The two trees are to the rear of the properties addressed as 828 and 904 Roca St. along Roca Creek. The application is prepared by an ISA certified arborist and states that both trees are in a state of decline with 25-35% of the upper canopy either dead or dying. The application states that there is no obvious reason for the decline but that this species is susceptible to a number of pathogens that could be the cause. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to prqject completion. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.6, aType I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The StaffAdvisor may reconsider a Type I decision as set forth below. I_ Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Adviser, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raise(] by letter or evidence during the opportunity to provide public input on the application sufficient to afford the StaffAdvisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The StaffAdvisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the StaffAdvisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice ofAppeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.6.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Time for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the (late the notice of decision is mailed, c. Content qtNotice qfAppeed. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before [lie Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the 'Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals ol-Typo I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5.1.060, Subsections A — E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 197.805 - 197.860. COMPREHENSIVE PLAN DESIGNATION- Single Family Residential; ZONING: R-1-10; MAP: 39 1F, 15 BC; TAX LOT: 1201 SUBMITTAL DATE: January 25, 2020 DEEMED COMPLETE DATE: February 2, 2020 STAFF DECISION DATE: March 8, 2021 DEADLINE TO APPEAL (4:30 p.m.): March 22, 2021 FINAL DECISION DATE: March 23, 2021 APPROVAL EXPIRATION DATE: September 23, 2022 DECISION This proposal is to remove two tree identified as white alders (Alnus rhombifolia) from the common area property owned by the Roca Canyon Home Owners Association. The property is located to the east of the houses that make up the Roca Canyon HOA. The property is irregularly shaped and measures 1 acre in size. The property is zoned Single -Family Residential (R-1-10) as is the surrounding neighborhood. Because the property is vacant any tree over six -inches Diameter at Breast Height (DBH) require a tree removal permit. The two trees proposed for removal are described as i5" and 16" DBH and are located behind 828 and 804 Roca Street respectively. The application, prepared by an ISA certified arborist, states that the trees are in a state of decline characterized by crown dieback with one tree estimated to have 25% loss, and the other between 35-45% of the crown made up of dead limbs. The application states that there is no obvious reason for the decline but that this species is susceptible to a number of pathogens that could be the cause. The application concludes that as the trees continue to decline they pose a risk as they shed branches, and pose a hazard to those that would need to climb the these trees when they do fully die in order to safely remove them To be deemed a "hazard tree" the condition or location of the tree must clearly present a public safety hazard (i.e., that the tree is likely to fall and it jure persons or properly). Or, that there is a foreseeable danger of property damage to an existing structure or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment, relocation or pruning. Based on the TREE -2020-00138 Roca St. Tax Lot #1201/aa Page I materials provided by the applicant's arborist and a site visit by staff, it is reasonable to conclude that the subject tree is indeed posing a hazard and therefore ought to be removed. During the public comment period staff received no input from the public. At the February regular meeting of the Tree Commission staff presented the application. After a brief deliberation, the Tree Commission voted unanimously to recommend approval of the removal. The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.8 as follows: 1. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing Structure or facility, and such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of hazard tree in part 18.6. b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action 11TREE-2020-00138, a request to remove two hazard trees, complies with all applicable city ordinances with the imposition of the conditions attached below. 'I"herefore, Planning Action #TREE -2020-00138 is approved. If any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action #TREE -2020-001.38 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. That two (2) mitigation trees, of an appropriate stature, shall be planted on site within one (I) year of issuance of this decision. The 2 trees requested for removal are 16" and 15" DBH white alders (Altus rhontbifoliq). They are located behind 828 and 804 Roca St along Roca Creek. Both trees are in a state ot'decline, characterized by crown dieback. It is a bit difficult to tell currently, but when I visited the site in August and again in October of this year, the upper canopies were characterized by approximately 15%-25%, and 35%-45% respectively, ofdead limbs. It is unclear as to the exact reason for the decline of these trees. Alders are susceptible to a number of air and sell - born pathogens which present as crown dieback and eventual mortality. There have been a number of alders along this creek that have (lied in recent years, all of which exhibited the signs of decline now present in these 2 trees. I suspect that the cause is a soil pathogen such asarmillaria or a phytophthora which is spreading via the creek or cumulative years of drought stress resulting in a lowered water table or a combination of these factors. There has been no recovery for the trees observed previous])' With these signs. As the trees continue to die back, their dead limbs hanging over common space regularly enjoyed by residence, makes them an increasing hazard. It is also an increasing hazard for those that would need to climb these trees when the do fully die in order to safely remove then).
