The proposal includes a large addition to the rear of the structure for a new master suite, as well as the construction of a two car garage with a second dwelling above. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Effective Date of Decision. I.Jrfless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5,1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider aType I decision as set forth below. I. Any party entitled to notice of tile planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of tile party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of all issue to be raised by letter or evidence during tile opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 1 Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three clays whether to reconsider the matter. 1 If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw tile decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, 01' reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action, 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, tile Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type: I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: L Who May Appeal. The following persons have standing to appeal a Type I decision, a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 19.5. 1 .050R c. Any other person who participated in the proceeding by submitting written coninients on the application to the City by the specified deadline. 2. Appeal Filing procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.05O.G. 1, above, illay appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to, tile procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include tile site. If all appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded, b. ThneforFiling. A notice of appeal shall be tiled with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Confeiil of Notice of Appeal. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. 'rhe appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The proposal includes a large addition to the rear of the structure for a new master suite, as well as the construction of a two -car garage with the ARU above. The application includes a request to remove two trees; a 35" DISH Cedar, and a 10" DBH Japanese maple. COMPREHENSIVE PLAN DESIGNATION: Multi -Family Residential; ZONING: R-2; MAP: 39 IE 09 DA; TAX LOT: 6600 SUBMITTAL DATE: March 4, 2021 DEEMED COMPLETE DATE: March 29, 2021 STAFF APPROVAL DATE: May 24, 2021 APPEAL DEADLINE (4:30 P.M.): June 7, 2021 FINAL DECISION DATE: June 8, 2021 APPROVAL EXPIRATION DATE: December 8, 2022 DECISION The proposal is a request for Site Design Review to approve the construction of a new 458 square foot Accessary Residential Unit (ARU) above a two story garage, as well as a master suite addition at the rear of the house. The application also includes a request to remove two trees within the building footprint of the proposed garage, these include a 35" D13I-1 cedar tree, and a 10" DBH Japanese maple. The subject property is located at 912 Siskiyou Blvd, Assessor's map 39 1E 09 DA, tax lot 6600. The property is an approximately 0.34 acre irregular shaped lot located on the south side of Siskiyou Blvd. between South Mountain Ave. and Morse Ave. Siskiyou Blvd. is improved with curb, gutter, park -row and sidewalk. The subject property and surrounding neighborhood is located in the R-2 (multi -family) zoning district. The entire property is within the National Register Historic District, however only the front portion is within the local Siskiyou-Hagardinc Historic district (the local districts boundary falls along the rear of the existing liorne). Therefore, the rear of the property, where the proposed addition and garage with ARU are proposed to be built are not subject to local Historic District Design Standards. The property is currently developed with a single-family home built in 1904 known as the `George Taverner House' which is both locally recognized a primary contributing historical structure and is also individually listed on the National Register of Historic Landmarks (National Register 478002290). The National Register describes the house as `fashionably eclectic' and notes that it was designed by Frank C. Clark, Southern Oregon's leading, and perhaps only professionally trained, architect of the early 20th Century. Clark is noted for the many commodious residences in the Colonial Revival Style he designed in Ashland and nearby Medford. Best known among his work in this style is the Chappel- Swedenburg House on the Southern Oregon State College campus a few blocks from the "Taverner (louse. By comparison, the Taverner House combines several stylistic idioms, including Dutch Colonial, Tudor, Gothic and Shingle. Because of the attention to craftsmanship and detail, because of tine PA -'r l -2021-00145 912 Siskiyou Blvd. /aa Page I placement of openings to command the best views offered by the site, and because of an open floor plan allowing efficient circulation around a central stair hall, the Taverner House is a good example of the "Progressive American Architecture" of its day. The current application proposes to obtain City approval to add a master suite to the rear of the building and build a new detached two -car garage with an accessory residential unit above. This addition will entail obtaining this planning approval and required building permits. Tire land use ordinance parking requirements for an ARU and a single-family home requires three automobile parking spaces. The application materials indicate that in addition to the two car garage that two additional off street parking space will be added, one near the front of the home with another along the northern property line at the rear of the property. Bicycle parking is required to be provided and a condition of approval to that affect has been added. The site has robust and mature landscaping meeting the standards of the Ashland Municipal Code. The existing driveway surface is compacted gravel and is not proposed to be improved by the applicant. This is consistent with Single Family developments and is allowed per the code. At the April 7"' Historic Commission tnecting the application was reviewed. The Historic Commission recommended continuing the application to an additional meeting because they unable to determine the extent of the proposed exterior modifications to the individually listed structure on the National Register of Historic Places from the application materials and whether the proposed exterior modifications are consistent with the applicable design standards in Ashland Municipal Code. The application was continued to a date and time certain for review at the following month meeting. At the May 5i1' Historic Commission meeting the application was again reviewed with supplemental application materials. The applicant clarified that there would be no modifications to the front balcony of the house as had originally been proposed. The Historic Commission noted that they appreciated the applicant's intentions to preserve the original Frank C. Clark house and limit the demolition and new additions to the rear of the structure and property so that the original historic home is not modified or obscured. The Historic Commission recommends approval of the application with the following recommendation, to maintain exterior materials, doors and windows of original house in the new addition and detached garage/accessory residential unit. At the April Tree Commission meeting the application was scheduled to be reviewed, but unfortunately the Tree Commission did not have a quorum and were unable to review the application. The Staff Advisor therefore reviewed the application in the absence of a recommendation of the Tree Commission. Based oil the location of the two trees, the size of the critical root zone, and the proposed garage the Staff Advisor felt that any effort to preserve the two trees would preclude the development of the additional residential unit thus meeting the criteria for removal of a Tree that is not a hazard because requiring their perseveration would reduce the allowed residential density. The application materials did not include a tree protection plan therefore one will be required as a condition of approval showing how the remaining 45" cedar is to be protected. The application complies with all the applicable provisions of the R-1-5 zoning district, and die applicable Site Development and Design Standards in AMC 18.4, as well as the special use standards for an ARU. Staff finds that the site has adequate public facilities to accommodate a total of two residential units on the property as proposed. The site has existing water and sewer service, and the new ARU will have a new electrical service installed. FIA -TI -2021-00145 912 Siskiyou Blvd. /aa Page 2 In accordance with the land Use ordinance once the application was determined to be complete a notice was mailed to all surrounding properties within a two -hundred foot radius and well a s physical notice posted at the subject property. During the period of Public (,'oninicnt no input was received either for or against. The applicant has submitted materials to the Planning Department to demonstrate compliance with the applicable approval standards for the approvals requested and by their reference are incorporated as if set out in full. The special use standards for an Accessory Residential Unit are descr-ibed in AMC Chapter 18.2.3.040, as follows: S. R-1 Zone. Accessory Residential Units in the R-1 zone shall meet the following requirements: 1. One Accessory Residential Unit is allowed per lot, and the maximum number of dwelling units shall not exceed two per lot. 2. Accessory Residential Units are not subject to the density or minimum lot area requirements of the zone. 3. The maximum gross habitable floor area (GHFA) of the Accessory Residential Unit shall not exceed 50 percent of the GHFA of the primary residence on the lot, and shall not exceed 1,000 square feet GHFA. 4. The proposal shall conform to the overall maximum lot coverage and setback requirements of the underlying zone. 5. Additional parking shall be provided in conformance with the off-street parking provisions for single-family dwellings in section 18.4.3.040, except that parking spaces, turn-arounds, and driveways are exempt from the requirements in subsections 18.4.3.080.D.1 and 18.4.3.080.D.2 and paving requirements in subsection 18.4.3.080.E.1, D. R-2 and R-3 Zones. Accessory residential units in the R-2 and R-3 zones shall meet the standards in subsection Lii ? , except that the maximum gross habitable floor area (GHFA) of the accessory residential structure shall not exceed 50 percent of the GHFA of the primary residence on the lot, and shall not exceed 500 square feet GHFA. The criter-ia for Site Review approval are described in AMC Chapter 1.8.5.2.050 as follows: A. Underlying Zone: The proposal complies with all of the applicable provisions of the underlying zone (part 18.2), including but not limited to: building and yard setbacks, lot area and dimensions, density and floor area, lot coverage, buildingheight, building orientation,, architecture, and other applicable standards. B. Overlay Zones: The proposal complies with applicable overlay zone requirements (part 18.3). C. Site Development and Design Standards: The proposal complies with the applicable Site Development and Design Standards of part 18.4, except as provided by subsection E, below. D. City Facilities: The proposal complies with the applicable standards in section 18.4.6 Public Facilities and that adequate capacity of City facilities for water, sewer, electricity, urban storm drainage, paved access to and throughout the property and adequate transportation can and will be provided to the subject property. E. Exception to the Site Development and Design Standards. The approval authority may approve exceptions to the Site Development and Design Standards of part 18.4 if the circumstances in either subsection 1 or 2, below, are found to exist. 1. There is a demonstrable difficulty meeting the specific requirements of the Site Development and Design Standards due to a unique or unusual aspect of an existing structure or the proposed use of a site; and approval of the exception will not substantially negatively impact adjacent properties; and approval of the exception is consistent with the stated purpose of the Site Development and Design; and the exception requested is the minimum which would alleviate the difficulty.; or 2. There is no demonstrable difficulty in meeting the specific requirements, but granting the exception will result in a design that equally or better achieves the stated purpose of the Site Development and Design Standards. PA -TI -2021-00145 912 Siskiyou Blvd. !aa Page 1 The criteria for Tree Removal are described in AMC Chapter 18.5.7.040 as follows: 2. Tree That is Not a Hazard. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints in part 18.3.10. b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. In Staff's review, the application with the attached conditions meets all applicable criteria for Site Design Review approval. The Ashland Historic Commission reviewed the proposal on May 5`", 2021 and recommended approval of the accessory dwelling unit as proposed. Planning Action # PA -TI -2021-00145 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action PA -T1-2021-00145 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant be conditions of approval unless otherwise modified here. 2. That all requirements of the Fire Department shall be satisfactorily addressed, including approved addressing; fire apparatus access; fire flow; fire sprinklers for those units determined by Building and F ire Code to require theta based oil review of final building permit plans; and provisions for "Knox Box" key boxes. 3. That a General Fuel Modification Area fuel reduction plan addressing the requirements in AMC 18.3.10.100.13 shall be provided prior to bringing combustible materials onto the property, and any new landscaping proposed shall comply with these standards and not include plants listed on the Prohibited Flammable Plant List per Resolution 2018-028. 4. That building permit submittals shall include: b. An electric design and distribution plan including load calculations and locations of all primary and secondary services including any required transformers, cabinets and all other necessary equipment. This plan must be reviewed and approved by the Electric, Engineering, Building and Planning Departments prior to the issuance of building permits. Transformers, cabinets and vaults shall be located in areas least visible from streets, sidewalks and pedestrian areas, while considering the access needs of the Electric Department. C. Identification of required bicycle parking, which includes two bicycle parking spaces in PA -T1 -2021-00145 912 Siskiyou Blvd. /aa Page 4 rd the garage. Where bicycle parking is provided in garages, hanging racks shall not be used and final interior dimensions of garages shall be provided to ensure adequate space is provided. The building permit submittals shall verify that the bicycle parking and vehicle parking spacing requirements are met. That. prior to the iSSUanCC of a building permit; That the applicant apply for a new street address for the ARU. b. That the applicant provides a revised site plan showing the location of the required bike parking, and trash and recycling area and required screening. C. That the applicant provides a tree protection plan. d. That all necessary building permits fees and associated charges, including permits and connections fees for new, separate, electrical services to the second unit, and system development charges for transportation, parks, water, sewer, and storm water shall be paid. That prior to the issuance of the certificate of occupancy for the new residential dwelling unit the following shall be completed; a. All utility Service installations including a separate electrical meter shall be completed according to Electric, Engineering, Planning, and Building Division's specifications. b. All final inspections relating to the building permit for the conversion of the rear Structure into a second dwelling unit shall be completed and approved per the Building Division's specifications. C. That the replacement of the broken sidewalk sections on the property frontage shall completed prior to issuance of a certificate of occupancy. Public Works permits and associated inspections shall be obtained for any work to occur within the public right-of- way, d. That all bicycle parking areas within existing garages shall be delineated and installed according to the approved plan, inspected, and approved by the Staff Advisor C. That all garage parking, spaces shall remain available for vehicle parking only and shall not be Used for material storage, as required in AMC 18.4.3.11 O. The Historic Commission appreciates the applicant's expressed intentions to preserve the original Frank C. Clark house and limit the demolition and new additions to the rear of the structure and property so that the original historic home is not modified or obscured. However, the Commission was unable to determine the extent of the proposed exterior modifications to the individually listed structure on the National Register of Historic Places from the application materials and whether the proposed exterior modifications are consistent with the applicable design standards in Ashland Municipal Code (AMC) 18.4.2.050.C.2 Rehabilitation Standards. • The elevations do not clearly show the architectural features of the existing home that will be retained and modified. Submit documentation addressing the exterior architectural features that will be retained and those that will be modified on the original Frank C. Clark home in the form of revised elevations or photos of each side of the building with a written narrative. • Submit accurate, scaled elevations of proposed front entry/railing modifications including drawings of the entry/railing as it exists currently before changes and also after with the proposed changes. Show the railing detail. AMC 18.4.2.050.C.2.b. Original architectural features shall be restored as much as possible, when those features can be documented. • Vinyl windows should not be used in the original Frank C. Clark home. This is the second time in my career that I've been honored to participate in the restoration of a Frank C. Clarke design. I'll try and do justice to that privilege. I'll address each item from the list here and when applicable, on the working drawings as well.52.35'. We have updated and included all floor areas, existing and proposed, on sheet A of the working drawings. We have also listed all lot coverages to complete the statistical accounting of the project. For Solar Setback, the existing height of the structure is 28'3". Using your Setback Standard A, we have 28.25 -6 22.25. The average slope for the next 150' to the North is about 2%, or -.02. So, we'll have a calculation of 22.25 / (.445-,02) = 22.25/.425 = 52.35'. this shown on sheet B and the line falls into the existing front setback of this property. Changes to the existing structure. There was an appalling addition to this home performed in the 1970's I believe. The goal here was to eliminate this atrocity and restore the home to elements consistent with its original design. We used the roof pitch to match the Mansard portion of the existing roof to add the Master addition and in doing do eliminated much of the leakage problems that 70's addition caused. The connecting covered walkways also borrowed those elements and also matched existing columns from the covered patios found at the East section of the existing home. Siding, trim, and window styles match the era quite well, although it is fair to point out that windows in 2021 vary a wee bit from 1904. Changes to existing exterior elements. Railings on the upper balconies are rotting and need to be replaced. They also do not meet current codes of 36" in height. We are removing and replacing them by extending the existing parapet bases and matching the design of the original railings to meet current codes and match the existing elemental style of the home. Two (2) main floor windows toward the rear or South portion of the are being removed as they were part of the aforementioned 70�'s addition. The openings will be filled and finished to match the existing home. On the East side of the home is the Pergola. Two (2) sets of French doors access the patio there. One is the original and the I Zeceived 3.4 2021 other is from the 70�'s addition and does not match the home. That latter set will be removed. The master addition included the following changes to the exterior on the rear or South side of the home. Two (2) single doors access an existing balcony on the upper floor. The balcony and doors will be removed as at least a great portion is in conflict with the original design and the addition. One door will be replaced with a window matching the flavor of the home and the other will be framed in and will be covered by the now roof. The roof itself matches the existing pitch of the original home. The larger addition was designed to match the Dutch Gambrel portion of the existing home. Frank C. Clarke used 3 main elements in his original design. They are the French Mansard main roof, the Dutch Gambrel on the North, South, and East sides of the home, and of course the Victorian Era Turret on the North side of the home. By combining these 3 main elements he created a classic International Victorian Era design, Some of those elements, such as the Dutch Gambrel, have been used in homes, not just in the Ashland area, but all over the State of Oregon as well. In fact, in the tiny town I grew up in, there was a classic Dutch Gambrel across the street from my childhood home (until, tragically, it burned down in the early 70's.) The Classic Oregon Barn, a favorite of one my college professors, is a notable example of the Dutch Gambrel style. That element was an easy choice to use as a base for the garage addition. As viewed from the street, it is best to combine the working drawings with the actual views shown in Map style programs with some 3D shots as well. Included with this letter is Bing Map view of the property at it's most visible point. It shows the home well set back off the street. With the Northern most wall of the main addition being about 52' back from the North Side of the existing, it will be a minimally invasive, and hardly noticeable, visual addition as viewed from S,iskiyou Blvd. With the #D view I am providing as well, even with the street trees not shown, the perspective scale is well balanced and within the guidelines of the overall style of this home. The available open space for this project would exceed any standard the City currently has. I would ask that any landscaping not interfere with the architectural elements of the existing and proposed designs. We list this available open spaces on sheet B, o Also appearing on sheet B will be notes regarding the use of the existing irrigation system for the landscaping, notations about using filter bags during construction to minimize any water runoff, the location of two (2) new trees to be planted to mitigate the trees that need to be removed, and notations of existing utilities such as stormwater drainage being connected to the new rain drains of the new addition. • Bicycle parking in the garage has been noted on sheet B as well as sheet 3. • Dana Hopkinson of Gnome Construction has been working with the Fire Dept. by addressing any need for a sprinkler system. The agreement is that the garage addition will be fully sprinkled and that a simplified system of three (3) sprinkler heads will be added between the master addition(l) and the existing living area(2). • Mr. Hopkinson has also been working with the power company on upgrading the electrical service to the property.
