This restrictive covenant is to be binding upon Grantor, its heir(s), executors, and assigns, and it is Grantor's express intention that this restrictive covenant shall run with the land and shall be binding upon future owners of the property. Action: The Grantor or property owner waives any claim or right to hold the City liable for damages it or a tenant may suffer from state or federal enforcement actions for activities the City permits as a result of its approval of the proposed use or development once such approval is granted.
