forest. During this process Mr. Brooks was responsible for writing the
biological evaluation for forest sensitive plant species occurring within the project area.
Rare plant surveys, Cascade Siskiyou National Monument, OR. Completed a two year project to census
all rare plant occurrences (both vascular and non-vascular) within the 50,000 acre Cascade Siskiyou National
Monument. During the two year study Mr. Brooks documented over 100 rare plant sites and the team as a
whole over 300 within the first year (2007).
Mollusk surveys, Rogue Siskiyou National Forest, OR. Beginning in 2006 Mr. Brooks and small team of
wildlife biologists began surveying the Ashland watershed of the Siskiyou Mountains in southern Oregon for
the extremely rare mollusk species Monadetzia chaceana. The team surveyed 8,000 acres and found three new
populations of this terrestrial mollusk in addition to documenting several species previously unknown in the
area.
Rare plant monitoring and road mapping, Stanislaus National Forest, CA. Mapped all roads and
monitored all known rare plant populations along the Donnell-Curtis transmission line right-of way for Pacific
Gas & Electric. Monitored species included Lomatium stebbinsii (CNPS 1B.1), Alliu~~ t~^ib~acteatun~ (CNPS
1B.2) and Mit~zulus pulchellus (CNPS 1B.2).
Riparian stream monitoring, North Fork of the Feather River, CA. A member of a small team of biologists
tasked with constructing a long term monitoring program to consider the effects of stream flow manipulation
by hydroelectric facilities on streamside vegetation. This project involved taking detailed measurements of the
streambed and determining baseline vegetation densities as well as species composition immediately adjacent
to the river.
Rare plant surveys, Middle Fork of the Stanislaus River, CA. In support of PG&E's FERC relicensing
project, Mr. Brooks coordinated and performed rare plant surveys throughout the project area, provided
vegetation maps of the project area, and contributed to the final report to the US Forest Service. Mr. Brooks

located one new population of mountain lady's slipper (Cypj~ipedium ~nontanz~nz CNPS 4), and relocated several
additional known rare plant populations.
Small mammal trapping, Lake Tahoe, CA. Performed small mammal trapping transects for the US Forest
Service around the Lake Tahoe basin. This study is part of an ongoing yearly investigation to census small
mammals in this area, as well as discovering habitat partitioning among different species of chipmunks,
squirrels and mice. Project involved laying out large Sherman trap grids, checking these grids twice per day
and taking a series of measurements and observations on all animals captured.
Noxious weed surveys, North Fork of the Feather River, CA. This survey was pa1-t of PG&E's requirements
determined by the Federal Energy Re-licensing committee (FERC) for the rock creek-cresta hydroelectric
project. Mr. Brooks performed surveys for noxious weeds on a ten mile stretch of the North Fork of the Feather
River. The project utilized highly innovative mobile GPS and GIS technologies to accurately and quickly map
weed occurrences.
SIERRA NEVADA FOOTHILLS AND CENTRAL VALLEY
San Joaquin Valley and Sacramento Valley Biological Services. Conducted biological resources evaluations
along three projects located in the San Joaquin Valley, Sacramento Valley, and the Sierra Nevada foothills near
New Melones Lake, CA. Responsibilities included conducting habitat-typing and reconnaissance-level
biological surveys along over 250 miles of transmission line right-of way and access roads for sensitive
biological resources including wetlands, vernal pools, and sensitive wildlife and plant species and habitats.
Rare Plant Surveys, DeSabla-Centerville CA. Mr. Brooks performed rare plant surveys in support of PG&E's
FERC relicensing project for the DeSabla-Centerville Hydroelectric project located on Butte Creek near Chico,
California. During this survey many new populations of Butte County morning glory (Calystegia att~iplicifolia
ssp. buttensis CNPS 4.2), white stemmed clarkia (Claj~kia g~acilis ssp. albieaulis CNPS 1B.2), shield-bracted
monkeyflower (Mimulus glaucescens CNPS 4.3) and Jepson's onion (Allium jepsonii CNPS IB.2) were
located.
Rare plant surveys, East Park Reservoir, CA. Performed surveys for special status plants for the U. S. Bureau
of Reclamation to determine the feasibility of turning the facility over to the US Forest Service for management.
Many new populations of extremely rare plants were found including Colusa layia (Layia septent~~ionalis
(CNPS 1B.2), red flowered bird's foot (Act~~ispon ruby flows CNPS 1B.I), Brandegee's eriastrum (Eriastrum
b~andegeeae CNPS IB.I), and adobe-lily (Fr~itillaNia plus°iflo~a CNPS 1B.2).
Rare plant monitoring, Napa County, CA. Performed two years of plant monitoring for known populations
of Harn~onia hallii (CNPS 1B.2) in support of a mitigation measure for a new fiber optic line between
Dunnigan, CA and Manchester, CA. Mr. Brooks monitored four known populations and composed the
subsequent monitoring reports.
MOJAVE DESERT
Rare plant surveys for the Soda Mountain Solar Project, East Mojave Desert, CA. Conducted focused
botanical surveys for fall-flowering special-status plants at the proposed Soda Mountain Solar Project in the
east Mojave Desert near Baker, CA. The botanical surveys focused on locating fall-blooming rare plants within
the approximately 4,075-acre survey area. Wildlife species including special-status species were also recorded
incidentally during this survey. During the survey the team relocated on known population of Crucifixion
thorn C,astela en2or~yi (CNPS 2.2).

Rare plant surveys, Spring Mountains, NV. Conducted rare plant surveys in support of a gas line crossing
the Spring Mountains that would support a new solar facility in the Pahrump Valley of southern Nevada. Duties
included determination of all species encountered during the survey and subsequent mapping of rare plant taxa.
During the survey Mr. Brooks discovered three new populations of Clokey's buckwheat (E~iogonum
hee~°mannii var. clokeyi, BLM-SEN).
Rare plant surveys, Ivanpah Valley, CA. Conducted rare plant surveys just east of the Clark Mountains
outside of the Mojave National Preserve to determine feasibility of a new solar installation. In addition to
collecting survey data, Mr. Brooks was a crew leader for this proj ect and was responsible for coordinating field
personnel on a daily basis. During the survey Mr. Brooks and his crew discovered new populations of desert
pincushion {Co3yphantha chlor~antha CLAPS 2.1), Mojave milkweed (Asclepias nyctagini~ folia CLAPS 2.1), nine
awned pappus grass (Enneapogon desvauxii CLAPS 2.2), Rusby's desert-mallow (Sphaer~alcea ~usbyi var.
e~emicola CLAPS 1B.2), and Utah milkvine (Cynanchum utahense CLAPS 4.2).
Rare plant surveys, Mormon Mesa, NV. Conducted rare plant surveys west of Mesquite nevada in support
of a potential solar facility. In addition to surveying Mr. Brooks led large crews for this project and was
responsible for coordinating field personnel on a daily basis. In addition he was often tasked with downloading
data from up to 30 Trimble GPS units per day, organizing this data and coordinating with GIS staff on the
results.
Habitat assessment for Iberdrola Renewables, Amargosa Valley, NV. One of a two member team assessing
the possibility for rare or endangered taxa within the boundaries of a proposed solar facility near the Spring
Mountains. Duties included site analysis and a subsequent report detailing feasibility of the installation from
an environmental standpoint.
Rare plant surveys, Kern Pipeline, NV. Mr. Brooks coordinated and performed rare plant surveys for the
second Kern Pipeline project beginning in Mesquite, NV and terminating in Bakersfield, CA. The project
involved searching for new populations of special status plant species as well as characterization of all plant
association types. During the survey Mr. Brooks located new populations of the Las Vegas bear poppy
{Arctomecon me~riamii, CLAPS 2.2), three-cornered milkvetch (Astragalus geyeri var. tj~iquetrus NNPS-
threatened), and rosy two-toned beardtongue (Penstemon bicolor ssp. ~~oseus CLAPS 1B.1).
Rare plant and desert tortoise surveys, US Borax, CA. Performed tortoise surveys and vegetation analysis
for two separate expansion projects for the US Borax company in Boron Califonlia. These surveys occurred
five times over a six year period. These surveys also included searching for the watch list species Mojave
spineflower (Cho~izanthe spinosa CLAPS 4.2) of which several populations were encountered.
Rare plant and desert tortoise surveys, Topock Compressor Station, Needles CA. Performed. desert
tortoise and rare plant surveys for Pacific Gas & Electric on numerous occasions over a four year period
documenting all federal and state listed plant and wildlife species.
Rare plant and desert tortoise surveys, US Marine Corps, Twentynine Palms, CA. This project was the
baseline study in an ongoing two year investigation studying the effects of relocation on desert tortoise within
the military reservation. Duties for the baseline study were protocol USFWS surveys for both plants and
tortoise over the 2000 acre project area. During this survey 3 live tortoises were discovered and many active
burrows were also found.
Rare plant and desert tortoise surveys,'Grow the Force', US Marine Corps, Twentynine Palms, CA. One
member of a small team conducting protocol level desert tortoise surveys over a two year period. The project

occurred along two different corridors between the military reservation and the town of Twentynine Palms,
CA. During this 2 year survey a total of 11 tortoises were discovered as well as many populations of the watch
list plant Funastrunz utahense (CNPS 4.2) .
SONORAN DESERT
Rare plant surveys, Blythe, CA. Performed rare plant surveys over an 8000 acre site in support of a new
solar facility new Blythe California. Duties included recording all plant species detected during the surveys
and mapping and cataloging all rare plant species found. During the survey Mr. Brooks found many populations
of Ast~^agalus insularis var. ha~woodii (CNPS 2.2), and E~iastru~n ha~woodii (CNPS 1B.2).
Burrowing owl surveys, Blythe, CA. Conducted burrowing owl surveys in April and May 2012 for a proposed
solar facility in the Sonoran Desert region of California near Blythe, CA. The purpose of the burrowing owl
surveys was to locate and map occurrences of burrowing owls, sign, and occupied burrows within the proposed
project area.
Habitat assessment for Iberdrola Renewables, Ogilby, CA. One of a two member team assessing the
possibility of occurrence for rare or endangered taxa within the boundaries of a proposed solar facility just
south of the Chocolate Mountains. Though this was a reconnaissance level survey, one previously
undocumented population of pink fairy-duster (Calliandra e~iophylla CNPS 2.3) was discovered.
Rare Plant and Wildlife Habitat Assessment, Devers-Palo Verde Transmission Line, Blythe CA. One
member of an interdisciplinary team working on site location of transmission line towers for a new transmission
line for Southern California Edison. Responsible for determination of suitable habitat for special status species
as well as identifying previously unknown occurrences of these species during the reconnaissance survey.
Habitat Assessment, US Border Patrol, Southern Arizona. Part of an interdisciplinary team that determined
environmental impacts to "sky island" and desert mountain ranges across the US-Mexico border in southenl
Arizona. Duties included evaluating potential habitat for rare plant species on remote peaks for radio
transmission tower upgrades.
Biological Monitor for Level 3 Communications, El Centro, CA. Monitored directional drilling crews
between Yuma AZ and San Diego California for a fiber optic line. This project was multi jurisdictional and
crossed lands managed by both the Bureau of Land Management and the U.S. Forest Service. Mr. Brooks was
approved to monitor for Desert tortoise, flat-tailed horned lizard and burrowing owl i~1 the Imperial Valley and
for Yuma clapper rail and black rail in the section near Yuma, AZ where the line crossed the Colorado River.
This project lasted approximately six months in duration.
GREAT BASIN
Noxious weed surveys, Lakeview BLM, OR. Part of ongoing project to map and eradicate noxious weeds
within the habitat of the Greater Sage Grouse. This project has focused on uplands and river canyons just east
of the Warner Mountains, OR.
Habitat assessment, Prineville, OR. In support of Apple computer's new server farm just west of Prineville,
OR, Mr. Brooks and a wildlife biologist conducted assessments of properties on two separate occasions to
determine potential impacts to rare taxa.
Grazing study, Fallon, NV. Mr. Brooks and one other botanist undertook a feasibility study for the Paiute -
Shoshone tribe of Fallon, NV to determine the carrying capacity of a small piece of land for cattle grazing.

This study involved extrapolating the amount of forage by weight in small exclosures and extrapolating this
across the range to determine the number of cattle suitable for the property.
Rare plant survey, Bishop, CA. In support of a the Paiute-Shoshone tribe's application to build several new
homes on scattered sites around Bishop, CA. Mr. Brooks and a wildlife biologist conducted surveys for rare
taxa to determine potential impacts to sensitive resources.
botanical transects, Ecological Restoration Institute, Northern Arizona University, AZ. One of a 4
member botanical crew responsible for collecting all baseline botanical data in support of a large scale
ponderosa pine forest restoration effort. Field locations for this study included Mt. Trumball, AZ, the north rim
of Grand Canyon National Park and- several locations near Flagstaff, AZ. Duties included daily botanical
transects as well as tree coring and data interpretation.
COASTAL COMMUNITIES
Rare plant surveys, Otay Mesa, CA. Performed a series of 3 rare plant surveys of the Otay Mesa (San Diego,
CA) for anew CalTransright-of way. The project located many rare species in the 1400 acre parcel, including
many narrow endemics. These included variegated Dudleya (Dudleya variegata CNPS 1B.2), San Diego
button celery (Eryngium aristulatum var pa~ishii CNPS 1B.1), San Diego goldenstar (Muilla clevelandii CNPS
1B.1), Munz's sage (Salvia munzii CNPS 2.2) and San Diego barrel cactus (Ferocactus vi~idescens CNPS 2.1).
In addition many populations of San Diego County viguiera (Viguiera laciniata CNPS 4.2), and small-flowered
molding glory (Convolvulus simulans, CNPS 4.2) were also located.
Del Mar manzanita census, Miramar Marine Corps Air Station, San Diego, CA Conducted a complete
census of the federally endangered Del Mar manzanita (Aj°ctostaphylos glandulosa ssp. crassifolia) on
Miramar Marine Corps Air Station. Survey included mapping and collecting data on all Del Mar Manzanita
plants located on military lands. Mr. Brooks located and installed monitoring plats that will be used by military
personnel to determine reference conditions and the change in manzanita populations over time. In addition
Mr. Brooks wrote the final report detailing all aspects of the work performed.
Revegetation of coastal sage scrub, Camp Pendleton. CA. Mr. Brooks drafted a revegetation plan for the
United States Marine Corps for the area surrounding a new water treatment facility. This report detailed a five
year plan in including implementation, irrigation and weed control. In addition to the design, Mr. Brooks was
directly involved in overseeing the implementation of the project.
Rare plant survey, False Lake Meadow, Annadel State Park, CA. One of two botanists asked to survey this
meadow in support of a new trail system for receation. During the survey Mr. Brooks discovered and mapped
new populations of Calochortus uniflorus (CNPS 4.2).
Rare plant surveys, Napa-Sonoma transmission line upgrade, CA. Mr. Brooks assisted with rare plant
surveys throughout Napa and Sonoma counties to determine possible routes for additional transmission line
corridors while minimizing impacts to special status plant species.
Rare plant surveys, Elysian Reservoir, Los Angeles, CA. Performed rare plant surveys around a small
reservoir adjacent to Dodger Field in central Los Angeles.
Rare plant survey, Mallard Slough, CA. Conducted a rare plant survey for a potential natural gas drilling
site on Mallard Island located along Suisan Bay in Contra Costa County California. During the survey two

new populations of special status plant species were located, Mason's Lilaeopsis (Lilaeopsis masonii CNPS
1B.1), and delta mudwoi-t (Limosella subulata CNPS 2.1).
Vegetation mapping, Sonoma-NIarin Rapid Transit, I~Iarin and Sonoma counties, CA. one of a two
member crew responsible for habitat mapping the entire route of a proposed rail line that would join the San
Francisco bay, CA to northern Sonoma county.
WILDLIFE
Avian point counts,lVlojave Solar Project, Hinkley, CA. As one of the lead environmental inspectors of the
Mojave Solar Project, Mr. Brooks is responsible for performing daily bird point counts, performing noxious
weed surveys, and ensuring that Abengoa Solar was in compliance with all environmental regulations required
by the California Energy Commission and U.S. Fish and Wildlife Service. During this project Mr. Brooks
workied to facilitate a study examining the effects of different deterrent methods to prevent birds from entering
the facility's evaporation ponds. This study included deploying different deterrent measures such as propane
cannons, 'scare eyes' and radar detection for deployment of lasers and cannons.
Avian point counts, desert tortoise surveys, Amboy, CA. Conducted multiple rounds of surveys in support
of a proposed solar facility southwestof Amboy, CA. In addition to collecting data Mr. Brooks led large crews
of surveyors and was responsible for coordinating field personal and data throughout all surveys performed for
this project.
Nesting bird surveys and nest monitoring, Salt River Ecosystem Restoration Project, CA. Mr. Brooks
conducted nesting bird surveys for the Salt River Ecosystem Restoration Project near Ferndale in Humboldt
County, CA. The focus of this survey was to determine the locations of all nesting birds. The focus of this
work was on nesting grassland sparrows such as Savannah sparrow, Grasshopper sparrow and Song sparrow.
Duties also included monitoring known nests during active construction
Daily bird point counts, USGS, Fort Collins, CO. Mr. Brooks was responsible for conducting botanical
transects and avian point counts on all research sites in support of a research project detailing the effects of
prairie dog towns on bird populations. Field locations included the Aubrey Valley of AZ, Dinosaur National
Monument, CO as well as areas adjacent in UT, and two locations in southeast WY.
Burrowing owl surveys, Blythe, CA. Conducted burrowing owl surveys in support of a proposed solar facility
in the Sonoran Desert region of California near Blythe, CA. The purpose of the burrowing owl surveys was to
locate and map occurrences of burrowing owls, sign, and occupied burrows within the proposed project area.

Protocol mollusk surveys for the U.S. Forest Service in the Siskiyou Mountains near Ashland, and Rogue River
National Forest. Surveys focused on presencelabsence of the Forest Sensitive species Siskiyou sideband (Monodenia
chaceana). Duties included identification of adequate mollusk habitat and identification of all mollusks found to
species.

Conducted rare plant surveys just east of the Clark Mountains to determine feasibility of a new solar installation. Ms.
Moser and her crew documented new populations of Coryphantha chlof°antha, Asclepias nyctaginifolia, Enneapogon
desvauxii, Sphaeralcea rusbyi var. eremicola, and Cynancliuln utahense.
Del Mar Manzanita census and monitoring, MCAS Miramar, CA
Conducted a complete census of the federally endangered Del Mar Manzanita (Arctostaphylos glandulosa ssp.
crassifolia). Mapped and collected data on all Del Mar Manzanita plants located on military lands, developed
monitoring plots for long term use.
Re-vegetation of coastal sage scrub, Camp Pendleton, CA
Identified and eradicated non-native species at GANDA's four acre coastal re-vegetation site.
Grazing study, Paiute Shoshone Indian reservation, Fallon., NV
Project design and implementation to determine forage value of wetland and salt scrub habitats on over 600 acres of the
Paiute Shoshone Indian reservation. Duties included identification of plants to species, clipping and sorting vegetation
and data entry.

Southern Oregon University
Worked as part of a collaborative group to study ectomycorrhizas on Quercus garryana. Individual research focused
on serpentine and non-serpentine soil comparisons. Developed sampling and morphotyping protocols. Collected soil
and sporocarps from field sites, sorted mycorrhizal tips from soil. Collected images, compared mycorrhizal tips, and
updated database. Extracted fungal DNA, and then amplified using PCR, RFLP, and sequencing. Statistical analysis.
Identified possible matches between mycorrhizae and sporocarps using molecular data. Presented results in written and
oral form, used web based references and scientific journals to prepare papers.
