The proposed partition and boundary line adjustment will create one additional lot, by dividing the two existing parcels into a three parcel configuration. COMPREHENSIVE PLAN DESIGNATION: Multifamily Residential; ZONING: R-2; ASSESSOR'S MAP: 39 lE I IC TAX LOTS: 2500 &2504. The Community Development Director's decision becomes final and is effective on the 121'' day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.G.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Time for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content of Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised during the public comment period. d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before the Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5.1.060, subsections A - E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 197.805 - 197.860. COMPREHENSIVE PLAN DESIGNATION: Multifamily Residential; ZONING: R-2; ASSESSOR'S MAP: 39 IE 11C TAX LOTS: 2500 & 2504 SUBMITTAL DATE: March 22, 2016 DEEMED COMPLETE DATE: April 6, 2016 STAFF APPROVAL DATE: May 6, 2016 FINAL DECISION DATE: May 18, 2016 APPROVAL EXPIRATION DATE: November 18, 2016 DECISION The subject properties are a combined 4.1 acres and are located east of Clay Street, south of Villard St., and east of Engle St. The properties include the original farm house and barn at 380 Clay Street and a public park located east of Engle Street. The application is for a land partition approval to divide the subject property into three parcels. Parcel labeled number one, the eastern most lot, will be 112,027 square feet. The middle lot, parcel number two, will be 33,730 square feet and parcel three is proposed to be 14,000 square feet. All of the proposed parcels exceed the R-2 zone's minimum 5,000 square foot lot size, comply with the dimensional requirements of the Unified Land Use Ordinance (ULUO). Vehicular access to the new parcels will be determined through application of the Site Development and Design review associated with any future development proposals. As presented Villard Street and Engle Street each provide sufficient frontages to enable the development of each proposed parcel consistent with Ashland's access management standards relating to driveway spacing. The proposed partition will provide for a 24 foot wide public access easement to connect the intersection of Villard and Engle Streets to McCall Drive with an alley extension upon development of Parcel 2. This new alley is consistent with the prior planning conditions of approval (PA 2013-00104): 4) That a 20 foot wide right-of-way for the completion of the McCall Drive alley improvements shall be provided for on final survey plat. The proposed alley extension of McCall Drive will bisect Parcel 1 and 2, within a newly dedicated 24' right of way. Although the original condition of approval only stipulated a 20' right of way, the current proposal proposed a 24' width to allow for a turning radius within the ally that is more conducive to fire apparatus access. However it is anticipated that the actual paved alley width within this right of way will be the minimum necessary to comply with the alley street standard. As the final location of the alley, and relocation of utilities adjacent to it, will be installed in advance or in conjunction with the development of Parcel 2, the requisite Right of Way, and public utility easements necessary for their installation shall be indicated on the final survey plat. This future alley may also be utilized to provide 2016-00537 380 Clay St/blg Page 1 i vehicular access to parcels 2 and 3. Two existing accessory buildings are located on Parcel 2 as proposed (barns). The creation of this new parcel will necessitate the removal of these existing barns in the future event Parcel 2 is to be sold and under separate ownership of the home on parcel 3. Demolition of these structures may require a Demolition Permit unless they are declared to be dangerous under the Uniform Code for the Abatement of Dangerous Buildings. Parcel 3 as proposed contains a 1053 square foot, vacant, dilapidated farmhouse (circa 1890). The home has experienced decades of differed maintenance, is in significant disrepair, and may ultimately need to be demolished to allow for residential use of the property. Additionally Parcel 3 includes a large Fremont Cottonwood (Populus fremontii) with an approximate breast height diameter of 72 inches. This tree was designated by the City as Tree of the Year for 2013. The application notes that this tree is to be retained as part of the minor land partition proposed. Tree was initially identified for preservation as part of the original annexation and subdivision approval (Planning Action #2009-00043). Therefore a condition is included in this approval to clarify that although the tree will be located on a parcel occupied by a single family home as a result of this partition, it shall not be considered eligible for the Exempt Tree Removal process, and would remain subject to Tree Removal Permit r equirement if a future owner proposed removal. The utilities necessary to service both parcels are available in the adjacent right-of-ways and will be installed at the time of the development of the parcels. Additionally, the sidewalks along Villard Street will be installed at the time of the Site Review for the Multi-family development and sidewalks along Engle Street will be installed along the frontage of the park property development. The utility and sidewalk installation is dependent on the final design of the multi-family development and the park development and those improvements are best installed at the time of those developments. The City received limited public comments during the 14-day public comment period which were considered in evaluation of the partition request. Comments received related to potential traffic generation from the future development of the properties. Staff finds that the existing street facilities serving the properties are presently adequate to accommodate development of the site, provided Engle and Villard Street are ultimately improved to include sidewalks, and park rows, consistent with Ashland's Street Standards. The future development of Parcels 2 and 3 as presented in the application will require Site Review approval through separate planning applications, and will be required to improve their respective street frontages at that time. The partition proposal does not modify the zoning of the property and as such the existing R-2 multifamily zone residential density allowance remains unchanged. The original 10 acre property acquired by the City and the Housing Authority of Jackson County had a prior approval for a total of 117 units. In order to accommodate anticipated traffic generated from a 117 unit subdivision, the original approval triggered the installation of a turning lane at the intersection of Clay Street and Ashland Street to facilitate right hand turns and reduce vehicular stacking at this intersection. This turn lane was installed in conjunction with the 60 unit development referred to as Snowberry Brook. The total combined development capacity of Parcels 2 and 3 as presented is approximately 15-23 units (depending on density bonus requests that may be sought). Therefore the total anticipated housing development on 2016-00537 380 Clay Sbblg Page 2 the 10 acre property is expected to be 75-83 units, which is substantially less than less than the originally approved 117 unit annexation. Given the street system was deemed to be adequate, with the turning lane improvement noted above, it is expected to be considered sufficient with the full build out of the remaining property at 380 Clay Street. Upon review of the application and the applicable code requirements of the City of Ashland, the proposed minor land partition is approved with conditions listed below. The criteria for a Preliminary Partition Plat are described in AMC Chapter 18.5.3.050, as follows: A. The future use for° urban purposes of the remainder of the tract will not be impeded. B. The development of the remainder of any adjoining land or access thereto will not be impeded. C. The partition plan conforms to applicable City-adopted neighborhood or districtplans, if any, and any previous land use approvals for the subject area. D. The tract of land has not been partitioned for 12 months. E. Proposed lots conform to the requirements of the underlying zone, per part 18.2, any applicable overlay zone requirements, per part 18.3, and any applicable development standards, per part 18.4 (e.g., parking and access, tree preservation, solar access and orientation). F. Accesses to individual lots conform to the standards in section 18.4.3.080 Vehicle Area Design. See also, 18.5.3.060 Additional Preliminary Flag Lot Partition Plat Criteria. G. The proposed streets, utilities, and surface water drainage facilities conform to the street design standards and other requirements in part 18.4, and allow for transitions to existing and potential future development on adjacent lands. The preliminary plat shall identify all proposed public improvements and dedications. H. Unpaved Streets. 1. Minimum Street Improvement ffhen there exists a 20-foot wide access along the entire street frontage of the parcel to the nearest fully improved collector or arterial street, as designated in the Comprehensive Plan, such access shall be improved with an asphaltic concrete pavement designed for° the use of the proposed street. The minimum width of the street shall be 20 feet with all work done under permit of the Public Works Department. 2. Unpaved Streets. The Public Works Director may allow an unpaved street for access for° a land partition when all of the following conditions exist, a. The unpaved street is at least 20 feet wide to the nearest fully improved collector or arterial street. The City may require the street to be graded (cut and filled) to its standard physical width, and surfaced as required in chapter 18.4.6 prior to the signature of the final partition plat by the City. b. The centerline grade on any portion of the unpaved street does not exceed ten percent. C. The final elevation of the street shall be established as specified by the Public Works Director except where the establishment of the elevation would produce a substantial variation in the level of the road surface. In this case, the slope of the lot shall be graded to meet the final street elevation. d. Should the partition be on an unpaved street and paving is not required, the applicant shall agree to participate in the costs and to waive the rights of the owner of the subject property to remonstrate both with respect to the owners agreeing to participate in the cost of full street improvements and to not remonstrate to the formation of a local improvement district to cover such improvements and costs thereof. This requirement shall be precedent to the signing of the final survey plat, and if the owner declines to so agree, then the application shall be denied. L Where an alley exists adjacent to the partition, access may be required to be provided f°om the alley and prohibited from the street. J. Required State and Federal permits, as applicable, have been obtained or can reasonably be obtained prior to development. h 2016-00537 380 Clay St/blg Page 4 i c e The application with the attached conditions complies with all applicable City ordinances. F Planning Action 2016-00537 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action 2016- 00537 is denied. The following are the conditions and they are attached to the approval: 1) All proposals of the applicant shall be conditions of approval unless otherwise modified here. 2) That a final survey plat shall be submitted within 18 months of this approval and shall include the following: a. All easements necessary for public utilities, reciprocal private utility, maintenance and access, and Talent Irrigation District , as required by the Ashland Engineering Division. b. Adequate public right-of-way shall be dedicated, if applicable, for the completion of the McCall Drive alley improvements. 3) That the dedication of public right-of-way, or public pedestrian easement, as necessary to accommodate future sidewalk installation be provided at the time of future development of Parcel 1, Parcel 2 and Parcel 3. 4) That all applicable requirements outlined in Resolution 2011-006 shall be adhered to as part of this partition. 5) That a Demolition / Relocation Review Permit shall be applied for and approved prior to the removal of any structures unless otherwise exempt as a building declared to be dangerous under the Uniform Code for the Abatement of Dangerous Buildings 6) The 72 inch in diameter Fremont Cottonwood tree located on Parcel 3 shall be protected and preserved in accordance with the Tree Protection Plan approved per Planning Action 2009-00043. Street dog park, so are writing to you as suggested by the emailed notice we received from the City. Our property is located at 410 Clay Street, adjacent to the City's Clay Street property. We have 2 dogs, but have strong reservations about a dog dedicated park at the City's Clay Street property. We respectfully ask that you consider a dog friendly (i.e. people park which allows dogs on leash), instead of a dog dedicated park. Among our concerns is the objectionable odor that a dedicated dog park would generate. Also, in the past couple of years we've noticed that there appears to be more aggressive behavior amongst the dogs at the existing dog park, and therefore don't use that park as much as we used to. A people park (dog friendly or not) would allow more residents in the area to enjoy an open space venue which is needed in the lower Clay neighborhood . We also ask that the City consider a community garden on the south end of the City property (ideally on what is identified as Lot 2 of the 3-lot minor subdivision application PA-2016-00537 currently under consideration by the City), with any proposed additional housing to be relocated from proposed Lot 2 to the north end of the property between the existing multi-family housing and soccer field. The minimum width of the street shall be 20-feet with all work done under permit of the Public Works Department. 2. Unpaved Streets. The Public Works Director may allow an unpaved street for access for a land partition when all of the following conditions exist. a. The unpaved street is at least 20-feet wide to the nearest fully improved collector or arterial street. The City may require the street to be graded (cut and filled) to its standard physical width, and surfaced as required in chapter 18.4.6 prior to the signature of the final partition plat by the City, b. The centerline grade on any portion of the unpaved street does not exceed ten percent. c. The final elevation of the street shall be established as specified by the Public Works Director except where the establishment of the elevation would produce a substantial variation in the level of the road surface. In this case, the slope of the lot shall be graded to meet the final street elevation. d. Should the partition be on an unpaved street and paving is not required, the applicant shall agree to participate in the costs and to waive the rights of the owner of the subject property to remonstrate both with respect to the owners agreeing to participate in the cost of full street improvements and to not remonstrate to the formation of a local improvement district to cover such improvements and costs thereof. Full street improvements shall include paving, curb, gutter, sidewalks, and the undergrounding of utilities. This requirement shall be precedent to the signing of the final survey plat, and if the owner declines to so agree, then the application shall be denied. 1. If approved, this partition plat will have the effect of saving a 75-year-old Cottonwood tree on the property by creating a new, 14,000 sq. foot parcel on which the tree is located. By adding another 7,000 square feet (currently under the control of the Parks and Recreation Department) to the opposite end of the property, the City would sell the Housing Authority 33,075 sq. feet of land on which to build its affordable housing development. As originally proposed, the City offered to sell HAJC 40,075 sq. feet of property for $325,000 on which the agency proposed to build up to 20 units of affordable housing. However, the development was contingent on the City receiving a tree removal permit in order to remove the Cottonwood tree. The tree removal permit application was denied by the Planning Commission on a 4-3 vote last June. Under this revised proposal, the city will sell 33,075 sq. feet of property to the Housing Authority for $268,238 and the Housing Authority will build 15 to 17 units of affordable housing. This proposal also calls for the city to relocate water, sewer and electric utilities at an estimated cost of $133,000 and to reimburse the Parks and Recreation Fund $117,000 as compensation for the 7,000 sq. feet being added to the east end of the parcel. The partition plat will create a new 14,000 sq. foot parcel at the corner of Clay and Villard streets on which the Cottonwood tree is located. The City Council will consider a proposal to declare this new parcel as surplus, and sell it for private development. A formal purchase and sale agreement between the City and HAJC will be presented to the City Council in the near future. The proposed partition and boundary line adjustment will create one additional lot, by dividing the two existing parcels into a three parcel configuration. The subject property is located approximately mid-block on the east side of the lower portion of Clay Street, north of Ashland Street, and is zoned for Low Density Multi- Family residential development (R-2). The properties to the east, west and south are also zoned R-2 and the property to the north is outside of City limits but within the Urban Growth Boundary. Each lot will comply with the applicable standards as set forth in the applicant's written finds provided below. The 72 inch in diameter at breast height Fremont Cottonwood tree will be retained on Parcel 3 as proposed. BACKGROUND INFORMATION: In November 2008 the City of Ashland, City Council approved the acquisition of a 10- acre property on Clay Street in partnership with the Housing Authority of Jackson County (HAJC). The property was subsequently partitioned to provide four (4) acres for development of a 60 unit affordable rental complex owned and operated by HAJC. The remaining area comprised of a City of Ashland owned wetland area, rights-of-ways for streets (both installed and future) and the remaining four (4) acres which is proposed to be further partitioned at this time. In March of 2013 a minor land partition to create two parcels for the property located at 380 Clay Street was approved (PA 2013-00104). As approved, one 3.18 acre parcel (Parcel 1) was retained as a dedicated City of Ashland park; the other 0.92 acre parcel (Parcel 2) created is zoned for future residential development as low-density, multi-family residential (R-2 zoning). In May 2015 an application for tree removal on Parcel 2, to remove the large MAR 2 2 2016 stature cottonwood, was submitted (PA# 2015-00934). This application was Page 1 380 Clay Street Partition Application i f c reviewed by the Tree Commission on June 4, 2015 and the commission recommended denial of the tree removal request. The Planning Commission ultimately moved to deny the tree removal request at a public hearing on June 23, 2015. However, findings of law were not adopted, and the final notice of decision was not completed, as the City, as applicant, withdrew the tree removal application.' Following the 2013 partition approval, and tree removal request in 2015, the City has endeavored to modify the previously approved lot configuration in order to create parcels that would allow for the development of parcel 2 without necessitating the removal of the Fremont Cottonwood. The current application presents a lot configuration that will allow for the retention of the Cottonwood tree at this time, while retaining the multifamily development potential of the property. There are no development proposals at this time. PROPOSAL The applicant proposes a minor land partition and boundary line adjustment between two City of Ashland owned properties located on lower Clay Street to create three lots. The subject property is located approximately mid-block on the east side of the lower portion of Clay Street, north of Ashland Street, and is zoned for low density Multi-Family residential development (R-2). The properties to the east, west and south are also zoned R-2, and the property to the north is outside of City limits but within the Urban Growth Boundary. This property along the northern boundary of the subject property has a comprehensive plan designation of Suburban Residential and when annexed into the city limits is expected to be zoned R-1-3.5. The southern property line adjoins three parcels with single family residences and the end of the Barkley Square (McCall Drive) subdivision. The proposed partition will provide for a 24 foot wide public access easement to connect the intersection of Villard and Engle Streets to McCall Drive with an alley extension upon development of Parcel 2. Parcel 1 would consist of the 2.57 acre property which is dedicated as park land. Parcel 2 as proposed will be 0.77 acres in size and would be available for development consistent with the low density multifamily zoning (R-2). Parcel 3 as proposed would be 0.32 acres in size (14,000sq.ft.) and is currently is occupied by a 1053 square foot vacant farmhouse built in approximately 1890, and also includes the large stature Fremont Cottonwood that was designated as the 2015 Tree of the Year. Parcel 3 with a lot size of .32 acres has a base residential density of four units. Parcel 2 as proposed contains a barn that would be removed to allow the development of residential units on the property. With a proposed lot size of .77 acres, Parcel 2 has a base residential density of 10 units. The structures remaining on the property are not proposed to be removed or modified as part of the partition proposal. It is anticipated that future development will necessitate the removal of the structures as a separate action. The property slopes approximately 3 to 6 percent from south to north. Future residential development of Parcels 2 and 3 will comply with the solar setback ordinance as the new structures will be allowed to shade across the 50-foot Villard Street right-of-way to the north. Any tree removal ultimately associated with the future development of multifamily housing on either Parcel 2 or 3 would require a tree removal permit to be processed and reviewed as part of the development proposal at that time. Specifically, the original annexation of this property in 2009 (Planning Action #2009-00043) included a condition (#2) that stipulated: "An agreement shall be recorded requiring the remaining poplar situated at the southwest corner of the site to be protected and preserved in accordance with the approved Tree Protection/Tree Removal Plan (Applicant's Exhibit L-1.0). Any modifications or amendments to the plan would be processed through a Tree Removal Permit procedure. The southwest corner of the property as delineated on the Tree Protection/Tree Removal Plan (Applicant's Exhibit L-1) would not be covered by Exempt Tree Removal Activities... cis described in the Land Use Ordinance. " i r With approval of this requested partition, the applicant recognizes that this prior condition of approval would remain in effect, and that the 72" Cottonwood would be retained unless a separate tree removal permit were approved. Further, it is the applicant's contention that the newly proposed lot configuration allows for the development of the multifamily zoned property in a manner that will allow this tree to be retained consistent with the Planning Action condition of approval cited above. Therefore the applicant is agreeable to a condition being placed on this application's approval stipulating that this tree is to be protected and preserved, and would be subject to a separate tree removal permit process if proposed to be removed at future date. The public utilities necessary to service each of the parcels are available in the adjacent right-of-ways and will extended to serve individual developments at the time of the development of the parcels. Additionally, the sidewalks along Villard Street are to be installed at the time of development of Parcel 2 and 3. Sidewalks along Engle Street will be installed along the frontage of Parcel 1 upon development of the park property or as indicated in a master plan developed for the park property once completed. The utility and sidewalk installation is dependent on the final design of the multi-family development for Parcel 2 and the master park plan for Parcel 1, and those improvements are best installed at the time of those developments. FINDINGS OF APPROVAL SECTION 18.5.3.050 Preliminary Partition Plat Criteria A. The future use for urban purposes of the remainder of the tract will not be impeded. The partition also allows for the development of a vacant, mufti-family zoned property (Parcel 2) into approximately 13 units. Parcel 1 as proposed will remain a public park. The partition allows for the development as the property as envisioned in the Comprehensive Plan, the adopted Open j Space Plan, and Resolution 2011-06 as approved by the City Council. D. The development of the remainder of any adjoining land or access thereto will not be impeded. i No impediments will be created by the partition. Engle Street provides future access to the property to the north. The street reservation area along the North property line provides a potential future access to and through the 3.18 acre parcel owned by the Parks Department (Parcel 1). The future alley connection to McCall Drive will provide an additional access for the .77 acre portion of the property (Parcel 2) and complete a neighborhood circulation connection as identified in the draft 2012 Transportation System Plan. C. The partition plan conforms to applicable City-adopted neighborhood or district plans, if any, and any previous land use approvals for the subject area. That the applicable conditions of the original annexation of the 10 acre property (PA2009-00043), and the partition approved in March 2013 (PA 2013- 00104) shall continue to apply to the subject properties, including but not limited to the tree preservation plan which stipulated that the owner of the property containing the large cottonwood (parcel 3) shall remain responsible for the pruning and maintenance of this tree. The proposed partition request is consist with Resolution 2011-06 authorizing a land transfer between the City of Ashland and the Ashland Parks Department Relating to the dedication of a portion of the property located at 380 Clay Street. No site improvements will occur until either the Parks Department Master Planning effort is complete for parcel 1, or a development application for Parcel 2 or 3 is processed. D. The tract of land has not been partitioned for 12 months. The property was last partitioned in March of 2013, and therefore has not been partitioned in the past 12 months. E. Proposed lots conform to the requirements of the underlying zone, per part 18.2, any applicable overlay zone requirements, per part 18.3, and any applicable development standards, per part 18,4 (e.g., parking and access, tree preservation, solar access and orientation). A 2 2 2016 Page 5 _ 380 Clay Street Partition Application i The property is zoned R-2, and each proposed lot exceeds the minimum lot size of the zone. Each lot exceeds the minimum width (50') and minimum depth (80') required. The requirement that the width shall not exceed depth only applies in the R-1 zones, and as such does not apply to this multi-family zoned property. The standards for residential zones (18.2.5) relating to setbacks, building height, lot coverage, outdoor recreational space, and landscaping standards will all be evaluated in conjunction with any future development proposals for the properties. No exceptions to these standards or the Site Development and Design Standard (18.4) are anticipated as development proposals for these lots can be designed in accordance with the existing site review requirements. G F. Accesses to individual lots conform to the standards in section 18.4.3.080 Vehicle Area Design. The future driveway access points, and other street improvements are to be installed at the time of the future development. Given the street frontage available on each of the three proposed parcels, access to individual parcels can readily be provided in compliance with City of Ashland access management standards in conjunction with a future site review application for development of the properties. G. The proposed streets, utilities, and surface water drainage facilities conform to the street design standards and other requirements in part 18.4, and allow for transitions to existing and potential future development on adjacent lands. The preliminary plat shall identify all proposed public improvements and dedications. Clay Street is fully improved across the frontage of parcel 3 as proposed. Villard and Engle Streets are partially improved including pavement, curbs and gutters within 52 foot wide right of ways. As part of the prior partition plat (P-29- 2013) adequate space was reserved for the installation of a seven (7) foot parkrow, and five (5) foot sidewalk along the entirety of Villard and Engle Streets. These improvements, including any future driveway curbcuts will be coordinated and provided at the time of the development of the parcels. Adequate public facilities are in place to serve the proposed parcels. An eight (8) inch sanitary sewer line is in place within the Clay Street right-of- way. The sewer line is sufficient to provide service to the new development. Villard and Engle Streets were installed 18 water services were stubbed to the subject property. Upon future development Storm drainage can be directed to the new storm drain lines which then filter through the wetlands along the north property line of the HAJC complex. The storm drainage may also be directed into the improved green street storm water features along Clay Street. Both facilities have capacity to service the new development. H. Unpaved Streets. Not applicable. The streets which provide access to the subject property (Clay Street, Villard Street, and Engle Street) are each paved, public streets. L Where an alley exists adjacent to the partition, access may be required to be provided from the alley and prohibited from the street. As part of this partition and boundary line adjustment request, a 24 foot wide Public Access Easement will be provided to connect McCall Dr. to Engle St. This easement will allow for the future installation of the alley. Installation of the alley extension will occur at the time of development of Parcel 2. Vehicular access to Parcels 1 and 2 from this new alley will be provided at that time. J. I Recitals: A. The City of Ashland (hereinafter "City") has acquired property at 380 Clay Street, which is identified in the 2000-2012 Open Space Master Plan. B. The Ashland Parks Department (hereinafter "Department") desires to own, operate, and maintain parks and open space as identified in the 2000-2012 Open Space Master Plan. C. The City desires to divest itself of ownership, development, management, and financial responsibility of approximately 3.18 acres of the subject property. D. The Department's acquisition of this property will enable it to address the Comprehensive Plan goal of providing the people of Ashland with a variety, quantity and quality of parks, open space, trails and visual resources sufficient for the community's needs. THE CITY OF ASHLAND RESOLVES AS FOLLOWS: SECTION 1. Land Transfer. The City agrees to transfer to the Department approximately 3.18 acres of land, referenced as "City Parks 3.18 acres" in Exhibit A, which is attached and incorporated herein by this reference. The City shall retain approximately 0.92 acres of land, referenced as "City of Ashland 0.92 acres" in Exhibit A, and 1 acre of wetlands referenced as "City Parks (wetland) 1 acre." in Exhibit A. SECTION 2. Payment Terms.- The Department shall pay a total of $1,350,000. The Department shall make payments of $208,000 per year beginning in fiscal year 2010-2011, and continue to pay such amount on an annual basis until paid in full. All annual payments are based on the City's fiscal year. SECTION 3. Infrastructure Improvements. In addition to payment for purchase of the property, the Department agrees to pay 50% of the total cost for all shared infrastructure and planning actions. Specifically, the Department agrees to pay for 50% of the total cost to the City of the right turn lane from Clay onto Ashland Street including sidewalk and Curb improvements on Clay Street. The Department's payment for these infrastructure improvements will be approximately $34,406. However, the City and the Department will each be solely responsible for any infrastructure that is required for permitted activities that shall occur exclusively on the City's or the Department's property. SECTION 4. Maintenance of Wetland. The City shall retain the wetland; however, the City and the Department agree to share the maintenance of the area referenced as "City Parks (wetland) I acre." The City and the Department shall discuss the maintenance schedule and cost each fiscal year. The City and the Department shall delegate to the City Administrator and the Parks Director the authority to determine a maintenance schedule each year. SECTION 5. Partition of Property. The City and the Department shall file and pursue to approval, including any appeals, an application to partition the Property so that at least two legal parcels are created. The City parcel shall constitute approximately 37.5% of the land area, and the Department parcel shall constitute approximately 62.5% of the land area of the parent parcel. The parties may agree to create a discrete third parcel for the wetland area to facilitate continuing maintenance. This future land division will be in substantial conformity with the site layout plan, including but not limited to future street reservation area, alley extension, and pathways development, as indicated in Exhibit A. The City and Department shall be jointly responsible for permit fees associated with a land use application including surveying and engineering costs associated with the partition. SECTION 6. The land transfer shall reserve to the City parcel the full residential dwelling potential of the parent parcel. Any additional units which may be obtained by amendment to the outline plan, by density bonuses, transferable development rights or any other means, shall be reserved to the City. SECTION 7. The City, or subsequent developer of the 0.92 acre property, and the Department shall be jointly responsible to construct and fund the installation of an alley connection from Villard and Engle Streets to the existing McCall Drive alley terminating along the south property line. Construction costs associated with the extension of McCall Drive Alley shall be divided + equally between the City and the Department. SECTION 8.
