DECISION
This proposal is to remove one pine trees from the property at 2110 Siskiyou Blvd. The subject
property is lot I of "The Court on Mary Jane" a planned community. The property is located at
the intersection of Mary Jane Ave and Siskiyou Blvd. The subject parcels is a 0.03 acre property
and is zoned R-3 Multifamily Residential. The property is developed a, 0.34 acre common area
and a total of ten dwellings in a mix of duplexes and
fourplexes.
The tree proposed for removal is a single pine tree. It is
unclear if the tree was originally a part of the planned
landscaping plan or was a volunteer. The edge of the
trunk of the tree is less than a foot away from the
wooden picket fence and pergola of the subject
property. The tree is identified as a nearly eight -inch
DBH and roughly twenty feet in height. ]'here is no
indication that the tree is in poor health, but its location
poses an unacceptable hazard both in terms of vision
clearance area for the vehicle exit onto Mary Jane, but
also in terms of fire risk. The application includes a
number of photos showing the location of the subject
tree.
To be deemed a "hazard tree" the condition or location
of the tree must clearly present a public safety hazard

(i.e., that the tree is likely to fall and injure persons orprol)erly). Or, that there is a foreseeable
danger of'property damage to an existing structure or facility, and, that such hazard or danger
cannot reasonably be alleviated by treatment, relocation or pruning. Based on the materials
provided by the applicant and a site visit by staff, it is reasonable to conclude that the subject tree
is indeed posing a hazard and therefore ought to be removed.
During the public comment period staff received no input from the public. At the April regular
meeting of the Tree Commission did not meet due to a lack Of (IL10111111.
Staff finds that the tree, due to its location, size, poses an unacceptable hazard to the property
that cannot be reasonably alleviated by means other than removal and replacement. Upon
recognizing the hazard posed to property Staff finds the application with attached conditions has
sufficiently demonstrated compliance with all applicable approval criteria.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.6.7.040.13 as
follows:
1. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds
that the application meets all of the following criteria, or can be made to conform through the
imposition of conditions.
a. The applicant must demonstrate that the condition or location of the tree presents a clear
public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable
danger of property damage to an existing structure or facility, and such hazard or danger
cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of
hazard tree in part 18.6.
b. The City may require the applicant to mitigate for the removal of each hazard tree
pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of
approval of the permit.
Staff finds that Planning Action #'I'REE-2020-00147, a request to remove one hazard tree,
complies with all applicable city ordinances with the imposition of the conditions attached
below. Therefore, Planning Action 4TREE-2020-00147 is approved. If any one or more of the
following conditions are found to be invalid, for any reason whatsoever, then planning Action
111'REE-2020-00147 is denied. The following are the conditions and they are attached to the
approval:
1. That all proposals of the applicant shall be conditions of approval unless otherwise
specifically modified herein.
2. That one (1) mitigation trees, of an appropriate stature, shall be planted on site within one
(1) year of issuance of this decision.

I am applying for a Tree Removal Permit for a pine tree (see pictures) from the south side of my
recently purchased townhouse. This isone often units which were built inanomi-drc|c. The
pine is beautiful and should have been planted on an acre of land well away from buildings.
It was not agood decision toplant this tree inthis spot; edecision made awhile ago based on
the size nfthe tree today. The branches are currently hanging over the bank-patio'spergola
and nearly touch the house. onthe other side the tree was growing into the community semi-
circle drivewhirhaUovwnhnos:owneomosto`cmrxi/mc"nit.|ti^a|sovervdo,ctnthe
community sidewalk. |nother words, the tree obstructs the driver's view and scratches cars.
Upon reading the Tree Removal Permit frequently asked questions I realized that the actions
being taken by myself and the previous owner and other HOA members, included removing
lower branches and branches over the pergola, are very close mactions stated inthe Tree
Removal permit nsnot permitted.
I believe this tree to be a fire hazard and a vehicular hazard. I asked permission at the February
HOA meeting nfthe HOA members mpursue getting itremoved, and they voted toa|lowthis
process tobegin.
The Tree Removal Permit document referred mabove led nemknow that because this ba
multi -family zone, |must ask permission for atree greater than six -inches. 8ymymeasurement
the diameter at 4.5 feet above ground is 25" which when divided by Pi (3.14) = 7.96 inches.
| will replace itwith an appropriate shrub which can be kept trimmed.
