Description. Permanent Easement and Agreement Page 1 of 3 3. True and Actual Consideration: $500.00,the receipt and sufficiency of which the Grantor hereby acknowledges. 4. Purpose. This easement is for purposes of the construction, reconstruction, operation, maintenance, repair, replacement,enlargement and removal of any sidewalk, and all appurtenances thereto. A further purpose of this easement is,without additional future compensation, to keep the right of way and said adjacent lands clear of all brush, trees, timber, structures and other hazards which might endanger Grantee's facilities or impede Grantee's activities to operate and maintain its aforementioned sidewalk. 5. Terms and Conditions. 5.1 Grantor shall have the right to use the Easement Area in any manner that does not interfere with Grantee's facilities within the Easement Area. 5.2 Grantee shall provide Grantor reasonable notice prior to performing work in the Easement Area. Pursuant to such work, Grantee shall: A. Fill any and all excavations as soon as practicable after opening; B. Dispose of all brush and debris; C. If practicable, replace or restore to approximately their former condition all improvements, trees, ornamental shrubs and crops,as soon as possible after damage or destruction, or if repair or replacement is not practicable, then pay to Grantor the reasonable value thereof. D. Pay Grantor for any and all non-temporary damage that may arise from construction, reconstruction, operation, maintenance, repair, replacement, enlargement or removal of the sidewalk within the Easement Area; 6. Litigation costs. In case of suit, action or proceeding to enforce any rights or conditions of this easement or appeal from said suit, action or proceedings, it is mutually agreed that the losing party in such suit, action, proceeding or appeal shall pay the prevailing party therein a reasonable attorney's fee in such amount as set by the court hearing such suit, action, proceeding or appeal. Cat.No.10231X Form W-9(Rev.11-2017) 1 recognized Hadassah as the charitable remainderman under the terms of the trust; an earlier order of this Court has confirmed such designation. 3 The Court stated at the July 10 hearing that it was not prepared to rule upon the petition 1 of Diana Reznik Serlin or the request of Samuel Foster to modify the terms of the Allen Serlin 5 Trust which currently provide each of them respectively with designated monthly payments. 6 This issue of modification was continued to a hearing set for Friday, July 19, 1996 at 2 pm in 7 Department 32 at the Hayward Courthouse in order to give Mrs. Serlin and/or Mr. Foster time to 8 file declarations which support their respective requests for modification. 9 On July 19, 1996 appearances were made by Michael Patiky Miller, Esq. and Mary H. 10 Widenor, Esq. on behalf of Diana Reznik Serlin, petitioner and by William Petzel, Esq. on 11 behalf of Samuel Foster, trust annuitant. The Court continued the request of Samuel Foster for a 12 modification of the trust with respect to his monthly payments to a hearing set for September 27, 13 1996 in Department 32. 14 The court stated that it had considered the verified petition of Mrs. Serlin, declarations of 13 various witnesses, memoranda of law and other documents filed in these proceedings. The Court 16 thereupon issued its order as follows: 17 The court stated that it was unnecessary to rule upon the petition of Diana Reznik Serlin 18 for modification. The petition had asked for such other and further relief as the court found to 19 be just. The court stated that it had reviewed the terms of the trust, and that stated that it would 20 interpret the provisions of the trust instrument pursuant to Probate Code §17200(b)(6). Article 21 V, C of the trust instrument declares that the Trustee can deal with the trust estate as if she were 2' the absolute owner. The court found that this made Diana Reznik Serlin the holder of grantor 23 trust powers over the trust pursuant to Internal Revenue Code §678.
