What we are hoping to achieve with this administrative acknowledgment is to document the current situation, while providing flexibility moving forward for any removals that may be required in the future and ensuring that appropriate species are selected for mitigation. For the purpose of providing background it is worth reviewing some details of this development. The original plans for the Street Trees in this subdivision called for western red bud (Cercis occidentalis) to be planted at 20' intervals. The western red bud is a small stature tree that would have been appropriate at such a close spacing, For reasons that are unknown many of the original trees planted were raywood ash, which is a much larger stature tree that would be inappropriate at such a spacing. For the forgoing reasons it is appropriate to revisit the approved street tree plan and through this administrative planning action. As you may know staff has been in touch with representatives of the AVHOA including meetings at our office and site visits. On December 6"', 2019 after consulting with staff application materials were provided by Trudy Duncan authorized by Bruce Duncan, who was at the time the acting president and secretary of the HOA. On December 3 1", 2019 a notice was posted in four prominent locations at the entrances to the subdivision advertising that this would conic before the Tree Commission at their January meeting. During the time that the notice was posted one written comment was received in the record from Scott Krupa. In this letter Mr. Krupa expressed concern that species diversity being maintained and that large stature trees should continue to be included in the streetscape despite the narrow planting strip. No members of the Home Owners Association attended the Tree Commission Meeting. The application materials indicated areas that the AVHOA wanted relief from being responsible for maintaining the approved streetscape plan. This included an area along the northern side ofthe right of way of Village Green Drive. The original plans called for park row planting strip and sidewalk along this section but was never developed consistent with the approved plans. Additionally, the AVHOA asked for relief ftom replanting street trees in two particular locations as indicated on their application materials. At the Tree Commissions January meeting this administrative planning action was brought before them. Staff explained the background and the submitted application materials. The Tree Commission deliberated on the submitted materials and ultimately recommended approval with. conditions, Planning Staff finds that the Tree Commission Recommendations are appropriate and shall be required to be complied with. The Tree Commission Recommendations are attached to this document as Exhibit A and incorporated by reference as if fully set out within this document, These conditions are required to be met within 12 months of the date of this letter to be considered to be fully in compliance with the approved plan. The purpose of this modification is to memorialize the current state of street trees within the subdivision, to identify street trees that need to be planted, and to clarify that any future street tree removals would be required to receive the appropriate Street Tree Removal Permit in order to provide clarity with regard to the tree species selection and spacing for future mitigation plantings. COMPREHENSIVE PLAN DESIGNATION: Single -Family Residential; ZONING: R-1-5 MAP: 39 1E 09 AA; TAX LOT: 5600 & 5500 and MAP: 39 1E 10 BB; TAX LOT: 3700 thru 3746 The Tree Commission recommends approving the application as subject to the following: 1. That the applicant shall plant replacement trees in the two locations proposed. Recommended species in these locations include Zelcova, Little leaf linden or Black Tupalow. These locations are identified as A & B on the attached exhibit. 2. That the applicant shall plant the proposed Dogwood and Crepe Myrtle in the common area. 3. That the area north of Village Green Drive be removed from the approved street tree plan. 4. That the tree at the corner of North Mountain and Village Green need not be replaced, but that the stump shall be removed consistent with the applicant's proposal. Additionally: 5. That the applicant shall plant a replacement tree in 1 of the locations that the applicant request relief from replanting (west side of village square, south of the mail boxes between 1138 and 1126). Recommended species Crab Apple or Paper Bark Maple. This location is identified as C on the attached exhibit. 6. That the applicant shall plant at least one cluster of black birch in the common area to mitigate for the birches that have been lost. The Tree Commission additionally recommends that care be taken to trim away climbing vines that are affecting a number of the smaller street trees in the development. The Tree Commission additionally recommends that in the future when any street tree be required to be replaced that the root barrier be removed. My wife and I purchase our home in the Ashland Village Subdivision 23 years ago. Our house was the third home built out of the 43 originally approved Pots. ( only know of three other families that have lived in the . uoaivision from the original construction, with most of our neighbors moving on every few years. We've seen the street trees from the initial planting to the current status, including the management, care, removals and wind storms. We purchased OUT home in this location in large part because we frequently get around by bicycle and' walking. The traditional street layout with sidewalks, planting strips and generous street trees was and continues to be important to us. We value street trees for their many benefits including providing a buffer from traffic, creating a safer and more comfortable walking environment, the sense of place created by planting strips, traffic calming and reduced urban traffic speeds, the connection to nature and the reduced urban air temperatures from the street trees, just to - �. Derek asked that I write to you to explain the details surrounding an administrative planning action that is currently in review for your subdivision. As you are well aware there has been a history street tree removals that have occurred within your subdivision that have not always been processed through the city. It is my understanding that due to a miscommunication with staff some time ago there were some members of your HOA who understood that tree removals were exempt from tree removal permits. Single family properties that are small enough that they can't be further subdivided are exempt from tree removal permits. That said, common areas that have approved landscaped plans through a planning action are not exempt. Additionally all street tree removals (and plantings) must be authorized by the city. For background it worth reviewing a few facts about the development of your subdivision: the tree spacing of the originally approved subdivision plan was based on a smaller stature tree to be planted. The original plan called for Western Red bud trees (Cercis occidentalis) to be planted at intervals of 20'. This is less than the city standard of 30' intervals but based on the proposed species the spacing was appropriate. For some reason, Instead of the red bud trees your subdivision was planted mainly with Raywood Ash (F'raxinus oxycorpo), which is a much larger stature tree, neither appropriate for such tight spacing and small tree wells. Obviously this has created a situation where there are large trees that are in some cases spaced far too close to each other. The purpose of this administrative planning action is to memorialize the current state of street trees in your subdivision, to identify trees that need to be planted, and to reiterate that any future tree removals would be required to receive the appropriate permits. What we are hoping to achieve with this administrative acknowledgment is to document the current situation, while providing flexibility moving forward for any removals that may be required in the future and ensuring that appropriate species are selected for mitigation. I anticipate that this will come before the tree commission at their regularly scheduled January meeting. I hope that you will plan to attend. Thank you, Trudy Duncan Y PROPOSAL TO CITY FOR SITE DESIGN CHANGE AVHOA In 1997, Ashland Village site plans included the planting of approximately 160 young trees. As early as 2001, trees were being lost. The most significant findings, by consulting arborists, was that the low pressure drip irrigation system was not providing adequate water to maintain optimally healthy and sustainable trees. As of March 2019, 23 of the first trees planted have been lost to stress, disease, or wind storms. Once again, the low pressure drip irrigation watering system has been cited as a significant factor by more than one arborist, including Chris John, who sits on the Tree Commission. We are deeply concerned about maintaining the planting of new trees according to the current site plain requirement of planting every 20 feet. Most of the trees, in the four foot strip, are currently at least 20-30 feet tall. One species, the Raywood Ash, are typically 40 feet tall, and this particular tree is the tree that has been mostly affected during storms. The overcrowding, and the competition for adequate water are the reasons we are asking to change the original site design from the planting of a tree every 20 feet, to a tree every 30 feet. Our plan will be biased on the replanting of any diseased or fallen tree at a 30 foot spacing interval, thus giving existing trees, and newly planted trees, the space and water needed. We are not presently requesting the removal of any further trees, unless a certified arborist so recommends. We will follow the recommendation of an arborist as to which trees are on the City`s list of permitted trees, hoping to add'' variety, and suitability for the small growing space afforded by the four foot strips. We would also like to ease the requirement that we replace all trees and plants that are lost or removed from the Common Area. The trees, planted there now, are mature, and they currently provide a pleasant atmosphere and plenty of shade for the smaller plants. RECEIVED (let AY 1 9 KY ot Ashland We have lost a few shrubs or bushes, due to disease, aging, or deer, and, since 2014, have replaced most of them. We have also added new plants at the request of neighbors who had wanted to improve the overall look of this space. We have, however, lost three clumps of Birch trees (9 trees in all), due to disease, and will be removing the last, now dead birch this Spring. Many of our residents have suggested we need not replace all plants we may lose, given the environment created by more mature plants and trees. In addition, with the threat of global warming, droughts, and water shortages, it may be wiser to consider installing decorative rocks or benches as an alternative. We had the pleasure of a consultative visit by Julie Smitherman this month, and she expressed the opinion that the Common Area is still looking attractive and well cared for. She made helpful suggestions re: care of some of the stressed pillants in the area, and guidelines for replacing plants as needed. We also discussed options to filling in the areas left by the three bunches of Birch trees. We would like the autonomy to use these ideas and suggestions to address any plant loss that may occur in the Common Area. We are committed to maintaining the Common Area's pleasant atmosphere that is enjoyed, not only by our neighborhood, but by many others who walk through the area. Please refer to the attached map for our site proposal plan. 'The map will indicate the location of both existing trees, and areas where trees need to be replaced, once again, hopefully at the proposed 30 foot interval. In some areas, where there is a gap of more than 30 feet, we would ask for an onsite visit to help determine what is appropriate planting. In some of these areas there are extenuating circumstances that may prohibit planting at even the 30 foot interval we are requesting. Because of our, inadequate watering system in the parking strips, we have made clear to residents, who have had new trees planted since 2014, that it is their responsibility to provide extra water for 2-3 years, in order to comply with Chris John's instructions re: the newly planted trees' watering needs. RECEIVED MAY 2019 CRY ot Ashland As we have painfully learned, it is very expensive to maintain healthy trees, and we have been very pleased with the trees we I ve purchased from Plant Oregon to replace ones we have lost since 2014. It is even more expensive have a diseased or fallen tree removed. The cost of replacing a single tree has been as much as $800, including the removal of tree, it's debris, and stump grinding, purchase of new tree, and the planting of that tree. Since 20141 most of our replacement trees have been purchased at Plant Oregon, and are healthy, vibrant trees. We will have to increase our neighborhood association fees in order to come into compliance with city's regulation of replacing trees within a one year time period. We appreciate the City's cooperation in working on our Site Design Plan change. Ashland, OR 97520-9136 Good Day, In inspecting the Ash street tree recently requested for emergency removal at 1213 Munson Drive, Planning staff noted that the tree was removed prior to the approval of the Street Tree Removal Permit, In addition, it appears that several other street trees have been removed within the subdivision without Street Tree Removal Permits and without planting of required replacement trees. The Ashland Municipal Code includes the following requirements with regard to the removal of street trees planted in public parkrow planting strips: • No tree shall be planted or removed in any planting strip until a permit has been issued. Applicants may be required to replace the tree or trees being removed with a tree ortrees of comparable value (AMC 13.16-030). Through no fault of the City or Tree Commission, (ve seen the consistent removal of street trees on the approved landscape plan over the years, without replacement. One of the most egregious cases was the removal of a Raywood Ash in front of 1138 Village Square Dr. approximately 5 years ago that was at least 12" DBH. There was no apparent reason and no sidewalk lifting as reported by the arborist removing the tree. I would like to offer two points for your consideration this evening when you review the proposal to modify the Ashland Village Subdivision landscape plan, specifically for street trees. First, it is an overstatement to say that most or all of the street trees are large stature and 30-40 feet in height. if the submittal is correct, i calculate 70% of the remaining trees are not Raywood Ash. Instead, the majority of `he trees are small, around 6`DBH and at most are 20 feet in height with relatively small canopies. In addition, if you, visit the neighborhood, you will see many of the trees appear strained, some are leaning and don't look great, Second, this latest discussion based on the appropriate species and spacing is entirely new. The HOA has consistently cited expense when I've requested tree replacements and tree care. In the 23 years we've lived in our home, the annual dues have remained the same $300 a, year. I don't know about you, but I don't have any household cost that has not been affected by inflation and remained flat for more than two decades. Just a few months ago, the dues were raised to $400, specificalily stated to address the tree replacement, I understand the vote was almost unanimous, although I didn't attend in person because, I did not receive an invitation to the meeting. F'T My request is that if the modification is approved that the plan for the subdivision continues to include large and small stature trees and a requirement that all removals obtain a street tree removal permit prior to removal and replacement. In addition, it would be helpful to have several species identified for the large and small stature trees so that members of the HOA are able to continue to monitor the activities, I know the Tree Commission is composed of arborists and tree experts and your perspective maybe focused on having the right treein the right place. But again, I urge you to look at the overall street health and the impact on the neighborhood. Please keep in mind the perspective of the people such as ourselves who live here every day with the street trees and enjoy their benefits. It is so much more, pleasant walking our dog, standing in our small front yard or walking to work in the areas where the trees shade us in the, summer and provide a substantial buffer form the traffic, In addition, it is helpful to look at the stature of the small trees in comparison to the large stature trees and see for yourself if the small trees have faired any better. The removal and replacement of these trees has been an economic burden for our neighborhood's available funds, and we do plan to raise our annual HOA fees in January. Reason for altering the original plan: We are deeply concerned about maintaining the planting of new trees, according to the current site plan, which requires that all trees be planted within 20 feet of each other. Most of the existing original trees hiave grown to heights of 30-40 feet, with most of the remaining Raywood Ash reaching over 40 feet. The canopies of many of these trees have rembed 20- to nearly 40 feet. • The original trees were planted at a 20 foot interval. Considering the mature size11f the trees, their height, and cainopy spread (pointed out to us by Aaron Anderson, Assistant Planner with: the City), we feel this change is reasonable, and prudent. The low pressure irrigation system, Global Warming, and threats of drought r" -' years, prevent existing and newly planted trees, the water nil sustain them if root systems are competing for this water. e Chris John, from Canopy Tree Service, has been an invaluable sourch of information, and help in our search for a more sustainable plan. Description of tree replacement: • Our plan is based upon the replanting, when indicated, at a within 30 foot interval, thus giving existing trees, and newly planted trees, the space and water needed. The exception to this would be on the north side of Village Green Street, where the canopy from a homeowner's trees could prevent a new tree to grow to it's fullest potential. In this area, we request the ability to, with the City's input, use our judgement about the feasibility of replacement if the need arises. • Trees will be chosen from the City's list of recommended trees for a 4 foot park row space, hoping to add variety, and suitability for the small growing space. We will look to Chris John, or another certified arborist for assistance with these choices. In years past, we have purchased most of our trees, with Chris's help, from Plant Oregon. We have also educated those neighbors, who have had new trees planted in their park row spot, the importance of increased watering for the first three years after planting, in order to promote deep roots for the new tree. Time line: • Presently, there are two trees needing replacement. They are located at 1126 Village Square Drive and 1213 Munson. These two trees will be replanted in February of 2020. See map marked; too • We request that, due to wide canopy at 1138 Village Square Drive and 1228 Munson, no new trees are necessary. See map marked: ob • We request that at the corner of Village Green and Village Square Drive 1141 Village Square, we can eliminate the need for replacing the tree that fell on that corner in 2014. We feel as if a tree there can impose traffic sight impairment as it is so near the corner. See map marked: we We request that the tree, removed due to a serious hazard, at 248 N. Mountain, not be replaced as it Will affect visibility at this busy intersection. See map, marked: mo We request permission to have the ability to determine, with the City's input, the need to replant, if a tree is lost on the north side of Village Green. Due to the dense canopy of the trees planted on private property, we feel as if a new tree may not thrive in that area. aw esai Additional note: Alan Campbell, co -landscape committee member, met with Julie Smitherman, Conservation Analyst, during the summer, re: the plants in our common green space. Due to disease, we have lost nine birch trees, and Julie offered suggestions for plants to replace the lost birches. She alsofelt that our existing mature trees, shrubs, and lawn provide a pleasant greenspace, and, due to the existing canopy, we need not replace small trees or shrubs that may die due to attrition or deer damage. She also offered excellent suggestions for water conservation. We therefore ask for autonomy in the selection of plants to maintain a pleasant environment for all who enjoy the area, and that we not be required to necessarily replace any plant that is lost. Presently we are considering replacing the three "birch clusters", that were lost, with a Crepe Myrtle Tree, a Dogwood Tree, and a comfortable bench.
