Notice of Final Decision
On August 30, 2018, the Community Development Director approved the request for the
following:
Planning Action: PA-TREE-2018-00014
Subject Property: 1730 Greemmeadows Way
Applicant: Mountain RCH Property Owner's Association l
Description: A request for a hazard tree removal of two trees in the Mountain Ranch
common area (addressed as 1730 Greenmeadows Way). The trees, both weeping willows, have a
history of limb failure and recently caused damage to an adjacent property. The applicant
submitted photos and an arborist report recommending removal and replacement of the trees.
COMPREHENSIVE PLAN DESIGNATION: Single-Family Residential; ZONING: R-1-7.5;
ASSESSOR'S MAP: 39 IE 23BB; TAX LOT: 1300.
The Community Development Director's decision becomes final and is effective on the 12th day
after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all
conditions of approval identified on the attached Findings are required to be met prior to project
completion.
The application, all associated documents and evidence submitted, and the applicable criteria are
available for review at the Ashland Community Development Department, located at 51
Winburn Way. Copies of file documents can be requested and are charged based on the City of
Ashland copy fee schedule.
Prior to the final decision date, anyone who was mailed this Notice of Final Decision may
request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO)
18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO
18.5.1.050(G). The ALUO sections covering reconsideration and appeal procedures are attached.
The appeal may not be made directly to the Oregon Land Use Board of Appeals.

SECTION 18.5.1.050 Type I Procedure (Administrative Decision with Notice)

E. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to
subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision.
F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below.
1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action
after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no
fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision.
Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence
during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity
to respond to the issue prior to making a decision. j
2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall
decide within three days whether to reconsider the matter.
3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the
decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse
the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any
party entitled to notice of the planning action.
4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the
reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration.
G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following:
1. Who May Appeal. The following persons have standing to appeal a Type I decision.
a. The applicant or owner of the subject property.
b. Any person who is entitled to written notice of the Type I decision pursuant to subsection
18.5.1.050.B.
c. Any other person who participated in the proceeding by submitting written comments on the application to the
City by the specified deadline.
2. Appeal Filing Procedure.
a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.G.1, above, may
appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of
this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community
organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the
hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded.
b. Tinge for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of
decision is mailed.
c. Content of Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall
contain.
i. An identification of the decision being appealed, including the date of the decision.
ii. A statement demonstrating the person filing the notice of appeal has standing to appeal,
iii. A statement explaining the specific issues being raised on appeal.
iv. A statement demonstrating that the appeal issues were raised during the public comment period.
d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a
jurisdictional defect and will not be heard or considered.
3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before
the Planning Commission. The appeal shall not be limited to the application materials, evidence and other
documentation, and specific issues raised in the review leading up to the Type I decision, but may include other
relevant evidence and arguments. The Commission may allow additional evidence, testinnony, or argument
concerning any relevant ordinance provision.
4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type II public hearing procedures,
pursuant to section 18.5.1.060, subsections A - E, except that the decision of the Planning Commission is the final
decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the
adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of
Appeals, pursuant to ORS 197.805 - 197.860.

DECISION
Planning Action #TREE-201-8=00014 requests a Hazard Tree Removal Permit to remove- two
willow trees from the Mountain Ranch common space at 1730 Greenmeadows Way. The lot is
2.66-acres in size and is zoned R-1--7.5. The lot where the trees are located serves as open space
for the Mountain Ranch subdivision. The open space -features a large green and trees around the
edges. It also- has-pedestrian connections to-the surrounding street network. The trees requested
for removal are located on the eastern edge of the space, near the residence addressed as 2345
Lupine Drive.
The willows (Salix babylonica) are both listed in an arborist statement as approximately 45' tall
and 36" diameter at breast height (DBH). The trees are requested for removal by the Mountain I
Ranch Property Owners Association because of the potential hazards the tree represent to property I
and residents. The applicant submitted evidence of limb failure in June of 2018. A failed limb
partially destroyed a fence and came close to an existing home.Jn addition, the applicant submitted
evidence of large ?imbs fd ling in 2014 and 2012 as well.
Two reports were submitted with the project. The first report was provided by a tree care
professional who has _pruned the willows multiple times in the past and dealt with the previous
limb-failures. The-report recommended removal of the trees for numerous-reasons, including the
short life span of Salix babylonico the shedding of large limbs in the-past, and evidence of internal
decay. The applicant and the tree care professional both state that the area around the tree is
common open area and that it is accessible by an-yone,-raising the risks associated with limb failure.
The report says that proper pruning can reduce the risk of limb failure, but that there is a
diminishing return as the tree size increases. Given these factors, the report recommends removal.

A second report was a second opinion from a separate tree care professional. This report stated
that the trees has been well cared for and professionally pruned regularly. It- ,was noted that
deadwood had been trimmed and weight removed to alleviate limb failure. Despite this, the-report
notes that willows have weak wood and are prone to breakage. The report noted that the trees will
be a liability and recommended either living with that liability or replacing with a more suitable
tree in the same location.
The Ashland Tree Commission -reviewed this request at their meeting on July 12, 2018. After
discussion with the applicants and the neighboring homeowners, the tree commission
recommended an initial denial and that the applicants return with a second opinion.
The applicant extended the action and returned to the Tree Commission-on August 9t" with a report
from a second tree care professional. While reviewing the application for the second time the
Commission discussed possible alternative measures such as removing-all limbs and turning the
trees into habitat trees. Ultimately the Commission agreed with the assessment of risk. The Tree
Commission re~rxommend-ed approving the request for removal unanimoust_y The Commission
recommended that the trees-be mitigated on a one to one basis with species that will-be appropriate
for the area-and-reach a similar size at naturity.- The Commission also recommended but did not
require that the applicants consider turning the willows into habitat trees. They also asked that
removal is done after nesting-season for migratory birds.
The City received eight comments on the proposal. A majority of the comments opposed removal.
The comments regarded the health of the trees, the potential loss of habitat, and wanted to ensure
that birds nesting in the trees were-not harmed.
As noted,-the applicants did seek two opinions from tree care professionals to ascertain the health
-of the trees.
The City of Ashland has no ordinance regarding the timing of tree removal. The City does require
that blackberries not be removedln riparian areas between May and July, but that does not apply
in this case. Following the second hearing at the tree cormnission the applicant contacted a
biologist at the Oregon Department of Fish and Wildlife to discuss nesting birds. The biologist
indicated that removing the trees between now and January should alleviate concerns to nesting
birds. The applicant should still- take care to check for nesting birds and ensure they are complying
withThe federal Migratory Bird Treaty Act.
The applicant will also be required_to replace each tree within- one year of removal with a species
of similar -size by maturity.
In order for the City to approve a tree_removd , the applicant must demonstrate that the tree
"presents a clear public safety hazard" or "a foreseeable-danger of property damage." It hasdiready
been demonstrated that the trees are capable-of property damage withpast limb fall. The submitted
reports on the tree status also shov:L a reasonable expectation of future limb failure.
Staff finds the application has sufficiently demonstrated compliance with all applicable approval

criteria.
The criteria for 'T'ree Removal PermitapproN41 are described in AMC section 18.5.7.040.13-
as follows:
1. Hazard Twee. A Hazard Tree Removal Per°rnit shall be granted if the approval authority finds that
the application meets all of the folloii,ing criteria, or can be made to conform through the
imposition of conditions.
a. The applicant must demonstrate that the condition or location of the tree presents a clear
public safety hazard (i. e., likely o fall and injure persons or property) or a foreseeable
danger of property damage to an existing structure or facilit}~ and such hazard or danger
cannot reasonably-be alleviated by treatment, relocation, or pruning. See definition of
hazard tree in part 18.6
b. The City may require the applicant to mitigate for the removal of-each hazard tree pursuant
to section 18.5.7.050. Such rrritigation requirements shall be a condition-of approval of the
permit.
The appli cation with the attached conditions complies with all- applicable City ordinances for a
Hazard Tree Removal Permit: Planning Action 9'1~REE=2018-00014 is therefore approved. The
following are the conditions and they are attached to the approval. If any of the following
conditions are found not to be true, then Planning Action #TREE-2018-000014 is denied:-
1) That all proposals of the applicant shall be conditions of approval unless otherwise
modified herein.
2) That a tree mitigation rn- lan-shall be submitted to a Staff Advisor for approval prior
to the replacement of the trees to ensure the new trees shall-be of similar size at
maturity to the removed willows-.
3) That two (2) mitigation trees shall be planted on site within twelve months of
removal of the willow trees.
4) That the mitigation-Nees shall be planted at a minimum of a 11/2-inch caliper
consistent with the requirements of AMC 18.5.7.050. 3 b L' I s'

As per our phone conversation, you should be_fine removing the tree anytime from now until January. Wie would always
love to have habitat trees but if you're going to replace the willows, a nice oak would be an environmentally friendly
addition!
Here's a quick review of the Migratory Bird Treaty Act (https://www.portiandoregon.goy/bes/article/403468), and a link
to the USFWS take form, which indicates that no permit is needed as long as birds or active nests are unharmed (gage 1,
https://www.fws.gov/forms/-3-200-13.pdf).

opinion was obtained supporting the removal of the willows. I believe that the tree commission asked for two opinions.
Am I correct?
We are fairly resigned to the trees being removed- seems like a loosing battle. However, we do feel obliged to protect
the birds nesting in the trees. I can imagine the number of baby birds that will be lost if we take the trees-down prior to
the end of the nesting period.

From what I gather the removal-of the trees is inevitable. Doug has lobbied the entire HOA on limb failure fear and
definitive lawsuits.....
That said I want to make sure he honors-nesting bird policy. I've seen him in deep planning/discussion with Up-per Limit I
on removal logistics already--seems early pJ_anning for-November/December event.
I'd also like to see if your side can push for replacement tree plan and time frame. (I have communication from 2 1/2
years ago when Willow removal was-still very much on Doug's radar that there was a proactive succession /replanting
plan-in place at that time.
There has been ZERO-succession planting)
Lastly can you confirm that people are not allowed to remove any tree big or small on public property without approval.
No accusation but I believe some removal-nay have occurred in the past. I want to-be sure I'm clear on City policy for
future conversations.
Unfortunately we will-not attend meeting tonight as we are out of town.

Dear Mr. Emerson,
see that there will apparently be another hearing on -the issue of removing two willow trees from the
area held for common use by the MRPOA. As a member of that Property Owners' Association, I write
to add my voice in advocacy of the tree removal.
The two trees in question have a history of shedding branches. When they drop at night or in inclement
=weather, when no one is present, the only risk is- to property, and the most recently shed branches
actually did some property damage. But these properties- are open-access property - anyone walking
up Green Meadows Way from Bellview Street can walk up into-this common area, and may potentially
be injured by falling branches. This is a significant risk for people who may well not be aware of the
danger, and is a liability issue for the POA.
We have consulted an-arborist, and now a second one. These trees are nearing the end of their
lifespans; this species typically sheds-;ranches when it is old. I think it is reasonable to _protect the
people-of the area by removing these trees before they drop branches onto a person--Don't you agree? i

I am writing to you with regard to the application by the
Mountain Ranch Property Owners Association Board for the
removal of two willow trees in the common area of our
association's property. I am an owner and resident in the
homeowners association.
The Board has been concerned about the condition of these
particular trees for many months and has pursued a
maintenance program with licensed arborists to preserve their
condition. In spite of this, the tree experts agree that the
expected life of the trees is reaching an end. Recent limb
failures have created a situation where the safety of individuals
and property in and around the two trees can be
dangerous. Although they are a beautiful part of common area,
we, the homeowners, have to recognize the danger involved in
retaining them and the risks related thereto.
The Board has proposed to replace the trees with suitable
species that can thrive in the area in question. I hope your
commission will approve the application promptly in the
interests of the safety of our community.

Mr. Emerson;
In anticipation n-oi the upcoming extended hearing on this matter, we make the
following observations and requests for your consideration.
The City has-an exemption in the code 18.1.5.7,_ that allows/requires the City to
manage the maintenance-and removal of trees on public property as needed, without
review.
No such exemption is all-owed for privately held common areas, owned by an-Oregon
registered Homeowners Association.
This means that while the City can take responsibility for removing potential dangers
from the City parks, such liability cannot be resolved by -subdivision Property
Owners Assn.
Such Assn cannot exerci&e the same discretionary safety measures in similarly
situated common area parks provided -under the Mountain Ranch Property Owners
Association. This seems to ignore the requirements the MRPOA, for keeping the
common areas safe and maintained.
CC&R's are required under Oregon statute. Fiscal responsibility, including safety and
~
liability issues, are a matter of=public record.
Regarding the prior hearing on this application, July 12, and the recommendatiDn for -
denial:
The fact that the Lowes, or anyone-else were not physically harmed by the tree limb
which fell and damaged their fence, does not predict that future damage is not
immanent. Property damage is also a concern.

The property owners within the MRPOA have no assurance under any property title
that property within the common areas will remain as is, over time. Where necessary,
any conditions as found in the common areas, that reasonably warrant modification or
removal, for the-safety or efficient use of the -common areas, must be addressed as part
of the CC & R's.
The MRPOA is liable for reasonable safety measures to be taken within the MRPOA
held common space sections of the subdivision, where own public safety hazards
exist.
We respectfully resubmit the findings of Beaver Tree Service, whicl-rhas maintained
the trees in the subject common space, for your review. Their statement that the
Mountain Ranch Property Owners Assn can "either live with the liability of branch
or trunk failure or remove the trees..." is not a viable alternative for MRPOA. See
attached report, July 27, 2018.
Lastly, the assertion by the Lowes regarding cresting birds being a concern, I would
point out that the Mountain Ranch subdivision was developed with a dedication of the
Ordson Todd Woods to the City of Ashland.
Please see landconserve org for an extensive list of nesting birds in this amazing
adjunct to the Mountain Ranch Homes. It provides virtually limitless nesting
opportunities for birds and squirrels,-and habitat for a wide variety of wildlife, within
less than 500 ft from subject-tree location.

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way,
Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a notice

TREE REMOVAL PERMIT
18.5.7.040.6
1. A A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can
be made to conform through the imposition of conditions,
a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or
property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated
by treatment, relocation, or pruning. See definition of hazard tree in part 18.6.
b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall
be a condition of approval of the permit.
2. T A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application
meets all of the following criteria, or can be made to conform through the imposition of conditions.
a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and
standards, including but not limited to applicable Site Development and Design Standards in part 18A and Physical and Environmental Constraints
in part 18,10,
b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or
existing windbreaks.
c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the
subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable
alternative exists to allow the property to be used as permitted in the zone.
d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this
determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact
on trees, so long as the alternatives continue to comply with the other provisions of this ordinance,
e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation
requirements shall be a condition of approval of the permit. If

Client: Mountain Ranch HOA
Trees: Two Mature Willows (Salix) The trees are approximately 45 tall and 36" dbh.
Evaluation: The Willows are approximately 40 years old and can be considered mature examples of the
species. Both trees have been well maintained and professionally pruned for many years. Deadwood
has been removed and weight taken off limbs to help prevent limb failure.
Willows are a fast growing species and the resulting wood is weak and prone to breakage.
Recently, one large limb broke and damaged a fence on private property. Everything-that can be done
has been done to make these trees as safe as possible.
Recommendations: The options are to either live with the liability of branch or trunk failure or remove
the trees and replant a more suitable species for that location,

I received a notice from the City of Ashland concerning a request to remove the 2 weeping willows on Mountain Ranch
property 1730 Greenmeadows Way. I would like to propose a compromise. The willow to the south side of the pair, if I
have my compass correct, has suffered more damage/limb loss and is off balance. The willow to the north ofihre pair has
had much less issues, and seems perfectly balanced. It is a gorgeous specimen, habitat for many creatures, and I have
considered nominating it as tree of the year. Why not remove the one and let the other stand until it is necessary to
remove I have spoken with the adjacent property owner who's fence was damaged by limb fall and know that they are
not in favorin removing the one tree-on the north side. I was unable to attend the public hearing,but am happy to learn
that a second tree expert opinion is being sought, and that importance was.placed on the nesting birds.

Dear Members of the City of Ashland Planning Division,
I would like to comment on the proposal described in the above planning action.
My husband and I live within the immediate neighborhood of the property at 1730 Greenmeadows
Way, which is the location of the two weeping willows that are the subject of the removal proposal,
although we are not within the Mountain Ranch Property Owner's Association. We were served with
the Notice of Application via mail, inviting our comment.
I would request that the following be taken under consideration:
➢ These are remarkable, mature trees of considerable beauty-they provide significant shade to
an otherwise unprotected open area, they do not appear to be unhealthy and are fully covered
in green foliage.
Neither tree now bears any branches that are overhanging private property - in the event of any
future limb failure, it is difficult to see how damage to private property would be imminent.
In our experience, it is rare to see anyone using the common space in the area under or near the
two trees, making it unlikely that concern for personal injury is a priority.
One of Ashland's greatest attributes is its trees - one of the primary reasons so many of us
choose to live here - and our culture is one that strongly embraces environmental sensitivity
including protection of trees whenever possible.
We fully appreciate that the members of the Mountain Ranch Property Owner's Association are
concerned foremost about the safety of their community, but would urge them to ensure that there is
true and valid risk versus perceived risk, and that these beautiful trees only be cut down as an absolute
last resort.

I am writing in regards to the proposed tree removal in the Greenmeadows Mountain Ranch HOA.
The two Willows in question are behind our house. We had an arborist inspect the trees two and a half years ago who
stated that the trees were healthy. He said that they were about 30 years old, andthat they live to be 50 to 75 years old.
We discussed the option of obtaining a core test to gain certainty on their health.
The recent fallen branch mentioned in the request for removal was due to birds making a hole a_t_the base of the branch.
We have photos depicting this fact. Also, the "property damage" mentioned was a very small section of our-fence.
We are greatly concerned that-the moves to remove these trees are premature. We respectfully request the opinions of
two additional arborist, and taking a core lest.
We would also like to raise the consideration of a considerable pruning-or topping of the trees instead of removing
them.
Another concern we have is for the many birds nests that are in the trees. If after additional opinions and a core test the
trees are determined unsafe, what is done to protect the birds nesting?"

The Ashland Planning Division Staff has received a complete application for the property noted above.
Any affected property owner or resident has a right to submit written comments to the City of Ashland Planning Division, 51 Winburn Way,
Ashland, Oregon 97520 prior to 4:30 p.m. on the deadline date shown above.
Ashland Planning Division Staff determine if a Land Use application is complete within 30 days of submittal. Upon determination of completeness, a notice

TREE REMOVAL PERMIT
18.5.7.040.E
1. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can
be made to conform through the imposition of conditions.
E
a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or t
property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated
by treatment, relocation, or pruning. See definition of hazard tree in part 18.6.
b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall
be a condition of approval of the permit.
. Tr A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application
meets all of the following criteria, or can be made to conform through the imposition of conditions.
a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and
standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints
in part 18.10.
b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or
existing windbreaks.
c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the
subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable
alternative exists to allow the property to be used as permitted in the zone,
d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this
determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact
on trees, so long as the alternatives continue to comply with the other provisions of this ordinance.
e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation
requirements shall be a condition of approval of the permit.

Thanks again for helping with our application today for our proposed willow tree remove .
As we talked about this morning while we are sad to see the willows in all likelihood getting removed , the HOA BOD has
to put the homeowners safety first .
We knew eventually this day would come and here it is . We did in 2016 had Plant Oregon come out and assess the
location of the existing-willows and make recommendations on suitable tree replacements .
Attached are some of the trees that were considered in 2016 . We will again have Plant Oregon come out and reassess
and see if their opinion has changed regarding the original choices .

To whom it may concern:
I have been recently contacted by Doug Kay regarding the recent limb failure of one of the two
large Weeping Willow trees in the common area.
Doug and I have worked extensively on these trees over the last few years. I have climbed and
pruned both of these trees several times over the last 15 years or so. I made a recommendation
for a plan to include the future removal and replacement of these trees for the following reasons:
1. At maturity, Salix babilonica trees tend to shed large limbs due to excessive end weight
coupled with relatively weak wood compared to other commonly planted broad leaved
hardwood trees.
2. All species of Willows are considered "short lived", and as they age, become very poor
compartmentalizers of decay within the stem, as well as throughout the large supportive
limbs throughout the canopy.
3. The area these trees occupy is a "common area" accessible by anyone, at any time. The
target value for failed limbs includes the entire area beneath both of these trees.
4. Both of these trees have, in the past, shown a propensity for shedding large limbs with
little or no warning.
5. Regular proper pruning reduces the risk of failure somewhat, but as they age, this
measure becomes a diminishing point of no return due to the size of the secondary
scaffolding, coupled with the factor of internal decay issues.
6. Most of the failures of large limbs have occurred during the summer months, when the
likelihood of someone being within the target area is high.
7. Evidence of internal decay, as well as "beam shift" cracking is evident in both trees.
I have recommended removal and replacement of these trees due to target value, likelihood of
failure, and opportunity to cause damage to property, or personal injury.

I am Doug Kay, president of the Mountain Ranch Property Owners Association (MRPOA). I have been
president since 2012 and since that time we have used Casey Roland as our go-to guy for all of our MRPOA
tree work.
In that span of time Casey has, on numerous occasions, had to tend to major limb failures on the two big
Weeping Willows in our common park area. The most recent limb failure occurred in mid-June of this year.
Unlike other limb failures of the past, this time property damage occurred to the adjacent neighbor's property.
The limb crashed through their fence, coming within about 6 feet of their home.
We, the Board of Directors of MRPOA, feel that these willows are a hazard and very much a liability to
personal safety and property, and we wish to have them removed. We are sorry to have to remove them, as
they are quite beautiful, and unfortunately, potentially deadly. We are in the process of looking at other
stronger trees we can plant once the willows have been removed.
The area where the willows are located is a 2 acre open area that is used extensively by families that live
within our MRPOA boundaries. The Board has now warned all residents to stay clear of the willows, as they
are now a safety hazard.
We have submitted the necessary paperwork and pictures for your review (attached), and we hope you will
allow us to remove these willows and plant two new stronger trees in their place.
