The applicant has submitted supplemental materials including photos of the tree and request that the tree commission review the application again. This is A request for approval to remove one red maple (Acer rubrurn) at Mountain Meadows. The application, prepared by all ISA certified arborist, indicates that the tree is 14"-DIIN and stands approximately forty feet tall. The application explains that the tree is not well rooted based oil the rocky nature of the ground, and that the height of the tree now exposes it to wind loads above the building. The concern is that a wind event may cause the tree to fail and potentially cause damage to the building. The application states the intent to mitigate the tree with a species better suited to the environment. The Community Development Director's decision becomes final and is effective on the 12"' day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn, Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of inal Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file all appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(6). Reconsideration. The Staff Advisor may reconsider a Type 1 decision as set forth below. 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no f=ault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice ofdeeision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to [affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. A Type 1 decision maybe appealed to tine Planning Conunissiona, pmsanant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Typc I decision pursuant to subsection 19.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal ;Filing Procedure. a. Notice q/ Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.05O.G.I, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or connmunity organizations recognized by the City and whose boundaries include the site. Appeal hearings on Type I decisions madc by the Staff Adviser shall be de novo hearings before the Planning Commission. 'file appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. Appeal Hearing Procedure. Hearings on appeals of `I'ypc 1 decisions follow the Type II public hearing procedures, pursuant to section 18.5.1,060, subsections A — E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. COMPREHENSIVE PLAN DESIGNATION: Health Care; ZONING: HC; MAP: 39 1E 04 AD; TAX LOT: 88000 & 40000 SUBMITTAL DATE: February 23, 2021 DEEMED COMPLETE DATE: February 26, 2021 STAFF DECISION DATE: May 27, 2021 DEADLINE TO APPEAL (4:30 p.m.): June 8, 2021 FINAL DECISION DATE: June 9, 2021 APPROVAL EXPIRATION DATE: December 9, 2022 DECISION This proposal is to remove one red maple from the Mountain Meadows property at assessor's map 39 IE 04 AD, tax lots 88000 and 40000. The property has multiple street addresses however the application indicated that 947 Mountain Meadows is the closest address. It was later found that the tree was in fact closer to the unit addressed as 931 Mountain Meadows, which will be discussed further below. The subject property is a pair of lots along the east side of Mountain Meadows between Meadow Lark Way and Golden Aspen Place and consists of three large multifamily buildings connected by walkways. The central building is located on tax lot 40000, and the address identified on the application 947 is in the northwest corner of the building. The application materials include a report prepared by Southern Oregon Tree Care. The application materials state that the one tree proposed for removal is a 14" DBH red maple (Acer rubrum). The application describes the location of the tree as growing on a rocky slope eight feet from the building, The arborist report states that the tree has many surface roots which isn't uncommon for this species but is particularly noticeable in this instance due to the rocky surface and lack of topsoil. The tree has a significant lean to the south described as a phototropic (light seeking) lean. The primary concern is that the tree is poorly anchored and due to its height the tree is now above the roof line exposing it to storm winds. The report concludes that the intention TREE -2021-00140 (near) 947 Mountain Meadows/aa Page 1 is to replace the tree with a more appropriate species better suited to the area. In accordance with the land use ordinance once the application was determined to be complete a notice was mailed to all surrounding properties within a two -hundred foot radius and well a s physical notice posted at the subject property. During the period of public comment, no input was received either for or against. At the March 4th Tree Commission meeting the application was reviewed. The tree commission recommended denial of the application citing a lack of evidence in the record. There were no photographs showing the tree in the application materials and all tree commissioners who made site visits were unable to be sure that they had seen the subject tree as no trees on site appeared to be marked. Based on the fact that they hadn't seen the tree in person or in photographs they didn't feel they could make a finding that the tree removal request met the criteria for a hazard tree removal based solely on the written arborist report. Staff contacted the applicant letting them know that the tree commission had recommended denial of the application and asked if they wanted to accept the denial or submit additional application materials. The applicant was interested in returning to the tree commission and agreed to submit supplemental materials. On March 15`h the applicant provided four photos showing the tree and updated the location of the tree. An updated site plan was never submitted but it was described to be on the south side of the central building adjacent to unit 931. Just prior to the April Tree Commission a representative of Mountain Meadows contacted staff and informed them that no one would be available to represent the application and if they could continue to the application to the May meeting. Staff asked the applicant to formally request an extension to both the 45 -day limit set in AMC 18.5 and to the 120 -day rule. On April 7'h the applicant provided a signed extension requesting a 90 -day extension to the time limit set forth in AMC 227.178(1). At the May regular meeting of the Tree Commission staff presented the application again this time with the supplemental application materials. icon Ketchum, the Mountain Meadows landscaping supervisor was present and spoke in favor of the requested removal due to the poor location, and height of the tree with regard to the concerns with wind events. After a brief deliberation, the Tree Commission voted unanimously to recommend approval of the removal. To be deemed a "hazard tree" the condition or location of the tree must clearly present a public safety hazard or, that there is a foreseeable danger of property damage to an existing structure or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment, relocation or pruning. Based on the materials provided by the applicant's arborist and the photos provided, it is reasonable to conclude that the subject tree is indeed posing a hazard and therefore ought to be removed. The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.B as follows: 1. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of hazard tree in part 18.6. b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action #TREE -2021-00140, a request to remove one hazard tree, complies with all applicable city ordinances with the imposition of the conditions attached below, Therefore, Planning Action #TREE -2021-00140 is approved. If any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action #TREE -2021-00140 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. That one (1) mitigation trees, of an appropriate stature, shall be planted on site within one (1) year of issuance of this decision. I made a site visit January 01, 2021 to see the tree located between the Golden Aspen building and the Birch building on Mountain Meadows Dr. in Ashland Oregon. The limitations of my report were visual observations from the ground, and I was limited to a single page to limit expenses. This tree appeared reasonably healthy and is between two buildings that are each two story "apartment" type buildings. One has a parking garage as the first floor, the other is two stories of living quarters. The tree is 14" diameter at breast height (DBH, 54" above grade), approximately 40 feet tall and growing on a rock slab slope. The nearest building is eight feet from the trunk and a main support post for the second story balcony is b feet from the trunk. There are many surface roots which is not uncommon for this species typically but more so on this tree due to the rock slab and little topsoil available. This tree also has a phototropic lean (seeking light) down the hill towards the other building. The concern is that this tree is not well anchored and is now above the roof line exposing it to storm winds. if this tree uproots it could damage not only the building it is leaning towards but also could damage the support post nearby. Another concern is damage to the building and/or support post by the roots due to the proximity to the building, lack of soil, impacts of the wind etc. The plan by MMOA is to replace the tree with one of smaller stature better suited to the environment as well as to bring in many yards of soil and relandscape the area to add more texture and beauty to an area that is struggling due to lack of soil.
