Mountain Ave (Ashland High School) Applicant: Christopher Brown, Arkitek/ Ashland School District 5 Description: A request -for Site Design Review to allow the construction of a new 2,539 square foot single -story classroom addition to the Ashland High School Science Building, and a 1,249 square foot addition to the Humanities Building which includes an elevator and restrooms. The project also includes seismic retrofitting of existing structures, installation of emergency power generators, and safety enhancements including the enclosure of exterior hallways with a polyearbonate cladding. COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-2; MAP: 39 1 E 09DA; TAX LOTS: 100 The Community Development Director's decision becomes final and is effective on the 12t" day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to Subsection 18.5.1..050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision, F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. 1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence: to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the Opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred Crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision, The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action, 4, If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request, Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: I, Who May Appeal, The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b, Ally person who is entitled to written notice of the Type I decision pursuant to subsection 18,51,05OR c. Any other person who participated in the proceeding by Submitting written col-nments on the application to the City by the specified deadline. 2. Appeal Filing Procedure, a. Notice oj'Appeal, Any person with standing to appeal, as provided in Subsection 18.5.1.050.G.1, above, may appeal aType I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The 'fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If ail appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Tiinefior Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content qf'Notice ofApppal. The notice ofappeal shall be accompanied by the required filing fee and shall contaill. j. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised during the public comment period. d, The appeal reqUireluentS Of this Section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo, hearings before the Planning Cornin ission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading LIP to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional. evidence, testimony, or argument concerning any relevant ordinance provision. 4, Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5,1,060, subsections A - E, except that the decision of the Planning Commission is the filial decision of the City on an appeal of a Type I decision, A decision on an appeal is final the date the City mails the adopted and signed decision, Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 19T805 - 19T860. COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-2; MAP: 39 1E 09DA; TAX LOTS: 100 SUBMITTAL DATE: June 26, 2019 DEEMED COMPLETE DATE: December 29, 2020 STAFF APPROVAL DATE: January 27, 2021 DEADLINE TO APPEAL (4:30 p.m.): February 9, 2021 FINAL DECISION DATE: February 10, 2021 APPROVAL EXPIRATION DATE: October 10, 2022 DECISION Subject Property The subject property is located on the north side of Siskiyou Boulevard, at the corner of Mountain Ave and Siskiyou Blvd. The surrounding neighborhood is comprised of single-family homes, multi -family developments, and commercial properties. The subject property is zoned Low -Density, Multi -Family Residential (R-2). The zoning to the west and south of the subject property is R-2. To the north and east, the zoning is R-3 (High -Density Multi -Family). The property is owned by Ashland School District and is the site of the High School. The subject property is 12.05 acres. The lot is a trapezoidal lot with frontage on Siskiyou Boulevard and Mountain Ave. Proposal The request for Site Review approval to construct additions to the Humanities and Science buildings, seismically retrofit existing structures, installation of emergency power generators, and safety enhancements including the enclosure of exterior hallways with a polyearbonate cladding. The intention of the additions and upgrades is to improve safety and elevate overcrowding of classrooms, provide outdoor teaching area, and provide accessibility improvements to walkways and parking lots to improve access for students and faculty with disabilities. Polyearbonate cladding is proposed for use on the project at both the upper Humanities exterior walkways and the western exterior hallway entrance of the Science building. The application also identifies the removal of several existing small trees and shrubs. However, The proposed project will not result in the removal of any Significant Trees, and therefore, a tree removal permit is not required. PA-Tt-2020-00136 201 S Mountainlbg Page 1 Project Impacts The first approval criterion for Site Design Review approval is that, "The proposal complies with all of the applicable provisions of the underlying zone (part 18.2), including but not limited to: building and yard setbacks, lot area and dimensions, density and floor area, lot coverage, building height, building orientation, architecture, and other applicable standards. " . The application states that proposal complies with all applicable provisions of part 18.2, noting that the property is zoned R-2, which is a multi -family residential zone, and that Public School uses are permitted within the zone. The application presents a new 2,539 square foot single -story classroom addition to the Ashland High School Science Building, and a 1,249 square foot addition to the Humanities Building. The application notes that the Ashland High School site was originally developed in the 1960s and the existing conditions comply with most of, but not all the applicable Site Development and Design Standards. The proposed design increases compliance with standards pertaining to parking, accessibility, and bicycle parking within the areas of project scope. Staff finds that the proposed additions comply with all applicable setbacks, lot coverage requirements, building height, orientation, and other standards. The second approval criterion is that, "The proposal complies with applicable overlay zone requirements (part 18.3)." The subject property is located within the Detail Site Review zone and a portion of the site is located within the Siskiyou Hargadine Historic District. The location of the proposed Science Building addition is within the designated historic district overlay. The Ashland Historic Commission reviewed the proposed addition to the Science Building, including the proposed polyearbonate and metal siding, and found the proposal to be compatible with the historic development of the Ashland High School campus. The Historic Commission unanimously recommended approving the application as presented. The Commission further commented that the project enhances the existing Science Building without mimicking the historic structure and that the addition will be a positive and refreshing feature given the visibility from the intersection of Siskiyou Blvd. and Morse Ave. The Detail Site Review Standards are included in the Site Development and Design Standards are discussed in the next section. The third approval criterion is that, "The proposal complies with the applicable Site Development and Design Standards of part 18.4, except as provided by subsection E, below." Public school use is a permitted uses in the R-2 Low -Density Multiple -Family Residential District and Ashland High School is well -established in this location. Staff finds that the proposed additions to the existing school buildings are in compliance with setbacks, height and lot coverage requirements of the R-2 Low -Density Multiple - Family Residential District. Setback requirements dictate that front yards must be at least 20 feet deep along arterial streets, side yards adjacent to public streets must be a minimum of ten feet, and rear yards must be ten feet plus ten feet for each story in excess of one story. As proposed, the building additions relative to Siskiyou Boulevard, Mountain Avenue, and Morse Avenue significantly exceeds all required setbacks. Accessibility enhancements to existing pathways, parking, and installation of the proposed Elevator to serve the Humanities Building, bring the site fiu-ther into compliance with accessibility standards. The maximum building height in the R-2 zoning district is 35 feet. The new addition to the northern end of the existing three story humanities building is for the purpose of including an elevator. The height of the addition is 41.5' however as an average height between the uphill side and the downhill side of the flat roofed structure, the building has an average height of 337.5" . The one story addition to the Science Building, including the roof top parapet and guard-rail, has a total height of 21' 6". Staff finds that the approximate 250 existing onsite parking spaces existing provide less than required to meet the demands of the existing assembly uses on campus, the application as proposed does PA-,ri-2020-00 I36 201 S Mountainlbg Page 2 not result in either a change in use or an intensification of demand, and as such no additional parking is required. The application clarifies that the additions, seismic upgrades, and safety and accessibility enhancements will not create any new uses or activities on site, will not increase the number of users, and will not intensify or expand the current uses and activities of the site. The application proposed changes to existing outdoor lighting to allow dimmable energy conserving lighting within the corridors. The programable nature of the corridor lighting is intended to insure the polycarbonate panels do not become large light boxes illuminating the surrounding neighborhood. As part of the notification process for this application to the neighbors, Staff received comments from adjacent neighbors and property owners that the existing LED lighting recently installed on the Gymnasium and the on the north east corner of the Humanities building were directly illuminating their residential properties. This direct illumination is a violation of 18.4.4.050 and as such the Ashland School District was informed of the adverse impact upon the neighboring residential properties in early January. Since that time the School District has reduced the light intensity of 4 of 8 lights by 62% and are working with their electrician to similarly shield the remaining 4 lights causing the disturbance. In this way the School District has been very responsive to complying with the outdoor lighting standard once made aware of the violation. To ensure any new lighting installed or upgraded as part of this project comply with the standards in 18.4.4.050 a condition of approval has been added requiring a demonstration of compliance prior to issuance of a certificate of occupancy. The fourth approval criterion is that, "The proposal complies with the applicable standards in section 18.4.6 Public Facilities and that adequate capacity of City facilities for water, sewer, electricity, urban storm drainage, paved access to and throughout the property and adequate transportation can and will be provided to the subject property." Staff finds that City facilities are available to serve the proposed new buildings. Existing facilities for water, sewer, paved access to and through the development, electricity, urban storm drainage, and adequate transportation via existing streets are in place and serve the existing school facility. Existing curbside sidewalks are in place along the full South Mountain Avenue and Morse Avenue frontages, and parkrow planting strips and sidewalks are in place along the full Siskiyou Boulevard frontage. The final criterion for Site Design Review approval addresses instances where Exception to the Site Development and Design Standards provides necessary, noting that, "The approval authority may approve exceptions to the Site Development and Design Standards of part 18.4 if the circumstances in either subsection 1 or 2, below, are found to exist: 1) There is a demonstrable difficulty meeting the specific requirements of the Site Development and Design Standards due to a unique or unusual aspect of an existing structure or the proposed use of a site, and approval of the exception will not substantially negatively impact adjacent properties, and approval of the exception is consistent with the stated purpose of the Site Development and Design; and the exception requested is the minimum which would alleviate the difficulty.; or 2) There is no demonstrable difficulty in meeting the specific requirements, but granting the exception will result in a design that equally or better achieves the stated purpose of the Site Development and Design Standards." The application does not include a request for any Exceptions to the Site Development and Design Standards The criteria for Site Design Review approval are described in AMC Section 18.5.2.050 as follows: A. Underlying Zone: The proposal complies with all of the applicable provisions of the underlying zone (part 18.2), including but not limited to: building and yard setbacks, lot area and dimensions, density and floor area, lot coverage, building height, building orientation, architecture, and other applicable standards. PA-TI-2020-00 t 36 201 S MountaLnft Page 3 B. Overlay Zones: The proposal complies with applicable overlay zone requirements (part 18.3'). C. Site Development and Design Standards: The proposal complies with the applicable Site Development and Design Standards of part 18.4, except as provided by subsection E, below. D. City Facilities: The proposal complies with the applicable standards in section 18.4.6 Public Facilities and that adequate capacity of City facilities for water, sewer, electricity, urban storm drainoge, Paved access to and throughout the property and adequate transportation can and will be provided to the subject property. E"'. Exception to the Site Development and Design Standards, The approval authority may approve exceptions to the Site Development and Design Standards of part 18.4 if the circumstances in either subsection I or 2, below, are found to exist. 1. There is a demonstrable difficulty meeting the specific requirements of the Site Development and f7i Design Standards due to a unique or unusual aspect of an existing structure or the proposed use of a site,- and approval of the exception will not substantially negatively impact adjacent properties; and approval of the exception is consistent with the stated purpose of the Site Development and Design; and the exception requested is the minimum which would alleviate the difficulty.; or 2, There is no demonstrable difficulty in meeting the specific requirements, but granting the exception will result in a design that equally or better achieves the stated purpose of the Site Development and Design Standards. In Staffs opinion, the criteria for Basic Site Review and Detail Site Review are satisfied by the proposal with the conditions attached. Planning Action PA-TI-2020-00136 is approved with the following conditions. Further, if any one or more of the: following conditions are IbUnd to be invalid for any reason whatsoever, then Planning Action PA-TI-2020-00136 is, denied. The following, are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2) That the plans submitted for the building permit shall be in substantial conformance with those approved as part of this application. If the plans submitted for the building permit are not in substantial conformance with those approved as part of this application, an application to modify the Site Design Review approval shall be submitted and approved prior to issuance of a building permit. 3) That storm water from all new impervious surfaces, and runoff associated with peak rainfalls must be collected on site and channeled to the City storm water collection system (i.e., curb gutter at public street, public storm pipe or public drainage way) or through an approved alternative in accordance: with Ashland Building Division policy BD-PP-0029. On -site collection systems shall be detailed on the building permit submittals. 4) That the building permit submittals shall include: a. A final landscaping and irrigation plan which includes irrigation details satisfying the requirements of the Site Design and Use Standards Water Conserving Landscaping Guidelines and Policies. b. Bicycle parking details detailing the proposed racks, their placement and coverage. Inverted u-racks shall be used for the bicycle parking, All bicycle parking shall be installed in accordance with design and rack standards in 18.4.3,070.1 and J prior to the issuance of the certificate of occupancy. The building permit submittals shall verify that the bicycle parking spacing, and coverage requirements are met in accordance with 18.43.070,1 PA-Ti-2020-00 136 201 S Mount�iin/bg [Inge 4 C. That exterior building materials, Including the polycarbonate panels, and paint colors shall be compatible with the proposal in the application, and sample exterior building colors shall be provided with the building permit submittals for review and approval of the S Laff Advisor. Very bright or neon paint colors shall not be used in accordance with AMC 18.4.2.030.E. 5) That prior to the issuance of a Certificate of Occupancy: a. All exterior elements shown on the approved building permit submittals, including modifications of the plans to address conditions of approval here, shall be installed on the building, inspected and approved prior to the issuance of the certificate of occupancy. b. All exterior lighting shall be directed on the property and shall not directly illuminate adjacent residential proprieties in compliance with 18.4.4.050. C. On -site vehicular parking is located in three, lots along the southern property boundary, and in the center of the site north of the auto shop. ADA parking is located in all four lots. There are several locations for bicycle parking on site adjacent to the major school buildings. There is extensive, well established landscaping throughout the 12.05 acre site, including shade trees, adjacent to parking areas and open space. Refer to the attached Exhibits B, C, and D and the following narrative for design details. The approximate overall site coverage is currently 31.6% buildings, 43.1% landscaping, and 25.3% impervious surfacing such as driveways, parking areas, and the track. The proposed overall site coverage will be 31.7% buildings, 42.8% landscaping, and 25.5% impervious surfacing. The proposal complies with all applicable overlaying zone requirements. A narrow portion of the subject site overlaps the historic downtown district overlay zone along Siskiyou Boulevard. See Exhibit B attached and written findings below for applicability of AMC section 18.4.2.050 Historic District Development. The site was originally developed in the 1960s and the existing conditions comply with most of, but not all of the applicable Site Development and Design Standards. Ashland HiRh School The proposed development expands the current campus by approximately 1.8%. Due to the limited nature of the development, improvements to existing building orientation and scale will not be feasible. The design will however apply this code section to all proposed work. The following has been observed on site: Existing buildings on site have been oriented toward the street whenever possible. The proposed building additions support this code section. Existing auto circulation & off- street parking is not located between buildings and the street, parking is located toward the lesser order of the streets. No changes to auto circulation are proposed. See the attached Exhibit B for details. Existing building facades occupy the majority of the project's street frontage on Mountain and Siskiyou, the higher order streets. The proposed building additions support this code section, and the proposed landscape improvements support this code section. See the attached Exhibits B and D for details. The Ashland Nigh School campus is access from several points of entry. The admin entrance on S Mountain Ave is the primary entrance for visitors, which is accessible via a public sidewalk. Not all of the ten existing buildings on site are accessible from public sidewalk. The proposed project will improve accessibility to the Humanities Building, English Building, and Science/Library Building through the installation of new ramps. All new accessible routes will incorporate ADA parking signage and way -finding signage per this code section. See the attached Exhibits B, and C. No new buildings are included in the proposed development plans. The project site includes numerous trees across campus. Only a small portion of those are in locations that are affected by proposed construction. Proposed site improvements are geared primarily towards improving accessibility with new walkways, ramps, and stairs, and raising the existing 'sunken plaza' to be level with surrounding grades. Eleven (11) trees and large shrubs were determined to be in close proximity to proposed construction and potentially affected by construction, and of those, five (5) are proposed for removal. Of those proposed for removal, two (2) multi -trunk shrub species (both in poor condition), a Portuguese Laurel and a Torulosa Juniper, have a combined diameter at breast height (dbh) of 12" or greater. Three (3) trees with a dbh less than 12" but greater than 6" will also be removed as a part of the project. (See Tree Removal Summary below.) Removal of these trees and large shrubs will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. Additionally, the removal of these trees and large shrubs will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. One or more trees are planned to be planted in the new landscape as mitigation for each tree greater than 6 inches in diameter that is removed. The Site Design Review Preliminary Planting Plan identifies new trees to be planted as part of the project. TREE REMOVAL SUMMARY: Shrubs 12" dbh and larger - 2 Trees <12" dbh and > 6" dbh - 3 Total: 5 Tree #1: 14" Red Pine. Retain. Tree #2: 10" Birch tree.
