As noted in the application materials, the property in question was created through a deed recorded with Jackson County in Vol. 16-27 in May of 1888 — prior to August 18, 1964 when the city adopted land use regulations. With this determination, the lot line between Lots 9 and 10 of the Highland Park Tract now divides the property at 168 Meade St. On June 23, 2022, the Department of Community Development, Planning Division reviewed and approved your request for a Property Line Adjustment between the properties created through the Legal Lot Determination above at 168 Meade St. The proposal moves the westernmost 85.6' of the property line separating these properties north 0.6' and the easternmost 89.9' of the property line separating these properties south 5.4' transferring approximately 0.01 acres from proposed Parcel 2 to proposed Parcel 1. The review finds: 1) The proposed property line adjustment does not create any non -conformities with regard to the Land Use Ordinance including lot coverage, setbacks, and lot size. 2) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein. 3) This approval is valid for 18 months, and a final survey shall be submitted within that time period. Property line adjustments do not become final until a final plat is signed by all affected parties, approved and signed by the Community Development Director, and recorded at the Jackson County Assessor's DEPT. Submittal Fee Pg.2 of 5 %A POP ROGUE PLANNING G DEVELOPMENT SERVICES, LLC The residence was constructed in 1994/1995. The property is located within the Siskiyou Hargadine Historic District. There are some significant slopes on the property just behind the curb of Meade Street and adjacent to the alley. The property is within the Physical and Environmental Constraints Overlay for Hillside Development. The average slope of the property is approximately 17 percent, any areas of disturbance that are more than 25 percent slope is subject to the requirements of the Physical and Environmental Constraints Ordinance. Because the lot is within the historic district, it is exempt from the design standards. Zoning Requirements: The parcel is zoned Single Family Residential (R-1-7.5) Solar: The existing residence, and the required dimension of the yard area north of the residence for the required solar setback is dependent upon the height of the structure and the shade producing point. With the actual slope of the property downhill from Meade on the west to the alley adjacent to the east property line, the north wall height of the structure is exaggerated. Whereas the solar slope of the property is 3.9 percent to the north. This requires a substantial setback from any structure on the property to the existing north property line and determines that any future lot or parcel has at least a 73 -foot lot dimension from the north to the south property lines. The solar setback ordinance will be an important consideration in the layout of any future lot division. It is possible to grant solar waivers for existing and even proposed structures, the `affected' property owner to the north must grant deed recorded agreement to the additional shadow area. The city is against solar waivers and will often require deed restrictions on the development lot that limits allowed shadows. Property Potentials Legal Lot of Record: The request is to seek lot legality of Lot 10, and the South 10 -feet of the East 90 feet of Lot 11 in the Highland Park Tracts to the city of Ashland. This portion of the property meets the criteria from the legal lot of record as the property was lawfully created through a subdivision prior to 1964 (AMC 18.1.3.020.B). A. The plot of land was lawfully created through a subdivision or partition plat in Jackson County prior to annexation to the City. .0 1q V ROGUE PLANNING R DEVELOPMENT SERVICES, LLC In the event of a partition, utilities would be required to be "stubbed" out to the new parcel. All partition requests must evaluate vehicular access and often it is required from the alley even though the future parcels would have frontage on Meade Street, Accessory Residential Units/Duplex: In all residential zones, there are accessory dwellings and duplex units allowed. These are allowed as attached or detached. These second dwelling units do not require their own off-street parking as long as there is parking for the primary residence. Accessory Residential Unit and duplexes are subject to the underlying zones setbacks and coverage standards.
