The application materials state that there is a hole at ground level with visible rot. If the tree were to fail it would fall towards the street posing a hazard. COMPREIIENSIVE PLAN DESIGNATION: Commercial; ZONING: C-1; MAP: 39 lE 09 BB; TAX LOT: 98000 SUBMITTAL DATE: September 24, 2020 DEEMED COMPLETE DATE: October 26, 2020 STAFF DECISION DATE: November 12, 2020 DEADLINE TO APPEAL (4:30 p.m.): November 24, 2020 FINAL DECISION DATE: November 25, 2020 APPROVAL EXPIRATION DATE: May 25, 2022 DECISION This proposal is to remove a single Maple tree from the property at 171 Oak Street. The property is located on the west side of Oak Street between Lithia Way and B Street. The property is zoned Commercial (C-1) as are the surrounding properties. The property is developed with "Oak Street Cottages" which is a four -unit commercial motel that was approved in 1991 (see PA#91-096). Because the property is zoned Commercial all trees over six -inches Diameter at Breast Height (DBH) require a tree removal permit. The single tree proposed for removal is identified as a Maple in the application materials. Staff estimates that the tree is approximately eight -inches DBH and twenty-four feet in height. The application includes photos showing a large gaping hole neat the base of the tree with obvious decay and rot. The application includes an email from `Branch Management Tree Company' explaining that due to the rot at the base of the tree poses a risk of main stem failure, and that due to the location of the tree if it were to fail it would fall toward the street posing a hazard both to pedestrians and parked cars. To be deemed a "hazard tree" the condition or location of the tree must clearly present a public safety hazard (i.e., that the tree is likely to fall and injure persons or property). Or, that there is a foreseeable danger of property damage to an existing structure or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment, relocation or pruning, Based on the materials provided by the applicant's arborist and a site visit by staff, it is reasonable to conclude that the subject tree is indeed posing a hazard and therefore ought to be removed. During the public comment period staff received no input from the public. At the November TREE -2020-00127 171 Oak St./aa Page 1 regular meeting of the Tree Commission staff presented the application. Commissioners Gould and John stated that they both made site visits. Commissioner John also stated that he had previously provided a quote to the applicant, but that was many months ago and has no further contact. Staff stated that the photos were pretty solid evidence that the tree was in decline, and staff did not require an arborist report. After a brief deliberation, the Tree Commission voted unanimously to recommend approval of the removal. The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.8 as follows: 4. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of hazard tree in part 18.6. b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action #TREE -2020-00127, a request to remove one hazard tree, complies with all applicable city ordinances with the imposition of the conditions attached below. Therefore, Planning Action #TREE -2020-00127 is approved. If any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action #TREE -2020-00127 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. That one (1) mitigation trees, of an appropriate stature, shall be planted on site within one (1) year of issuance of this decision. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints in part 18.10. b. If the tree fails it is likely that it would fall toward the street and possibly damage vehicles parked there.) $550,00 This dots hat inCkvd2 E+Vv V VfMoVaI. Remove 1 large Black Locust on Northeast side of property. (This is not as urgent as the other tree. I recommend this because eventually the stump will begin breaking the sidewalk and could potentially interfere with any utilities buried in the ground nearby. Ifs basically outgrowing its environment.) $1,100.00 Trim/thin 2 small Sunburst Locust in parking lot- (This is good to do annually to eliminate unwanted sprouts) $1Sb.00- for both trees Trim Maple growing from neighbors property over roof on North side of property. (This will help reduce moss on the roof and debris in the gutter) $150.00 *All prices include hauling away limbs and wood generated by tree work. The price on the Black Locust is more because it is in a very sensitive location. it will take extra precautions to avoid property damage. If you have any questions feel free to contact me.
