Notice of Final Decision
On August 27, 2021, the Community Development Director approved the request for the
following:
Planning Action: TREE -2021-00158
Subject Property: 2181 Birchwood Ln
Applicant: Geri Esposito and Jack Defonatine
Description: A request to remove two Linden trees at the property located at 2181
Birchwood St. One tree is located in the front of the home approximately 8.5' from the
foundation, the other is located along the side of the house and is 3.5' from the house. The
applicant lists a number of reasons to request the removal including that the trees are a nuisance
but also that their location to the foundation of the house is likely to cause `issues with the
foundation.' COMPREHENSIVE PLAN DESIGNATION: Multi -Family Residential;
ZONING: R-2; ASSESSOR'S MAP #: 391ElICC; TAX LOT: 1700.
The Community Development Director's decision becomes final and is effective on the 12th day
after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all
conditions of approval identified on the attached Findings are required to be met prior to project
completion.
The application, all associated documents and evidence submitted, and the applicable criteria are
available for review at the Ashland Community Development Department, located at 51
Winburn Way. Copies of file documents can be requested and are charged based on the City of
Ashland copy fee schedule.
Prior to the final decision date, anyone who was mailed this Notice of Final Decision may
request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO)
18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO
18.5.1.050(G). The ALUO sections covering reconsideration and appeal procedures are attached.
The appeal may not be made directly to the Oregon Land Use Board of Appeals.

SECTION 18.5.1.050 Type I Procedure (Administrative Decision with Notice)
E. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to
subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision.
F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below.
1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action
after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no
fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision.
Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence
during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity
to respond to the issue prior to making a decision.
2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall
decide within three days whether to reconsider the matter.
3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the
decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse
the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any
party entitled to notice of the planning action.
4, If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the
reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration.
G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following:
1. Who May Appeal. The following persons have standing to appeal a Type I decision.
a. The applicant or owner of the subject property.
b. Any person who is entitled to written notice of the Type I decision pursuant to subsection
18.5.1.050.B.
c. Any other person who participated in the proceeding by submitting written comments on the application to the
City by the specified deadline.
2. Appeal Piling Procedure.
a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.0.1, above, may
appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this
subsection. The fee required in this section shall not apply to appeals made by neighborhood or community
organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing
or upon subsequent appeal, the fee for the initial hearing shall be refunded.
b. Time far Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of
decision is mailed.
C. Content of Notice of,4ppeal. The notice of appeal shall be accompanied by the required filing fee and shall contain.
i. An identification of the decision being appealed, including the date of the decision.
ii. A statement demonstrating the person filing the notice of appeal has standing to appeal.
iii. A statement explaining the specific issues being raised on appeal.
iv. A statement demonstrating that the appeal issues were raised during the public comment period.
d. The appeal requirements of this section must be fully net or the appeal will be considered by the City as a
jurisdictional defect and will not be heard or considered.
3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de nova hearings before the
Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation,
and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and
arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant
ordinance provision.
4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures,
pursuant to section 18.5.1.060, subsections A — E, except that the decision of the Planning Commission is the final
decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the
adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of
Appeals, pursuant to ORS 197.805 - 197.860.

DECISION
This proposal is to remove two trees from the property that is located at 2181 Birchwood Lane.
Birchwood Lane is a private road which was created as part of "Birchwood at Ashland, A
planned community" (approved by PA#98-113 and recorded as CS 16178). The property is
zoned R-2, and the subdivision is developed with attached duplexes, due to this fact the standard
exemption for single family homes on lots that can not be further developed does not apply*.
The trees proposed for removal are both Linden trees one in the front yard, and one in the side
yard and are located 8.5' and 3.5' away from the foundation respectively. The application lists a
number of reasons why the applicant wishes to remove the trees including the fact that these
trees are generally the wrong stature to be located so close to the home considering that the trees
are not fully mature and will continue to increase in size. The trees also cause excessive
droppings in the form of both sap, leaves and other debris which in turn requires the frequent
cleaning of the gutters. The application included a number of photos of the trees which clearly
showed that the root zone of the trees are clearly encroaching on the building foundation. The
applicant has stated that they intend to plan mitigation trees from an HOA approved species that
will be more appropriate for the space.
In accordance with the Land Use Ordinance, Notice of Complete Application (HOCA) was
tailed to all surrounding properties within 200' of the subject property as well as a physical
notice posted along the frontage. No public comment received either in favor or against.
* Note that the regulations have since changed to include an exemption for duplexes with the adoption of Ordinance
43199 which amended the band Use Ordinance as required by House Bill 2001 from the 80th Oregon Legislative
Assembly, 2019 Regular Legislative Session.

At the August regular meeting of the Tree commission the application was reviewed. Staff
presented the application and provided an overview for the reason to request the removal. The
Tree Commission, after a brief deliberation, determined that the location of the tree and the
damaged being caused consisted a hazard and voted unanimously to approve the application as
submitted.
To be deemed a "hazard tree" the condition or location of the tree must clearly present a public
safety hazard. Or, that there is a foreseeable danger of property damage to an existing structure
or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment,
relocation or pruning. Based on the materials provided by the applicant and a site visit by staff, it
is reasonable to conclude that the subject tree is indeed posing a hazard to the foundation of the
building and therefore ought to be removed. Staff finds that the tree, due to its location and size,
poses an unacceptable hazard to the property that cannot be reasonably alleviated by means other
than removal and replacement. Staff finds the application has sufficiently demonstrated
compliance with all applicable approval criteria.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.8 as
follows:
?. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds
that the application meets all of the following criteria, or can be made to conform through the
imposition of conditions.
a. The applicant must demonstrate that the condition or location of the tree presents a clear
public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable
danger of property damage to an existing structure or facility, and such hazard or danger
cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of
hazard tree in part 18.6.
b. The City may require the applicant to mitigate for the removal of each hazard tree
pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of
approval of the permit.
Staff finds that Planning Action 4TREE-2020-00158, a request to remove one hazard tree,
complies with all applicable city ordinances with the imposition of the conditions attached
below. Therefore, Planning Action #TREE -2020-00158 is approved. If any one or more of the
following conditions are found to be invalid, for any reason whatsoever, then Planning Action
#TREE -2020-00158 is denied. The following are the conditions and they are attached to the
approval:
1. That all proposals of the applicant shall be conditions of approval unless otherwise
specifically modified herein.

2, Tree That is Not a Hazard. A Tree Remov-' Oermit for a tree that is not a hazard shall be granter? "+he approval authority finds that the application
meets all of the following criteria, or can bE ,1e to conform through the imposition of conditions.
a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements
and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental
Constraints in part 18,10.
b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees,
or existing windbreaks.
c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of
the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no
reasonable alternative exists to allow the property to be used as permitted in the zone.
d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making
this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen
the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance.
e, The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18,5.7,050. Such mitigation

My neighbor, Gina DuQuenne, suggested that you may be able to give us assistance with our application for the removal of
two linden trees on our property.
We just want to remove the two linden trees which will be replaced with two trees that are on "The Birchwoods of Ashland
Homeowners Association" approved tree list.
Please know that we love trees and that is why we want to replace them with trees that will be more appropriate for the
space.
Our reasons for this request are listed below. I have spoken with Aaron Anderson who has been very helpful and told me I
needed to get this application to him no later than July 26 if I want it to be included in the next Tree Commission meeting on
August 5. We would appreciate anything you can do help make this process go smoothly.
We are requesting the removal of the two Linden trees on our property at 2181 Birchwood Lane, Ashland,Oregon. We will
replace the two Linden trees with two trees that are part of "The Birchwoods at Ashland Homeowners" approved tree list.
The Birchwoods at Ashland Homeowners Association list of approved trees to plant as new trees and/or as replacement trees
are:
Cercis variety 'Merlot'
Crape Myrtle varieties 'Natchez' white, 'Dynamite' red, or 'Watermelon' deep rose -red
Japanese Maple, standard green variety (Acer palmatum) or'Bloodgood'
Dogwood variety 'Venus'
Kwanzan Cherry
These are the reasons for this request to remove the two Linden trees:
1) Linden trees are not on the City of Ashland's approved Fire -wise tree list.
2) Linden trees are shallow rooted, invasive and can cause issues with foundations
3) Linden trees attract Insects. Aphids leave sticky sap on the leaves and cottony scale insects look like fuzzy growths on the
twigs and stems. Linden trees secrete sap like no other. Just one of these trees can coat your car, your lawn and your walkway
in a sticky film of sap.
4) The tree in our front yard is 8 feet 6 inches (102 inches) from our house, has visible large roots and has coated our car, our
plants, our walkway and our driveway with the sticky film of sap and debris. When the sap is on the driveway it is very slippery
and we have slipped walking on it. In addition, when the tree sheds the debris clogs our gutters and gets all over our
landscaping, entrance walkway to our house and our driveway.
5) The Linden tree on the side of our house is 3 1/2 feet (42 inches) from our house. The sticky sap goes onto the walkway on
the side of the house. This walkway is used by the public as a shortcut to go to the YMCA or stores in the Albertson shopping
center. We have had issues with people almost falling due to the sticky slippery sap on this path. In addition the debris and
sap from this Linden tree comes over our fence and falls directly on our air -conditioner condenser. In short, these trees create
a mess.
6) Linden trees grow 60 to 80 feet high.This is the wrong size tree for our small development and our smaller yard.
7) Researchers have found that the mass death of bumblebees is due partly to ineffective metabolism of linden nectar and
partly to a toxin in the nectar that impairs the bees' nervous systems. Specifically, in cool morning temperatures, the energy
that the bees get from nectar isn't enough for constant flight, so the bees are forced to crawl on the ground and may not be
able to regulate their body temperature. Also, the linden nectar is loaded with toxic chemicals, so bees that continue feeding
on it eventually die. The linden trees are just a small piece of the larger puzzle of what is causing bumblebee declines all over
the world, but may point researchers working on other causes in new directions.
8) Just as important to us is the fact that it is dangerous for people our age (72 and 73 years of age) to be climbing ladders to
clean the gutters. When the Linden trees are shedding, our gutters need to be cleaned every few days because debris
builds causing in the gutters creating an increased fire risk. Hiring someone to maintain the gutters so often is cost
prohibitive. Our walkways and driveways need to be cleaned every other day as well or they become hazardous with debris
and sap.
We believe that the list above is sufficient enough for the tree commission to consider this request and hope that you will
approve it.
