CITY OF ASHLAND July 21, 2021 Notice of Final Decision On July 21, 2021, the Community Development Director approved the request for the following: Planning Action: Subject Property: PA -TI -2021-00151 321 Clay Street Applicant/Owner: Northwest Biological Consulting - Scott English/ Wingspread LLC Description: A request for Physical and Environmental Constraints Permit for a replacement culvert and a Limited Activities and Uses Permit for a Water Resource Protection Zone to allow for a sediment removal project and approval of a multi-year maintenance plan to provide ongoing and routine maintenance of the existing storm water treatment and detention ponds in order to maintain flow reduce flooding. COMPREHENSIVE PLAN DESIGNATION: Multi -Family Residential; ZONING: R-2; MAP: 39 1 I1 C; TAX LOT: 3000 The Community Development Director's decision becomes final and is effective on the 12th day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winbum Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G), The ALUO sections covering reconsideration and appeal procedures are attached. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below, 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.6.1, above, may appeal a Type 1 decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection, The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Time for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content of Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised during the public comment period. d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de nova hearings before the Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5.1,060, subsections A — E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 197.805 - 197.860. The purpose of the project is to maintain flow through Clay Creek and to reduce the impacts of flooding. The application includes an extensive narrative and burden of proof document prepared by Scott English with Northwest Biological Consulting. One of the limited activities and uses that is permitted in the Water Resource Protection Zone (WRPZ) is the ongoing, routine maintenance of storm water treatment facilities such as detention ponds or sediment traps, vegetated swales, and constructed wetlands in order to maintain flow and prevent flooding. Once the multi-year maintenance plan is approved the routine annual maintenance of storm water treatment facilities well be exempt per AMC 18.3.11.050.A.2. The subject property is located on the east side of Clay St. and north of the railroad ROW. The property is 20.37 acres in size and is zoned R-2. The property is developed with a Mobile Home Park that has been established since the early 1960's and has over 100 mobile homes. The date of development is relevant as it pre -dates the establishment of the National Flood Insurance Program (1968) and the subsequent creation of Flood Insurance Rate Maps (FIRMS) and Flood Insurance Studies (FIS). PA -T1-2021-00151 321 Clay St./aha Page 1 This property includes, the following regulatory natural features: Clay Creek: Bear Creek is a riparian fish -bearing stream with associated ficiodplain lands which are regulated under federal, state and local regulations which include a local water resource protection zone (WRPZ) which extends 50 -feet upland from the creek's top -of -bank. Severe Constraint Lands: Land within the floodway channel of Ciay Creek are considered "Severe Constraint Lands." These lands are recognized as being extremely sensitive to disturbance and are carefully considered as part of the Physical and Environmental Constraints Review Permit process. Below is a screen capture from the FEMA Map Service Center (MS,C) showing the designated floodway and flood zones for the subject property. Additional details are provided is exhibits A - C included at the end of these findings which will also be discussed in further detail below. A Physical & Environmental Constraints Review Permits are required under AMC 18.3. 10 for the installation of a new culvert and for work within the floodway (severe constraints), as well as a Limited Activities and Uses Permits are required under AMC 18.3.11 for uses or activities within a water resource protection zone for a regulated stream or wetland. Proposal The application explains the proposal as follows: "A series of five ponds were built at Wingspread in the 1960's to provide detention/flood control and these ponds also served the Talent irrigation District which used Clay Creek and the Wingspread ponds to provide irrigation water to the TID irrigation system for agricultural use. Two of the ponds are now filled with sediment due to the lack of maintenance. Sediment needs to be removed to restore a functioning detention system. A Long -Term Sediment Removal Management/Maintenance Plan is needed to provide a long- term solution to the sediment problem. This Plan was prepared after conducting a physical sediment survey and mapping of two ponds that were identified as needing sediment removal to restore detention capacity to help control flooding. The plan is to remove sediment from Ponds 2 and 3 to restore depth and volume. Once the sediments are removed, the plan is to use an old sediment trap/pond system that used to divert Clay Creek into the trap to deposit sediment and allow the creek to flow into pond 2 and the other ponds. The sediment trap can be maintained on an annual basis as necessary to remove accumulated sediment from the trap which will help maintain the detention effectiveness of the four ponds. A long-term agreement with the City is needed to address the annual maintenance / management of the ponds. In addition, the culvert that crosses Clay Creek needs replacement. An engineering study and design were completed for the culvert replacement and that engineering design is attached" Exhibit B is included at the end of these findings with four pages from the applicant's submittal showing the cross sections of the ponds, the sediment levels, and diagrams showing the scope of work. The application details that 6,050 square feet of pond 2 will be excavated and 4,550 or of pond 3. The plans show that 900 cubic yards of sediment will be removed from pond 2, and approximately 500 cubic yards from pond 3. The Timeline for the project is expected to being in October of this year and is estimated to take roughly a month to complete. The application materials estimate that the culvert replacement will take approximately 10 days, and the sediment removal to take 15 days for pond 2, and 10 days for pond 3. The application describes this stretch of Clay Creek as follows: "Clay Creek, tributary to Bear Creek, is a small perennial stream that drains a watershed basin of 1.5 square miles. The stream would normally be dry during the hot summer months, but the creek and ponds are utilized by Talent Irrigation- District {TID), as a conduit for irrigation water during the growing season. The return flows average approximately 3 to 5 CFS from mid- May until the end of September. The pond banks are PA -T1-2021-00151 321 Clay St./aha Page 3 stable and covered by dense grasses and forbs with little or no evidence of bank erosion. The riparian vegetation surrounding the ponds is multi -storied and dense and provides good shading or most areas of the ponds, Riparian species are typically alder, willow, cottonwood, ash, mixed with some conifers as well as shrubs like snowberry, rose, red - rosier dogwood, and other shrubs. The majority- of the substrate is decomposed granitic sands mixed with small amounts of gravel. The ponds function as habitat for a variety of waterfowl, wading birds, and songbirds. Clay Creek basin is comprised of decomposed granite soils, which are easily eroded, especially from up -stream road building and housing development and the ponds due function as both sediment traps and detention basins. Clay Creek is not a fish bearing stream in this reach which is approximately 1 mile upstream from the confluence with Bear Creek and there are numerous fish passage barriers located between the project and Bear Creek and this reach of the creek is not considered Essential Fish Habitat (EFH). In- particular, there is a natural waterfall near the confluence with Bear Creek that is a natural barrier to fish passage which prohibits anadromous fish access to the project site (paraphrased from recent conversation with Pete Samarin, ODFW assistant district fish biologist)." In addition to any federal and state permits that will be required, including permits from the U.S. Army Corps of Engineers, Oregon Division of State Lands, U.S. Fish and Wildlife Service, Oregon Department of Fish & Wildlife, Department of Environmental Quality and Oregon Water Resources Division, the proposal requires the following land use approvals from the City of Ashland: 1) A Physical and Environmental (P&E) Constraints Permit under AMC 18.3.10 for any site work which constitutes "development" on floodplain corridor or severe constraints lands. The development of any crossing or other activities in the SFHA requires a P&E permit. 2) A Limited Activities and Uses Permit under AMC 18.3.11 for activities and uses within Water Resource Protection Zones (WRPZ). The development of a Multi -Year maintenance plan is authorized by AMC 18.3.11.060.A.2 Staff understands that the applicant is in progress with permits from both the Department of State Lands and Army Core of Engineers. Physical & Environmental Constraints Review hermit Because the project involves both the installation of a culvert in the flood plain as well as sediment removal in the Special Flood Hazard Area (SFHA), a Physical and Environmental Constraints review permit is required. The application describes the roadway culvert to be replaced as follows: "there is a buried roadway culvert system that drains pond 2 and connects to pond 3. During flood events the culverts get plugged and overtop and flood the access road to a major part of the mobile home park. The undersized culvert system needs to be replaced PA -T1-2021-00151 321 Clay St./aha Page 4 to eliminate loading of the road crossing which cannot pass all the high flows during storm events. The plan is to replace the existing undersized culverts with a much larger culvert that is designed to pass high flows when. Clay creek is in flood stage." The application explains that the culvert will be replaced in the following fashion 1. Clay Creek will be diverted around the construction zone by creating a sump at the upper area of pond one and pumping the flows, if any, around the construction area. 2. All work will be done in the dry and no construction will occur in flowing water or wet areas. 3. BMP's and other erosion control methods will be employed to minimize turbidity and erosion. The applicant includes an engineered diagram for the new culvert prepared by Marquess and Associates and are included as exhibit C. The plans state that the hydraulic capacity of the culvert is 66 cfs. The Public Works Department have reviewed the engineered plans and confirmed to meet the requirements of the 2000 Master Strom Water Plan (MSWP). The new culvert will increase the capacity and therefor shall not result in any increase in flood levels during the occurrence of the base flood. It should be noted that the existing culvert is shown in the FIS (attached as exhibit A) that during a 1% or 0.2% flood event is shown to overtop. While the capacity of the culvert is increasing it may still occasionally overtop during flood events. The criteria for approval of a Physical Constraints Review Permit are described in AMC Chapter 18.3.10.050 as follows: A. Through the application of the development standards of this chapter, the potential impacts to the property and nearby areas have been considered, and adverse impacts have been minimized. B. That the applicant has considered the potential hazards that the development may create and implemented measures to mitigate the potential hazards caused by the development. C. That the applicant has taken all reasonable steps to reduce the adverse impact on the environment. Irreversible actions shall be considered more seriously than reversible actions. The Staff Advisor or Planning Commission shall consider the existing development of the surrounding area, and the maximum development permitted by this ordinance. The application addresses each of the approval criteria showing that the potential impacts have been considered and that the proposal will reduce the likelihood of flooding. The applicant has considered potential hazards and will implement best practices to ensure that both erosion and turbidity will be minimized in the waterway. Staff feels that as proposed the applicant has demonstrated that they are taking all reasonable steps to reduce adverse impact on the environment. Limited Activities and Uses within a Wetland Protection Zone The excavation of sediment load acts as an enhancement on the existing storm water capacity of PA -T1-2021-00151 321 Clay St./aha Page 5 the ponds. The development of a multi-year maintenance plan is authorized as an approved Limited Activities and Uses Permit within the WRPZ. The application describes the current condition of the ponds as follows: "The sediment trap/pond was dredged on a regular basis, but that practice stopped about 15 years ago when floods damaged the diversion structure and sediments were no longer trapped and began filling in ponds 2 and 3 with sediment. Pond 2 is now totally filled with sediment and covered with reed canary grass, an invasive species. Pond 3 is nearly filled with sediment and covered with a variety of native and invasive aquatic plants. The remaining lower ponds are still relatively deep. and dredging is not anticipated for those remaining ponds." The first step in the process is mitigating the existing sediment by reactivating the old sediment trap, and then excavating ponds 2 and 3. The applicant explains that this initial process of conducting reactivating the old sediment trap system and excavation will be conducted as follows: 1. Dredging activities will take place in ponds 2 and 3 and will not involve getting dredging equipment into the water. 2. A medium sized tracked excavator will excavate the sediment which will be placed in a front-end loader that will transport loads of sediment to the staging area where it will be loaded on to dump trucks and taken to the nearby upland Knife River quarry for disposal. 3. Only one equipment access point to each pond is planned which will allow all the dredging of the ponds to be done from inside the pond. That approach will minimize any impacts to nearby trees and shrubs. 4. A clean -water bypass system will be developed to pump the low -flow creek water around the sediment removal area to provide dry conditions. 5. The ponds will first be drawn down to expose the sediments and Clay Creek will be diverted as necessary to allow for excavation in the dry. 6. Invasive reed canary grass will first be removed from the top layer of sediment and that material will be loaded & trucked to the upland disposal site at Knife River quarry. 7. Excavated sediment will be loaded into trucks from the pond excavation area and taken to a local upland quarry for disposal. 8. The old sediment trap system and diversion channel will be cleared and grubbed to remove blackberries and trash that have accumulated in the area. 9. The sediment trap/pond will be cleaned out and the outlet culvert inspected and replaced as needed. 1 Q.The old channel diversion structure will be inspected and replaced if necessary. I I .BMP`s and other erosion control and clean water methods will be employed for sediment removal and culvert replacement to minimize erosion, turbidity, and other water quality problems. 12. All upland grass staging/equipment areas disturbed by the equipment activities will be seeded with appropriate grasses and forbs as needed. PA -Tl. -2021-00151 321 Clay St./aha Page 6 13. All trees mapped on Figure 5 are located away from the actual sediment excavation area and no damage to trees or shrubs is anticipated. 14. Work will be supervised by qualified biologist. Following the completion of the above work then the Multi -Year Monitoring and Maintenance Plan will be initiated and conducted in an ongoing manner by the applicant. The application provides the following additional details regarding the status of the existing ponds and the intent of the ongoing sediment management plan: "The upper ponds have a long history of maintenance dredging which has not been done for approximately 15 years. The upper two ponds are mostly filled in with sediment that was transported and deposited by Clay Creek. The sediment consists mainly of decomposed granitic- sands. A- main- focus of the Long- Term Sediment Management Plan is to dredge two ponds and modify the upper pond to function as a sediment trap that can be maintained as needed to prevent the other ponds from filling in. Two other ponds located downstream from pond 3 are not full of sediment and will not be dredged. A maintenance agreement will be requested to allow maintenance dredging on a yearly basis." The Multi -Year Monitoring and Maintenance plan is outlined as follows: 1. Monitoring of the pond will typically take place after each major storm event and will include a written log measuring the estimated volume of sediment that is trapped, including a photograph of the sediment delta. 2. The monitoring period is from November through the end of September. 3. The monitoring results will be summarized at the end of September and an excavation contractor will remove the sediment and invasive species and dispose of it at the Knife River quarry or other suitable upland disposal sites. 4. Protective fencing will be placed around the perimeter of the sediment removal zone to protect trees and shrubs. 5. BMP's and other erosion control methods will be employed to maintain water quality. 6. The removal site will be dried out by developing a temporary sump and pumping water in pond 3 to maintain a dry site for the equipment to work in. 7. The work will occur outside of the normal breeding season for birds and other wildlife which will minimize any impacts from the sediment removal. 8. The sediment removal will take place from only one access point in the dry pond which will minimize potential impacts to trees and shrubs. 9. An annual report will be submitted to the Community Development Department that summarizes the annual sediment removal. The criteria for approval of a `Limited Activities and Uses Permit' within a Water Resources Protection Zone are described in AMC 18.3.11.060.1) as follows: 1. All activities shall be located as far away from streams and wetlands as practicable, designed to minimize intrusion into the Water Resources Protection Zone and disturb as little of the surface area of the Water Resource Protection Zone as practicable. PA -T1-2021-00151 321 Clay St./aha Page 7 2. The proposed activity shall be designed, located and constructed to minimize excavation, grading, area of impervious surfaces, loss of native vegetation, erosion, and other adverse impacts on Water Resources. 3. On stream beds or banks within the bank full stage, in wetlands, and on slopes of 25 percent or greater in a Water Resource Protection Zone, excavation, grading, installation of impervious surfaces, and removal of native vegetation shall be avoided except where no practicable alternative exists, or where necessary to construct public facilities or to ensure slope stability. 4. Water, storm drain, and sewer systems shall be designed, located and constructed to avoid exposure to floodwaters, and to avoid accidental discharges to streams and wetlands. 5. Stream channel repair and enhancement, riparian habitat restoration and enhancement, and wetland restoration and enhancement will be restored through the implementation of a mitigation plan prepared in accordance with the standards and requirements in section 98.3.91.990 Mitigation Requirements. 6. Long term conservation, management and maintenance of the Water Resource Protection Zone shall be ensured through preparation and recordation of a management plan as described in subsection 18.3. 11, 110, C, except a management plan is not required for residentially zoned lots occupied only by a single-family dwelling and accessory structures. The activities cannot reasonably located away from the WRPZ because the work is required to happen within the pond area, that said the application makes clear that encroachment into these areas will be kept to a minimum. Staff finds that the design of the project has minimized adverse impacts the WRPZ, and that the completion of this project will enhance the storm water capacity for the area. The application notes that mitigation will be provided by the removal of invasive species, restoration of the detention volumes, and creation of Long-term Maintenance and Management Plan. Conditions have been included below to require that a mitigation plan consistent with the requirements of AMC 18.3.11.110. The approval of this planning action constitutes the creation of a long-term conservation, management and maintenance plan consistent with the requirements of AMC 18.3.11.110.0 satisfying the final criteria Staff finds that, with the attached conditions of approval, that the proposal satisfies all of the relevant approval criteria. The sediment removal and the removal of invasive species will restore the ability of the ponds to mitigate flood flows. Trees The application notes that a complete survey of trees greater than 6 -inches DBH was conducted, and that there are no plans to remove any trees. The application goes on to state: "The trees are located on the berms and islands which will be avoided by the equipment. All the 58 surveyed trees are healthy and will survive potential impacts mainly because the activity will be far enough away from the excavation zone and will not be impacted by the work. Fencing will be installed and inspected prior to the start of work. A biologist familiar with the work and trees will provide supervision." PA -TI -2021-00151 321 Clay St./aha Page 8 Nelahbors' Concerns In accordance with the Land Use Ordinance, Notice of Complete Application (HOCA) was mailed to all surrounding properties within 200' of the subject property as well as a physical notice posted along the frontage. After the mailing of the HOCA, 13 written comments were received from 12 parties. All the public comment received were in support of the application, there was no public comment received that expressed concern or opposition. Conclusion Decision & Conditions of Approval The request for Limited Activities and Uses Permit for activities within Water Resource Protection Zones and Physical Environment Constraints Review Permit can be found to meet all applicable criteria. The applicant has submitted materials to the Planning Department to demonstrate compliance with the applicable approval standards for the approvals requested and by their reference are incorporated as if set out in frill. The project has been designed and located and will utilize best management practices through construction to minimize impacts to the water resources and associated flood plain corridor lands and buffer zones while implementing the necessary project, along with the mitigation and management plans. In staff's final assessment, the application with the attached conditions complies with all applicable City ordinances. Planning Action PA -TI -2021-00151 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action PA -TI -2021-00151 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant including proposed conservation, erosion control and pollution control measures shall be conditions of approval unless otherwise modified herein. 2) That the applicant shall obtain required state or federal permits and abide by the requirements thereof, including all proposed conservation, pollution control, and erosion control measures. 3) That prior to the commencement of site work including any demolition, staging, storing of project materials, or tree removal: a. A Mitigation Plan consistent with the requirements of AMC 18.3.11.110 and a Long -Term Conservation, Management and Maintenance plan consistent with the requirements of AMC 18.3.11.110.0 for the disturbed water resource protection zones shall be provided for the review and approval of the Staff Advisor once final design drawings have been developed. Mitigation plantings shall include local native plant species identified on the City's Local Native Plant Species List. The use of noxious and invasive plants on the City's Prohibited Plant List is prohibited in water resource protection zones. 4) The applicant shall obtain necessary inspection approvals for all conservation, pollution control and erosion control measures. I am writing to say this has been long overdue, and is very necessary for the above stated reasons. I have been very concerned as the problem has kept getting worse, and nothing seemed to be happening in spite of requests on the part of the park. The danger of flooding in certain times of the year is very real, and very important for us to prevent as there is only one entrance/exit to the park. The culvert in question runs under this road. In addition, I have noticed that the wildlife here have suffered, as the geese and ducks do not stay as long each year nor in as great numbers as before, because it is not safe for them with the increasing sediment and lack of water. The ducks and geese were one of the attractive aspects of living here in this park for me, and the pond and wildlife have contributed to the value of the real estate and our homes here. A. Through the application of the development standards of this chapter, the potential impacts to the property and nearby areas have been considered, and adverse impacts have been minimized. Standards for Fill in Flood Plain Corridor Lands: B. Crossings. A crossing of any waterway identified on the official maps adopted pursuant to section 18.3.10.070 Official Maps (e.g., for streets, property access or utilities) must be designed by an engineer. Stream crossings shall be designed to the standards of AMC 15. 10, or where no floodway has been identified, to pass a 100 -year flood without any increase in the upstream flood height elevation. The engineer shall consider in the design the probability that the crossing will be blocked by debris in a severe flood, and accommodate expected overflow. The crossing shall be at right angles to the stream channel to the greatest extent possible. Fill for stream crossings shall be kept to the minimum necessary to achieve property access but is exempt from the limitations in subsection 18.3.10.080.A, above. The applicant has addressed this standard by having a licensed Civil Engineer design the culvert crossing that meets the above stated crossing standard. Refer to attached culvert design and notes located in Figure A in the plans and exhibits. Water Resources Limited Activities and Uses: The following activities and uses within Water Resource Protection Zones are allowed provided the activities or uses comply with the review procedure and approval standards set forth in subsection 18.3.11.060.D. 1. Use of Power -assisted Equipment or Machinery. Use of power -assisted equipment or machinery for vegetation maintenance unless otherwise exempted in subsection 18.3.11.050.A.1.h. The use of Power -assisted equipment or Machinery for vegetation maintenance is exempted as detailed in subsection 18.3.11.050.A.1.h. The applicant is proposing to maintain the detention capacity of two ponds by removing invasive species such as reed canary grass and blackberries that have overgrown the ponds filled in with sediment. Refer to attached narrative, plans, and exhibits for details. 2. Multi -Year Maintenance Plans. Multi-year maintenance plans may be authorized as follows for existing areas or storm water treatment facilities in Water Resource Protection Zones which do not have a previously approved management plans. a. Publicly and Commonly Owned Properties. The routine restoration and enhancement of publicly and commonly owned properties such as public parks and private open spaces. The proposed project will help maintain and restore commonly owned properties within the Wingspread Mobil Home Park. Refer to the attached narrative and long- term maintenance plans. b. Storm Water Treatment Facilities. The ongoing routine maintenance of storm water treatment facilities such as detention ponds or sediment traps, vegetated swales, and constructed wetlands in- order to maintain flow and prevent flooding. Routine maintenance of storm water treatment facilities in accordance with an approved management plan is exempted as outline in subsection 18.3.11.050.A.2.c. A multi-year maintenance plan was developed to provide ongoing and routine maintenance of existing Wingspread storm water treatment and detention ponds or sediment traps in -order to maintain flow and minimize flooding. Refer to the attached narrative, plans, and exhibits for details. Tree Health and Protection: An inventory of trees that are greater than 6 -inch DBH (location, species, diameter, health, hazard, recommendations for treatment) within 15 -feet of the project site is required and any trees proposed for removal shown. The applicants will need to provide plans assessing the health of the trees and their ability to survive the impact of the proposed disturbance as part of the application; if a tree is unlikely to survive and its removal would ultimately involve substantially less disturbance within the Water Resources Protection Zone, removal may be the preferred option. If the trees are evaluated to live through construction, a tree protection plan will also have to be submitted. Work to be done inside the protection area will require an arborist to be on site to oversee the work. Fencing will have to be installed and inspected before work can ,6101141 NOD1OTS14 An inventory/survey of all trees within the work area greater than 6 -inch DBH was completed as illustrated in Figure 5 of the plan. There are no plans to remove any trees. The work access to the ponds is limited to one point and the work will be contained within the berms of the ponds where past sediment removal took place. The trees are located on the berms and islands which will be avoided by the equipment. All the 58 surveyed trees are healthy and will survive potential impacts mainly because the activity will be far enough away from the excavation zone and will not be impacted by the work. Fencing will be installed and inspected prior to the start of work. A biologist familiar with the work and trees will provide supervision. Mitigation and Management Plan: In addition to the plan requirements, a mitigation and management plan in accordance with 18.3.11.110 will also be required to be submitted when submitting application materials. This plan is to include, but not limited to, identified areas for equipment and material staging, re -vegetation and stream restoration plan, and erosion control measures. A mitigation and Management plan was completed and is attached as part of the plans and exhibits. Mitigation will be provided by: Removal of invasive species, restoration of the detention volumes, and creation of Long-term Maintenance and Management Plan. Two of the ponds are now filled with sediment due to the lack of maintenance. Sediment needs to be removed to restore a functioning detention system. A Long -Term Sediment Removal Management/Maintenance Plan is needed to provide a long- term solution to the sediment problem. This Plan was prepared after conducting a physical sediment survey and mapping of two ponds that were identified as needing sediment removal to restore detention capacity to help control flooding. The plan is to remove sediment from Ponds 2 and 3 to restore depth and volume. Once the sediments are removed, the plan is to use an old sediment trap/pond system that used to divert Clay Creek into the trap to deposit sediment and allow the creek to flow into pond 2 and the other ponds. The sediment trap can be maintained on an annual basis as necessary to remove accumulated sediment from the trap which will help maintain the detention effectiveness of the four ponds. A long-term agreement with the City is needed to address the annual maintenance /management of the ponds. In addition, the culvert that crosses Clay Creek needs replacement. An engineering study and design were completed for the culvert replacement and that engineering design is attached as report Figure A. Refer to the following Narrative, Figures, & Photographs for Plan details: Werview: /ingspread Mobile Home Park was built over 50 years ago along with a series of 5 ponds. The onds were designed and constructed in Clay Creek to provide a sediment trap and detention asins to help reduce flooding and trap sediments to help maintain the detention volumes of all ie ponds. TID maintains a water control structure at pond 4 that releases irrigation water from ie ponds into their system. In the past a sediment trap system and diversion allowed the 3 periodic removal of sediments from the trap/pond, which allowed the remaining four ponds to emain mostly sediment free and provide detention and storage for TID irrigation water eleases. The sediment trap/pond was dredged on a regular basis, but that practice stopped bout 15 years ago when floods damaged the diversion structure and sediments were no longer rapped and began filling in ponds 2 and 3 with sediment. Pond 2 is now totally filled with ediment and covered with reed canary grass, an invasive species. Pond 3 is nearly filled with ediment and covered with a variety of native and invasive aquatic plants. The remaining lower ►onds are still relatively deep. and dredging is not anticipated for those remaining ponds. here is a buried roadway culvert system that drains pond 2 and connects to pond 3. During lood events the culverts get plugged and overtop and flood the access road to a major part of he mobile home park. The undersized culvert system needs to be replaced to eliminate 'looding of the road crossing which cannot pass all the high flows during storm events. The plan s to replace the existing undersized culverts with a much larger culvert that is designed to pass sigh flows when Clay creek is in flood stage. (See attached Engineering Plan (Figure A), culvert ;ketches and dimensions and photographs of the crossing). :lay Creek, tributary to Bear Creek is a small perennial stream that drains a watershed basin of 1.5 square miles. The stream would normally be dry during the hot summer months, but the -reek and ponds are utilized by Talent Irrigation- District (TID), as a conduit for irrigation water During the growing season. The return flows average approximately 3 to 5 CFS from mid- May .intil the end of September. Ordinary high water around pond three was easily determined by rhe examining the debris lines around the ponds, much like a bathtub ring. The pond banks are Mable and covered by dense grasses and forbs with little or no evidence of bank erosion. The riparian vegetation surrounding the ponds is multi -storied and dense and provides good shading For most areas of the ponds, Riparian species are typically alder, willow, cottonwood, ash, mixed vvith some conifers as well as shrubs like snowberry, rose, red -rosier dogwood, and other shrubs. The majority- of the substrate is decomposed granitic sands mixed with small amounts of gravel. The ponds function as habitat for a variety of waterfowl, wading birds, and song- birds. Clay Creek basin is comprised of decomposed granite soils, which are easily eroded, especially from up -stream road building and housing development and the ponds due function as both sediment traps and detention basins. Clay Creek is not a fish bearing stream in this reach which is approximately 1 mile upstream from the confluence with Bear Creek and there are numerous fish passage barriers located between the project and Bear Creek and this reach of the creek is not considered Essential Fish Habitat (EFH). In- particular, there is a natural waterfall near the confluence with Bear Creek that is a natural barrier to fish passage which rohibits anadromous fish access to the project site (paraphrased from recent conversation Fith Pete Samarin, ODFW assistant district fish biologist). e ponds are a wonderful attraction for this mobile home community and provide real njoyment to the residents as well as providing aquatic and riparian habitat for a wide variety of iaterfowl, song- birds, and other wildlife. The upper ponds have a long history of maintenance redging which has not been done for approximately 15 years. The upper two ponds are mostly Iled in with sediment that was transported and deposited by Clay Creek. The sediment consists 7ainly of decomposed granitic- sands. A- main- focus of the Long- Term Sediment Management lan is to dredge two ponds and modify the upper pond to function as a sediment trap that can e maintained as needed to prevent the other ponds from filling in. Two other ponds located ownstream from pond 3 are not full of sediment and will not be dredged. A maintenance greement will be requested to allow maintenance dredging on a yearly basis. Refer to Figures arrative, and photographs for more information. Multi Year Management Plan Outline: Sediment Removal and Reactivating the Old Sediment Trap System 1. Dredging activities will take place in ponds 2 and 3 and will not involve getting dredging equipment into the water. 2. A medium sized tracked excavator will excavate the sediment which will be placed in a front-end loader that will transport loads of sediment to the staging area where it will be loaded on to dump trucks and taken to the nearby upland Knife River quarry for disposal. Refer to Table 1. 3. Only one equipment access point to each pond is planned which will allow all the dredging of the ponds to be done from inside the pond. That approach will minimize any impacts to nearby trees and shrubs. 4. A clean -water bypass system will be developed to pump the low -flow creek water around the sediment removal area to provide dry conditions. 5. The ponds will first be drawn down to expose the sediments and Clay Creek will be diverted as necessary to allow for excavation in the dry. 5 6. Invasive reed canary grass will first be removed from the top layer of sediment and that material will be loaded & trucked to the upland disposal site at Knife River quarry. 7. Excavated sediment will be loaded into trucks from the pond excavation area and taken to a local upland quarry for disposal. 8. The old sediment trap system and diversion channel will be cleared and grubbed to remove blackberries and trash that have accumulated in the area. 9. The sediment trap/pond will be cleaned out and the outlet culvert inspected and replaced as needed. 1©.The old channel diversion structure will be inspected and replaced if necessary. 11.131VIP's and other erosion control and clean water methods will be employed for sediment removal and culvert replacement to minimize erosion, turbidty, and other water quality problems. 12. All upland grass staging/equipment areas disturbed by the equipment activities will be seeded with appropriate grasses and forbs as needed. 13. All trees mapped on Figure 5 are located away from the actual sediment excavation area and no damage to trees or shrubs is anticipated. 14. Work will be supervised by qualified biologist. Culvert replacement & construction will be accomplished by: 1. Clay Creek will be diverted around the construction zone by creating a sump at the upper area of pond one and pumping the flows, if any, around the construction area. 2. All work will be done in the dry and no construction will occur in flowing water or wet areas. 3. BMP's and other erosion control methods will be employed to minimize turbidity and erosion. Timeline: The project is expected to start on or about October 7th and be completed by October 31, 2021. Typically, TID shuts off their irrigation water around the end of September. Monitoring of the pond will typically take place after each major storm event and will include a written log measuring the estimated volume of sediment that is trapped, including a photograph of the sediment delta. 2. The monitoring period is from November through the end of September. 3. The monitoring results will be summarized at the end of September and an excavation contractor will remove the 7 sediment and invasive species and dispose of it at the Knife River quarry or other suitable upland disposal sites. 4. Protective fencing will be placed around the perimeter of the sediment removal zone to protect trees and shrubs. 5. BMP's and other erosion control methods will be employed to maintain water quality. 6. The removal site will be dried out by developing a temporary sump and pumping water in pond 3 to maintain a dry site for the equipment to work in. 7. The work will occur outside of the normal breeding season for birds and other wildlife which will minimize any impacts from the sediment removal. 8. The sediment removal will take place from only one access point in the dry pond which will minimize potential impacts to trees and shrubs. 9.
