CITY OF -YNSHLAND September 28, 2021 Notice of Final Decision On September 28, 2021, the Community Development Director approved the request for the following: Planning Action: PA -T1-202,1-00160 Subject Property: 351 Walker St Applicant: Southern Oregon University Description: A request for Conditional Use Permit to replace the existing Raider Stadium scoreboard with a new scoreboard that incorporates video playback technology. The existing scoreboard is approximately 18 years old, well past its useful life. The video replay capability of the new board conflicts with the COA sign ordinance, however, which does not allow for moving signs. Therefore, SOU requests a CUP to officially modify the existing Master Sign Agreement to allow for the installation of the new video scoreboard, The Corm-nunity Development Director's decision becomes final and is effective on the 12"' day ,after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winborn Way, Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALIJO) 18.5.1.050(14) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(0). Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050,0, aType I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. 'Fhe Staff Advisor may reconsider a Type I decision as set forth below, I . Any party entitled to notice of the planning action, or any City department. may request reconsideration of'the action after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity to respond to the issue prior to inaking a decision. 1 Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider the matter, 3. If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to ally party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that all ell -Or Occurred crucial to the decision, the StaffAdvisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type .1 Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: I . Who May Appeal. The following persons have standing to appeal a Type I decision. a. The applicant or owner of the subject property. b. Any person who is entitled to written notice of the Type I decision pursuant to, subsection 18.5.1.050.B. c. Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing Procedure. a. Notice of,,Ippeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.0.1, above, may appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to, tile procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded, b. Tiniefor 17iling. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of decision is mailed. 0. Content (?I'Notice of Appeal. The notice of appeal shall be accompanied by the required filing fee and shall contain. i. An identification of the decision being appealed, including the date of tile decision, ii. A statement demonstrating tile: person filing the notice of appeal has standing to appeal. iii. A statement explaining the specific issues being raised on appeal, iv. A statement demonstrating that the appeal issues were raised during the public comment period. & The appeal requirements of this section must be fully rnet or the appeal will be considered by the City as a jurisdictional defect and will not be heard or considered. 3. Scope of Appeal. Appeal hearings on Type I decisions made by the Staff Advisor shall be, do novo hearings before the Planning Commission. Tile appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but may include other relevant evidence and arguments. The Commission may allow additional evidence, testimony, or arguirient concerning any relevant ordinance provision, 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5.1.060, subsections A — E, except that the decision of the Planning Commission is the final decision of the City on an appeal of a Type I decision, A decision on an appeal is final the date the City mails the adopted and signed decision. The proposed score board is visible from the rights-of-way, so it is a regulated sign. Staff discussed with the applicant potential strategies to provided screening so that the score board was not visible from the right of way (and thus not a regulated sign), but the applicant for various reasons explained in their application felt that visually screening the score board would create a larger impact and therefor chose to apply for a CUP to officially modify the Master Sign Program to allow for the installation of the new video scoreboard. Subjectl-'rqpedy & Baekground Southern Oregon University is a nearly 120 -acre campus. Siskiyou Boulevard splits the campus area with the majority of the student housing to the north of Siskiyou and the majority of the academic buildings south of Siskiyou Boulevard. Additionally, the north side of Siskiyou houses the athletic facilitates and south of Siskiyou are the music/art faculties. TI -ac football stadium, which is the proposed location for the new score board, is located centrally between Wightman Street and Walker Avenue, and Iowa & Ashland Streets, The three parcels that contain the football stadium and other sports facilities property is located at 351 Walker, Avenue: and 380 PAWN -2021-00160 Southern Oregon University/aha Page 1 Wightman Street, and comprise a total of 48.16 -acres (Tax lot 391E]OCA 100 extends north to the train tracks,), The parcel is located on the Southern Oregon University campus and is within the, Southern Oregon University District (SO) zoning overlay, Current Pr olmsal SOU has had a Master Sign Program for the entire campus that was adopted in 1995. That program established the size and location for the vast majority of the signs around campus allowing them to be changed as needed with a basic sign permit so long as the dimensions, location, and materials were generally the sante. This particular application has the addition of a new LED video score board for the Raiders football stadium. The proposal is to replace the existing Raider Stadium scoreboard with a new scoreboard that incorporates video playback technology. The existing scoreboard is approximately 18 years old, well past its useful life. The video replay capability of the new board conflicts with the CCA sign ordinance, however, which does not allow for moving signs. Therefore, SOU requests a CUP to officially modify the existing Master Sign Agreement to allow for the installation of the new scoreboard. The score board that is being replaced is 33'x19' and is proposed to be replaced with a new Neveo 16nim I.ED video score board that will measure 32' x 20.' (An increase of only 13 square feet). The application summarizes the key facts about proposed usage and technical specifications as follow: A. The off -axis angle of view (160 degrees), and distance to Walker and Wightman (400 feet plus), will render the graphics very indistinct and vague to passers-by. B. The area of view along Wigbtrnan Street will be approximately 240 feet and approximately 407 feet along Walker Avenue. G Video "play" will entail an occasional instant replay but will otherwise present static pictures of student -athletes, a hawk graphic, sponsor logo, or be blank, D. Total estimated time this scoreboard will be in use: 47 hours during daylight hours. F. The scoreboard's video presentation is for internal audiences at soccer, football, track and field and Commencement within Raider stadium, not for notification or advertisement external to that (i.e., passers-by on Wightman or Walker). The application makes the point that scoreboards with video play back. are not unique and states that "All large universities have them cis well as mostsmall universities and colleges. Many high schools around the co untr)have also installed scoreboards incorporating video playback Recruits, student -athletes, families and coinmunityJans have become accustomed to seeing rej_)Ia))s oj'hnpaqfldpla))s and pictures ofstudent-athletes during an event. Not having this technology) puts SOU at a compelifive disadvantage." The application materials states that the "video scoreboard will onljr be used fbr intercollegiate games, and meets, and University Commencement, notfir advertising of events during non- competition times. Those sI)orls consist of soccer, track andfield and./botbalL The video portion of the board ivill not be usedfir an))practices or scrimmages and ivill not be usedfor any chth practices, games or intramural evenis." The application estimates that the video scoreboard will PAWN -2021-00160 Southei-ji Oregon University/aha Page 2 be used between 15-20 dates per year which is estimated to be 47 hours of use. The application emphasizes that the video screen will not be used to screen movies. The proposed score board also has an integrated sound system consisting of four main aimable speakers and two subwoofers. The system is described as being "more specific in :its broadcast" therefore it will help "ameliorating the issues" of sound traveling into surrounding neighborhoods. Public Comment In accordance with the Land tJsc Ordinance, Notice of Complete Application (NOCA) was mailed to all surrounding properties within 200' of the subject property as well as a physical notice posted along the frontage. No public co.nu-nent received either in favor or against. Approval Criteria The applicant has submitted materials to the Planning Department to demonstrate compliance with the applicable approval criteria for the approval of a CUP and by their reference they are incorporated as if set out in full. Staff would only add that the SO zone allows for all uses as envisioned by the SOU Master Plan, because of this staff feels that when considering the 'no, greater, adverse effect on the impact to the area' when compared to the 'target use of the zone' is met. Staff finds that while there are short sections along the road where the scoreboard will be visible from the ROW however when considering the significant degree that this is off axis — and thus dimmer, and that the use will primarily be during the daytime that the impact on tile ROW will. not be significant. Staff also finds that the impact may actually be less due to the integrated sound system to help eliminate sound traveling into adjacent neighborhoods. The criteria for a Conditional Use Permit are described in AMC Chapter 18.5.4.050, as follows: 1. That the use would be in conformance with, all standards within the zoning district in which the use is proposed to be located, and in conformance with relevant Comprehensive plan policies that are not implemented by any City, State, or Federal law or program. 2. That adequate capacity of City facilities for water, sewer, electricity, urban storm drainage, paved access to and throughout the development, and adequate transportation can and will be provided to the subject property. 3. That the conditional use will have no greater adverse material effect on the livability of the impact area when compared to the development of the subject lot with the target use of the zone, pursuant with subsection 18,5,4,050,A,5, below. When evaluating the effect of the proposed use on the impact area, the following factors of livability of the impact area shall be considered in relation to the target use of the zone. a. Similarity in scale, bulk, and coverage. b. Generation of traffic and effects on surrounding streets. Increases in pedestrian, bicycle, and mass transit use are considered beneficial regard8ess of capacity of fadlities. c. Architectural compatibility with the impact area. d. Air quality, including the generation of dust, odors, or other environmental pollutants, e. Generation of noise, light, and glare, f. The development of adjacent properties as envisioned in the Comprehensive Plan. g. Other factors found to be relevant by the approval authority for review of the proposed use. For the purposes of reviewing conditional use permit applications for conformity with the approval criteria of this subsection, the target uses of each zone are as follows, 1. HC, NIM, and SOU. The permitted uses listed in chapters 18.3.6 Southern Oregon University District, respectively, complying with all ordinance requirements. Staff finds that the application with the attached conditions complies with all applicable City ordinances,. Therefore, Planning Action 2021-00160 is approved with the following conditions. Further, if any one or more of the following conditions are found to, be invalid for any reason whatsoever, then Planning Action 2021-00160 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval. 2) An electric permit and any required structural permits for the installation of the LED screen shall be applied for and approved by the City of Ashland Building Division. The existing scoreboard is approximately 18 years old, well past its useful life, and has become increasingly difficult to repair and keep operational. The proposed new scoreboard has a video replay screen in addition to the typical scoreboard information (score, time, remaining, down and distance, timeouts, etc.). The video replay capability of the new board conflicts with the COA sign ordinance, however, which does not allow for moving signs. Therefore, SOU requests a CUP, to allow for installation of the new scoreboard. Facts about Usage and Design A. The off -axis angle of view (160 degrees), and distance to Walker and' a'V'ightman (400 feet plus), will render the graphics very indistinct and vague to passers-by. B. The area of view along Wightman Street will be approximately 240 feet and approximately 407 feet along Walker Avenue. C. Video, "play" will entail an occasional instant replay, but will otherwise present static pictures of student -athletes, a hawk graphic, sponsor logo, or be blank. D. Total estimated time this scoreboard will be in use: 47 hours during daylight hours, E. The scoreboard's video presentation is for internal! audiences at soccer, football, track and field and Commencement within Raider stadium, not for notification or advertisement external) to that (Le., passers-by on Wightman or Walker). Ill. Challenge with conformance to the existing Sign Ordinance The existing COA sign ordinance allows for installation of the new videoboard provided it is screened from public view along both Walker Avenue and Wightman Street. The current scoreboard is briefly visible from these locations, has an electronic messaging portion, and has been in place for 18 years; there have been no complaints to date. The slightly larger video portion of the new scoreboard may also be seen in these small windows, but at the off -axis angle view of 160 degrees, is very innocuous at that distance. To comply with the existing sign ordinance, SOU has evaluated screening options including: 1) new privacy fencing; 2) adding privacy screens to existing fencing; 3) installing vinyl fence slats; and 4) planting "hedge" type landscaping. We've concluded that 1), 2) and 3) fencing/screening options will not be aesthetically pleasing, block views, and draw negative responses from neighbors. SOU has always strived to maintain an open and inviting campus. Privacy fencing along Wightman and Walker will Page 1 of 5 project an "off-flimits" look that we believe will be worse than infrequent video image scoreboard usage. (Video play will average 47 hours per year during daylight hours. Screening will be permanent). Our Landscape and Sustainability supervisors both have serious reservations, about option 4) installing new plantings to act as screens. Hedge type plantings, by nature, require a lot of water to keep green. With the ongoing drought, SOU is not currently installing new plants that have high water requirements. Our landscape supervisor also recommends against installing understory plants beneath existing mature trees that can act as ladder fuels. Any screen type plantings will also require years to mature. IV. Scoreboards with Video Playback are not unique As the video technology has evolved and costs come down, scoreboards with video playback are common at colleges and universities throughout the country. All large universities have them as well as most small universities and colleges. Many high schools around the country have also installed scoreboards incorporating video playback. Recruits, student -athletes, families and community fans have become accustomed to seeing replays of impactful plays and pictures of student -athletes during an event. Not having this technology puts SOU at a competitive disadvantage. SOU will not present videos nor graphics similar to what one would see at University of Oregon (video fireworks, cartoons, or highlight videos), but instead use it for occasional replays, static pictures of student -athletes, and video close ups of live in-person events like graduating students accepting their diplomas at Commencement. V, The New scoreboard will be similar in size and, appearance to the existing scoreboard The new scoreboard will be approximately the same size as the existing one and similar in appearance and materials. A photograph of the existing board and a rendering of the new board are attached to this application. Specifications for the proposed new scoreboard are also attached. V1. Frequency and duration of use The new video scoreboard will only be used for intercollegiate games and meets, and University Commencement, not for advertising of events during non -competition times. Those sports consist of soccer, track andl field and football. The video portion of the board will not be used for any practices or scrimmages and will not be used for any dub practices, games or intramural events. For the 2021-22 SOU school year, total uses consist of an: estimated 15 to 20 dates. This equates to approximately 47 hours of use. The model we plan to install includes both a video portion and a static scoreboard portion. This allows it to be used as a scoreboard at times without moving graphics, pictures, and videos. Other models that we are not interested in consist of 100% digital scoreboard and video functions. Page, 2 of 5 The video portion of the board will not project constant rolling graphics, (unlike message boards and videoboards you see in large towns, car dealerships, etc.). During play, it will display a still graphic. After a big play it may change to another still graphic showing a student -athlete's picture (to highlight who scored the touchdown or the goal). The board will show the occasional 10 -second replay of a big play, but not constant live video of the game being played (as you see at larger universities). The board will not be used to show movies, VII. Sound andl PA system (does the screen have integrated speakers), The new sound system that accompanies the new scoreboard will be more specific in its broadcast, ameliorating the issues with the old sound system's carry into neighborhoods to the west of the stadium. A new speaker in the same location will replace the speaker that currently sits on top of the old scoreboard. The new speaker is engineered to direct sound to the bleacher areas, the turf and SOU buildings in front of it. That feature did not exist on the old sound system. The new sound system — much like the new video board — will only be used for intercollegiate games and meets not practices, scrimmages, club or intramural events.
