CITY OF -ASHLAND November 22, 2021 Notice of Final Decision On November 22, 2021, the Community Development Director approved the request for the following: Planning Action: PA -TREE -2021-00172 Subject Property: 545 Holly St. Applicant: Eric Recors / Quality Tree Service Description: A request to remove one large cottonwood tree at the property located at 545 Holly St. The tree is estimated to be 16 inches DBH and stands 50' tall. The application states that the tree has a significant lean towards the residence. While the property is single family and is small enough to be exempt because the tree is located in an identified Water Resource Protection Zone / Flood Plain Corridor Land a permit is required. COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-1-7.5; MAP: 39 IE 09 DB; TAX LOT. 8900, The Community Development Director's decision becomes final and is effective on the 12th day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). The ALUO sections covering reconsideration and appeal procedures are attached. The appeal may not be made directly to the Oregon Land Use Board of Appeals. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.I.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.G.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site, If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded, b. Tinze for Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content ofNotice ofAppeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised durbig the public comment period. d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before the Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type II public hearing procedures, pursuant to section 18.5.1.060, subsections A -- E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-1-7.5; MAP: 39 1E 09 DB; TAX LOT: 8900 SUBMITTAL DATE: October 22, 2021 DEEMED COMPLETE DATE: October 26, 2021 STAFF APPROVAL DATE: November 22, 2021 DEADLINE TO APPEAL (4:30 p.m.): December 6, 2021 FINAL DECISION DATE: December 7, 2021 APPROVAL EXPIRATION DATE: June 7, 2023 DECISION This proposal is to remove one tree from the property that is located at 545 Holly St. The property recently went through a Physical and Environmental Constraints Pennit as well as a Limited Activities and Uses Permit for bank stabilization activities along a Water Resource Protection Zone (WRPZ) (See: PA -T1-2021-00148). Typically, a property of this size and zoning would be exempt from a tree removal permit, however because staff was aware of the WRPZ on this property and the tree met the size threshold a tree removal permit is required. The subject property is accessed off of a flag drive located along the north side of Holly Street, between Idaho and Kearney Streets. The property was partitioned into this configuration with the recording of a county survey #11678 (approved as PA#88-096). The property is 0.25 acers in size and is zoned R-2. The surrounding neighborhood is also R-2 north of Holly St. and west of Harrison Street, to the south is R-1-7.5 zoning. The property contains a two-story, single-family residence and attached carport. A majority of the properties around 545 Holly St. are developed with detached single-family housing. However, adjacent to the subject property to the north and west there is also a 1.4 acre lot with mobile homes. The property has an identified intermittent and ephemeral stream as indicated on the adopted Water Resource Protection Zone map. In a letter from the project engineer on the previous land use action it was described as follows: "The existing drainage path is a unique "island" of open drainage that lies within the "Mountain Creek Basin" (name per the City's Stormwater Master Plan) between existing municipal storm drainage facilities located within both Holly Street and Harrison Street. The TREE -2021-00172 545 Holly St../aa Page 1 Master Plan includes the following excerpt: The small Beach, Mountain, and Clear Creek watersheds have been highly encroached by residential development. Ninety percent of the streams 'lengths have been piped. Little native vegetation exists along the stream reaches. The streams pose little threat to property but they show some signs of erosion. " The tree proposed for removal is identified as a large cottonwood estimated to be 16" DBIH and 50' tall. The application, prepared by an ISA certified arborist and included a completed risk assessment form identifying a significant lean towards the house with the only proposed mitigation option being removal. In accordance with the Land Use Ordinance, Notice of Complete Application (HOCA) was mailed to all surrounding properties within 200' of the subject property as well as a physical notice posted along the frontage. No public comment received either in favor or against. At the November regular meeting of the Tree commission the application was reviewed. Staff presented the application and provided an overview for the reason to request the removal. The Tree Commission, after a brief deliberation, determined that the location of the tree and the damaged being caused consisted a hazard and voted unanimously to approve the application as submitted. To be deemed a "hazard tree" the condition or location of the tree must clearly present a public safety hazard. Or, that there is a foreseeable danger of property damage to an existing structure or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment, relocation or pruning. Based on the materials provided by the applicant and a site visit by staff, it is reasonable to conclude that the subject tree is indeed posing a hazard to the foundation of the building and therefore ought to be removed. Staff finds that the tree, due to its location and size, poses an unacceptable hazard to the property that cannot be reasonably alleviated by means other than removal and replacement. Staff finds the application has sufficiently demonstrated compliance with all applicable approval criteria. The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.B as follows: 1. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of hazard tree in part 18.6. b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action 4TREE-2021-00172, a request to remove one hazard tree, complies with all applicable city ordinances with the imposition of the conditions attached TREE -2021-00172 545 Holly St../aa Page 2 below. Therefore, Planning Action #TREE -2021-00172 is approved. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050, Such mitigation requirements shall be a condition of approval of the permit. PHYSICAL & ENVIRONMENTAL CONSTRAINTS 18.3.10.050 An application for a Physical Constraints Review Permit is subject to the Type I procedure in section 18.5.1.050 and shall be approved if the proposal meets all of the following criteria. A. Through the application of the development standards of this chapter, the potential impacts to the property and nearby areas have been considered, and adverse impacts have been minimized. B. That the applicant has considered the potential hazards that the development may create and implemented measures to mitigate the potential hazards caused by the development, C.
