ASHLAND PLANNING DIVISION FINDINGS & ORDERS PLANNING ACTION: PA -TREE -2021-00160 SUBJECT PROPERTY: 1675 Ashland St, OWNER: Columbiacare Rogue Ridge Apartments LLC APPLICANT: berry KenCairn DESCRIPTION: A request for approval to remove a single bigleaf maple (acer macrophyllum) at the property address as 1675 Ashland ,St. The tree had previously been approved for protection associated with the Site Design Review approving the Columbia Care housing project (Identified as Tree #5 on the approved plans). The application states that the tree is 13' from the edge of the building footing but the canopy overhangs the building envelope and would be in conflict with the 3Fd floor. COMPREHENSIVE PLAN DESIGNATION: Commercial; ZONING: C-1; MAP: 39 1E 10 DC; TAX LOT: 9201 SUBMITTAL DATE: July 22, 2021 DEEMED COMPLETE DATE: July 27, 2021 STAFF APPROVAL DATE: August 27, 2021 DEADLINE TO APPEAL (4:30 p.m.): September 8, 2021 FINAL DECISION DATE: September 9, 2021 APPROVAL EXPIRATION DATE: March 9, 2023 DECISION This proposal is to remove one tree from the property that is currently under construction with the Columbia Care affordable housing project located at 1675 Ashland St. The property was created as parcel 1 of partition plat P-032020 recorded as county survey #22998. The property is 0.86 acres in size and is zoned C-1 (commercial). Because the tree is larger than six inches DBH and the property is zoned commercial a tree removal permit is required. This is the second tree proposed for removal since receiving Site Design Review approval (see PA -TREE -2021-00152 for a hazard tree removal.) The tree proposed for removal is identified as an Acer macrophyllum also known as a bigleaf or Oregon maple. The tree was originally slated for protection, but once construction began it was clear that the upper portion of the tree, due to a pronounced westward lean, is in conflict with the building envelope for the upper floors. In accordance with the Land Use Ordinance, Notice of Complete Application (NOCA) was mailed to all surrounding properties within 200' of the subject property as well as a physical notice posted along the frontage. No public comment received either in favor or against. At the August regular meeting of the Tree commission the application was reviewed. Staff presented the application and provided an overview for the reason to request the removal. Kerry KenCairn, the project landscape architect, was present and represented the application explaining TREE -2021-00160 1675 Ashland St../aa Page 1 that there are a number of mature trees along the eastern edge of the and in hindsight it should have been requested for removal in the original application. Due to other mature trees to the east of the subject tree has caused to the tree to lean into the building area. Also at the hearing was an adjacent property from 477 Litt Way who expressed concern that this is now the second tree that has been approved for removal since site and the potential loss of privacy and suggested that perhaps an additional tree could be added to the landscaping plan. The Tree Commission, after a brief deliberation determined that the location of the tree was in conflict with the building envelope and voted unanimously to approve the removal with a condition of approval that an additional tree be added to the approved landscape plan in the northeast coiner of the project area. Staff finds the application with attached conditions has sufficiently demonstrated compliance with all applicable approval criteria. The criteria for a Tree Removal Permit (Not a hazard) are described in AMC Chapter 18.5.7.040.8 as follows: 2. Tree That is Not a Hazard. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints in part 18.3.10. b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action #TREE -2020-00160, a request to remove one non -hazard tree, complies with all applicable city ordinances with the imposition of the conditions attached below. Therefore, Planning Action #TREE -2020-00160 is approved. If any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action TREE -2021-00160 1675 Ashland St../aa Page 2 #TREE -2020-00160 is denied. The following are the conditions and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. Approval is valid fora period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided it ALUO 1.8.5.1.050(G).
