The City and Contractor previously entered into a Personal Services Agreement effective June 14, 2021 (the "Agreement") to Contractor provide final design of wastewater treatment plant outfall relocation; and B. The City and Contractor wish to amend the Agreement to extend the term of the Agreement. AGREEMENT NOW THEREFORE,in consideration of the mutual benefits and obligations set forth herein,the parties agree as follows: 1. Amend Section 3 of the Agreement as follows,with strikeout wording deleted and underscored wording added: 2.1 City shall pay Provider the sum of$398,460 (THREE HUNDRED NINTY-EIGHT THOUSAND FOUR HUNDRED SIXTY DOLLARS) $362,�rvz,400rv0 as provided herein as full compensation for the Work as specified in the SUPPORTING DOCUMENTS. • 2.2 In no event shall Provider's total of all compensation and reimbursement under this Agreement exceed the sum of $398,460 (THREE HUNDRED NINTY-EIGHT • THOUSAND FOUR HUNDRED SIXTY DOLLARS) $362,409.00 without the express, written approval from the City official whose signature appears below, or such official's successor in office. The City's environmental permits have been extended to their limit and to avoid having to re-permit the project,the project needs to be modified to attract more potential bidders and needs to be re-advertised as soon as possible:In order to assist the City in obtaining a bid for the 2022 construction season,the City requested Jacobs to contact contractors to determine why no bids were received,and based on that information and input from the City's team,incorporate modifications to the Project including changes to the Bid Form from 15 Line items following a lump sum approach to 67 line items with a unit price approach,adding accompanying measurement and payment definitions for each bid item,incorporating updates to the prequalification language,incorporating addition of milestone language,incorporation of the 1200-C permit conditions,determination of an appropriate increase in the contract time based on the current materials procurement market,and attendance at the pre-bid meeting for the re-advertisement period. This City also requested Jacobs to make the required changes to the contract documents through an Addendum to incorporate the City procured materials,including design changes in the drawings.
