The application includes a report prepared by an ISA certified arborist, indicates that the trees are 43" and 24". COMPREHENSIVE PLAN DESIGNATION: Employment; ZONING: E-1; MAP: 39 IF 09 AB; TA: LOT: 6301 The Conimunity Development Director's decision becomes final and is effective on the 12"' day after the Notice of Final Decision is mailed, Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based oil the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1,050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed purStlarit to subsection 18,5.1.050,G, aTypc I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. 1. Any party entitled to notice of the planning action, or any City departnictiL may request reconsideration of tile action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. Tile StaffAdvisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that all error occurred crucial to the decision, tile Staff Advisor shall withdraw tile decision for purposes of reconsideration. The Staff Advisor shall decide within tell days to affirm, modify, or reverse the original decision. Tire City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action, 4. If the Staff Advisor is not satisfied that all error occurred crucial to tile decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to tile following: I. Who May Appeal. The following persons have standing to appeal a Type I decision. a. Tire applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5. 1.050,13, c. Any other person who participated in tile proceeding by submitting written comments oil the application to the City by tire specified deadline, 2. Appeal Filing Procedure, a. Notice of Appeal, Any person with standing to appeal, as provided in subsection 18.5.1.050.6.1, above, may appeal a'rype I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include tile site. If all appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Timefir Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. An identification of the decision being appealed, including tire date of the decision, ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will riot be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before the Planning Commission. "The appeal shall riot be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading tip to the Type I decision, but may include other relevant evidence and arguments. 'file Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings oil appeals of Type I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5.1.060, subsections A — E, except that the decision of the Planning Commission is tile filial decision of the City oil all appeal of a Type I decision. COMPREHENSIVE PLAN DESIGNATION: Employment; ZONING: E-1; MAP: 39 1 E 09 AB; TAX LOT: 6301 SUBMITTAL DATE: February 23, 2021 DEEMED COMPLETE DATE: February 26, 2021 STAFF DECISION DATE: March 17, 2021 DEADLINE TO APPEAL (4:30 p.m.): March 29, 2021 FINAL DECISION DATE: March 30, 2021 APPROVAL EXPIRATION DATE: September 30, 2022 DECISION This proposal is to remove two locust trees from the property at 60 fifth Street. The subject property is a pair of lots along the north side of B Street roughly 120 -feet east of 0' Street. The parcels is a 0.13 acre property and is zoned E-1 (with the Residential Overlay). The property is developed with a multi -family fourplex. The two trees proposed for removal are both locust trees with bad form. Recently the larger of the two developed a major crack. The applicant called requesting all emergency removal. Tile applicant's tree professional, Beaver Tree Service, stated that they could successfully mitigate the immediate hazard by pruning, and this application followed. The application materials include a report prepared by Beaver Tree Service and identified the two trees black locust trees (Robinia pseudoacacia L.) and estimates them to be 43" and 24" DBI -I respectively. The larger of the two trees is estimated to only have 30% of its canopy living, and that the trees unseasonal lack of budding and `branch curl' is evidence that it is in sever decline. The smaller of the two trees in a similar condition, with the split branch removed at approximately fourteen feet. The application includes a number of photos showing the condition of the trees as well. To be deemed a "hazard tree" the condition or location of the tree must clearly present a public safety hazard (i.e., that the tree is likely to fall and injure persons or property). Or, that there is a foreseeable danger of property damage to an existing structure or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment, relocation or pruning. Based oil the materials provided by the applicant's arborist and a site visit by staff, it is reasonable to conclude TALE -2020-00142 54913 St./aa Page I that the subject tree is indeed posing a hazard and therefore ought to be removed. During the public comment period staff received no input frorn the public. At the February regular meeting of the Tree Commission staff presented the application. After a brief deliberation, the Tree Commission voted unanimously to recommend approval of the removal. Staff finds that the tree, due to its location, size, and Continued decline in health, poses an unacceptable hazard to people and the property that cannot be reasonably alleviated by means other than removal and replacement. Upon recognizing the, hazard posed to property and taking the Tree Commission recommendation into consideration, Staff finds the application with attached conditions has sufficiently demonstrated compliance with all applicable approval criteria. The criteria for a Tree Removal Permit are described in AMC Chapter 18.6.7.040.13 as follows: 1. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (Le., (likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure or facility, and Such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of hazard tree in part 18.6. b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7,050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action #TREE -2020-00142, a request to remove one hazard tree, complies with all applicable city ordinances with the imposition of the conditions attached below. Therefore, Planning Action #TREE -2020-00142 is approved. If any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action #TREE -2020-00142 is denied. With the lack of budding and the extensive presence of branch curl, this tree shows indications of lack of water within the tree system; the tree is dying. A previously installed cabling system is broken, hanging low in the canopy, and no longer relieving the stress on the main joints. Therefore, the tree is currently under extreme load, making, it more prone to, failure. With the tree being so close in proximity to structures and having three-fourths of the tree canopy completely dead along with the stress and weight -distribution issues,, the tree needs to be removed immediately. This declining tree is a hazard to the people and structures in proximity, Black Locust Tree (Robinia pseudoacacia L.): DISH 24" (Located closer to the fence on the northeast side of the, property where people are commonly present) Like the tree listed above, this tree is also dead/dying and is an immediate hazard. It has a large split — through which one can see daylight (see included photo), Complete and prompt removal of the tree is recommended.
