All requirements of the RR-.5 zone: are met and the review finds that per planning Action A-2019- 00064: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein. 2) This approval is valid for 18 months, and a final survey shall be submitted within that time period. 3) That a Physical and Environmental Constraints Permit for Hillside Development shall be applied for and approved for any alteration of land or construction in areas over 25-percent slope in accordance with Ashland Municipal Code (AMC) 18.3.10. 4) That .all new construction be limited to the buildable area under 35-percent slope shown on the exhibit submitted with this application and lot coverage shall be limited to no more than 20-percent as required in AMC 18.2.5.030. TerraSurvey, Inc 274 Fourth Street Ashland, OR 97520 The request is for a property line adjustment between the parcels at 365 Strawberry Lane, and 151 Alnutt Street, Two of the properties, (TL 601 and 602) were created via a minor land partition in 1977 and are identified as Parcel 1 and 2. Note: Tax lot 6014 was created in 2016 as a tax lot and not a developable parcel. It is technically part of Tax Lot #601, and not referenced as a separate lot as part of this application. Both properties are zoned Rural Residential (RR-.5), The properties are within the Physical and Environmental. Constraints Review Overlay for Hillside, Severe Constraints and Wildfire Lands. The lots are occupied by single family, residential homes. The property at 151 Alnut Street (TL 601) Is presently 1.069 acres and is occupied by a 1,112 square foot, three-bedroom, one-bathroom, single story, residence, a 424 square foot patio and a 77 square foot shed, The property at 365 Strawberry Lane (TL 602) is a 22,651.2 square foot parcel. The lot is occupied by a 3,058, two story, single family home that was constructed in 1989. There is 4,795 square feet of solid surface impervious surfaces between the residence and the paved driveway. There is 932 square feet of porous solid surfaces from the large deck and the patio. The existing lot coverage is 5,727 square feet or 25 percent, this includes the allowed 200-square foot reduction for porous solid surface. Excluding the allowed 200 square feet of porous solid surface, the lot coverage is 5,527 or, 24.4 percent. The proposed property line adjustment will not reduce the setbacks provided for the existing structures, The proposed property line adjustment provides additional lot area to 365 Strawberry Lane to allow for additional site improvements that are not presently allowed' due to lot coverage constraints. I'll - I 18.1,3.020 Criteria A lot of record is a plot of land that meets one or more of the following criteria, pursuant to ORS 92.010 to 92.190: A. The plot of land was lawfully created through a subdivision or partition plat in Jackson County prior to annexation to the City. Not Applicable B. The plot of land was created through a deed or land sales contract recorded with Jackson County prior to August 18, 1964 before the City adopted planning, zoning, subdivision or partition regulations (Ordinance 1361) Not Applicable C. The plot of land was created through a deed or land sales contract recorded with Jackson County prior to January 1, 2007 a,nd the subject plot of land would have complied with the applicable planning, zoning, subdivision, or partition regulations in effect at the time it was created. The subject properties were created via a ininar land partition in 1977 (9252). 18.5.3.120 Property Line Adjustments Criteria for Approval B. 1. Parcel Creation. No additional parcel or lot is created by the lot line adjustment. No additional parcel or lot is created with the proper-ty line adjustment. 2. Lot Standards. Except as allowed for nonconforming lots, pursuant to chapter 1.8.1.4, or as required by an overlay zone in part 18.3, all lots and parcels conform to the lot standards of the applicable zoning district, including lot area, dimensions, setbacks, and coverage, per part 18.2. If a lot does not conform to the lots standards of the applicable zoning district, it shall not be made less conforming by the property line adjustment. As applicable, all lots and parcels shall identify a buildable area free of building restrictions for physical constraints (i.e.., flood plain, greater than 35 percent slope, water resource protection zones). The proposed p -operty line adjustment will not make any of the bats non-conforming. The subject properties are zoned Rural Residential. The pr°oposed property line adjustment allows for the minimum lot areas in the RR-.5 zone to be met ivith each lot is ,greater than Y.., acre. The lot at 151 Alnut (TL#601) is proposed to be 34,812 square feet in area and exceed rnininium lot size in the zone. The lot at 365 Strao berry) (TLii602) is proposed to be 41,643 square feet in area and also exceeds the rninirnurn lot area in the zone. Roth lots are occupied by r°esidences. The proposed property line adjustment does not impact the existing buildable areas on either- parcel. Both proper-ties have buildable area outside of slopes that exceed 35 pee-cent slopes. Due to the topography of 151 Alnut Street, the buildable area remains in the areas Qf the existing residence, and the driveway area. There is 1,613 square feet of impervious surfaces at 1.51 Alnut Street. This is a four percent lot coverage. There is 3,535 square feet of structure, 1, 355 square feet of driveway, a 724 square foot deck and a 175 square foot patio area. There is a total of 5,589 square feet (excludes 200 square feet of porous solid surface f6r° deck. This is a 13.4 percent lot coverage. The proposed lot line adjustment provides additional building area for a detached workshop and studio f guest house space for 365 Strawberry as the increased lot area provides additional lot coverage area. 3. Access Standards. All lots and parcels conform to the standards in section 18.4.3.080 Vehicle Area Design. Lets and parcels that do not conform to the access standards shall net be made less conforming by the property line adjustment. The proposal does not affect access ds°tandards for either parcel and does not create any additional lots that would require new access. The existing driveways will remain.
