The application materials indicate that the trees are in poor health as indicated by lack of root flare visible canker wounds and a pronounced lean. The application explains that the HOA feels that these trees pose a fire hazard as well. COMPREHENSIVE PLAN DESIGNATION. Single Family Residential; ZONING: R-1-5; MAP: 39 lE 04 DD; TAX LOT: 1600. The Community Development Director's decision becomes final and is effective on the 121h day after the Notice of Final Decision is mailed. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.G, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. I . Any party entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter. 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: 1. Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to subsection 18.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.G.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b. Time for Filing. A notice of appeal shall be tiled with the Staff Advisor within 12 days of the date the notice of decision is mailed. c. Content of Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of the decision. ii. A statement demonstrating the person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal. iv. A statement demonstrating that the appeal issues were raised during the public comment period. d. The appeal requirements of this section must be fully met or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before the Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5.1.060, subsections A — E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of Appeals, pursuant to ORS 197.805 - 197.860. COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-1-5; MAP: 39 1 E 04 DD; TAX LOT: 1600 SUBMITTAL DATE: September 29, 2020 DEEMED COMPLETE DATE: October 1, 2020 STAFF DECISION DATE: December 23, 2020 DEADLINE TO APPEAL (4:30 p.m.): January 4, 2021 FINAL DECISION DATE: January 5, 2021 APPROVAL EXPIRATION DATE: June 5, 2022 DECISION This proposal is to remove two coniferous trees identified as hazard trees from the property at 485 Clinton Street known as Common Area North to the Riverwalk Subdivision. The property is 0.10 acres in size and is undeveloped except for landscaping. Because the trees are a part of the approved landscaping plan a tree removal permit is required. The property is located at the south- west corner of the intersection of Clinton and Brisco Streets. The subject property and surrounding neighborhood are zoned R-1-5. The two trees proposed for removal are confirs planted in a row that nuns north -south adjacent to the home at 443 Clinton St. The application explains that the trees are requested for removal as they don't meet fire -wise standards as they provide ladder fuel. The application materials included pictures of the trees showing that one has a slight lean. The photos also showed details of the base of the trees stating that they showed evidence of girdling roots and lack of visible root flare. The Ashland Fire Department, working with the Homeowners association conducted a walk through in an effort to make their community more fire -wise. Staff received an email from. Ms. Gibble at the AFD which wrote in relevant part: "If these trees are limbed up 1/3 the way up the tree, or 8 feet off the ground, then they are spaced well enough that they do not represent a fire hazard." During the public comment period staff received no input from the public. The application was scheduled to be reviewed by the Tree Commission at their regular monthly TREE-2020-00128 Clinton St. Riverwalk Common Area/aa Page 1 meeting in October, but there was not a quorum so no business was conducted. Staff felt the evidence in the record insufficient to determine that the trees were a hazard without input from the Tree Commission. Staff consulted with the applicant who agreed to extend the time period to the 120-day rule. On November 101b the applicant provided a form agreeing to a 60-day extension to the time limit set forth in ORS 22T178(1). At the November 5t", 2020 meeting of the Tree Commission there was a quorum and the tree commission reviewed the application. At that time, the tree commission was only accepting written testimony. The tree commission reviewed the application materials and determined the fire hazard posed by the trees could be mitigated by pruning. The tree commission did not find that the lean of the trees, nor the lack of `visible root flare' indicated that there were any issues with regard to the health of the trees. After a brief deliberation, the tree commission voted unanimously to recommend denial of the application. As staff prepared findings there were concerns that there was not information in the record to confirm that pruning the trees to the standard recommended by the fire department would not have a deleterious effect on the trees. For this reason, staff remanded the application to the tree commission again for an additional hearing. At the Tree Commission's December 3, 2020 meeting the application was once again presented. This time the tree commission was accepting oral testimony via zoom. The application was represented by both the adjacent property owner and the head of the landscape committee for the Riverwalk HOA. The applicants provided testimony, presented a PowerPoint presentation and fielded questions from the commissioners. At the close of the public hearing the tree commission deliberated. It was stated that the trees appeared healthy, and the while there was evidence that one of the trees was leaning slightly it did not affect the stability of the tree. The tree commission found that the photographic evidence was not conclusive that the trees were in poor health. After the deliberations concluded the tree commission found that there was not enough evidence in the record to make a finding that the trees represented a hazard. The tree commission then voted unanimously to recommend denial of the application. Following the tree commission hearing, the staff advisor reviewed the tree commission's recommendation and concurred that there was not evidence in the record to make a finding approving a hazard tree removal. The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.8 as follows: 1. Hazard Tree, A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Now, therefore, Staff finds that Planning Action #TREE-2020-00128, a request to remove two hazard trees is denied without prejudice. By denying the application without prejudice, pursuant to AMC 18.5.1.1.130.A, the applicant is free to reapply at any time with a more developed application. I am the chair of the Landscape Committee and am submitting this request for Riverwalk. Riverwalk is located across the street from North Mountain Park, The pin below is the "Common Area North" where the two trees we are requesting permission to remove are located. The trees requested to be removed are in the middle the row of conifers, that run N-S along the house on the left side (south) of the picture. These trees do not meet Fire -wise standards: These trees provide a fuel ladder to the nearby home The proximity of the fuel load trees to the home RECEIVED BY EMAIL, 9/29/20 The trees are within the defensive space for the home These trees, in a wind storm, slam in to most vulnerable part of the home - the roof The need to keep trees away from structures The proximity of the wood fence to the trees The existing conditions of the trees render them unsafe: Removal was requested by the nearby homeowners During the wind storm, the trees slammed into the house and roof The trees are too close to a home The trees are, endangering the home and fence. The conifer trees are fuel loaded Both are leaning. Neither trees have visible root flare Evidence of girdling roots Large canker on the lower portion of trunk of tree #1 impacts and questions the structural integrity of the tree Both have questionable and unsafe root flare areas - no root flare, asymmetrical trunk, canker damage, and girdling stems. The house is well within the landing zone if either tree fell in that direction. No visible root flare (root collar, root crown)!. Tree is leaning, BY EI\AAI[- 9/29/20 Tree A (#3) 'Fop of large canker at the base of the tree. Dark areas at the top may have been caused by pathogens. No visible root flare. This large cankers at the base of the tree limits the tree's structural integrity. The lowest part of the trunk is distorted and has more trunk tissue on the right side than the left. The tree is not consistently vertical and present questions of stability.
