CITY O�F -ASHLANJF April 28, 2022 Notice of Final Decision On April 28, 2022, the Community Development Director approved the request for the following: Planning Action: TREE -2022-00184 Subject Property: 101 A Street Applicant: Jordan Willing/Christopher Brown Description: A request to modify the recent Site Design Review approval at 101 A Street (PA -T1-2021-00164) to allow the removal of four trees which were previously identified to be preserved and protected, These removals are proposed in response to the installation of the fire protection system which requires trenching on the north side of the building. Four new trees are proposed to, mitigate these removals, COMPREHENSIVE PLAN DESIGNATION: Employment; ZONING: E-1; P: 39 1E 09 BAJAX LOT: 14900. The Community Development Director's decision becomes final and is effective on the 1211' day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be net prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winborn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in AWO 18.5.1.050(01). Fffective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to subsection 18.5.1.050.6, a Type I decision becomes effective 12 days after the City mails the notice of decision. F. Reconsideration. The Staff Advisor may reconsider a Type I decision as set forth below. I. Any part), entitled to notice of the planning action, or any City department may request reconsideration of the action after the decision has been made by providing evidence to the Staff Advisor that a factual error Occurred through no fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision. I�econsideratioii requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence during the opportunity to provide public input our the application sufficient to afford the Staff Advisor all Opportunity to, respond to the issue prior to making a decision. 2. Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall decide within three days whether to reconsider tile matter. 3. If the Staff Advisor is satisfied that all error occurred crucial to the decision, the Staff Advisor shall withdraw the decision for purposes of reconsideration. The Staff Advisor shall decide within tell days to affirm, modify, or reverse the original decision. Tile City shall send notice of the reconsideration decision to affirin, modify, or reverse to any party entitled to notice of the planning action. 4. If the Staff Advisor is not satisfied that all error occurred crucial to the decision, the Staff Advisor shall deny the reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration. G. Appeal of Type I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following: I. Who May Appeal. The following persons have standing to appeal a Type I decision, a. The applicant or owner Of the Subject property. b. Any person who is entitled to written notice of theType I decision pursuant to subsection 18,5.1.050.13. c, Any other person who participated in the proceeding by submitting written comments on the application to the City by the specified deadline. 2. Appeal Filing procedure. a. Notice oj'j1ppeal. Any person with standing to appeal, as provided in subsection 18.5.1.050,6.1, above, may appeal aType I decision by filing a notice of appeal and paying the appeal fee according to tile procedures of this subsection. The fee required in this section shall not apply to appeals made by neighborhood or community organizations recognized by the City and whose boundaries include the site. If all appellant prevails at the hearing or upon subsequent appeal, the fee for the initial hearing shall be refunded. b,. Timefib)� Filing. Appeal hearings on Type I decisions made by the Staff Advisor shall be de novo hearings before tile Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation, and specific issues raised in the review leading up to the Type I decision, but May include other relevant evidence and arguments, The Commission may allow additional evidence, testimony, or argument concerning any relevant ordinance provision. 4. Appeal Hearing Procedure. Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures, pursuant to section 18.5.1.060, subsections A — H, except that the decision of the Planning Commission is the filial decision of the City oil all appeal of a Type I decision. A decision on all appeal is final the date the City mails the adopted and signed decision. COMPREHENSIVE PLAN DESIGNATION: Employment; ZONING: E-1; MAP: 39 lE 09 BA, TAX LOT: 14900 SUBMITTAL DATE: March 31, 2022 DEEMED COMPLETE DATE: April 1. 2022 STAFF APPROVAL DATE: April 28, 2022 DEADLINE TO APPEAL (4:30 pan.): May 10, 2022 FINAL DECISION DATE: May 11, 2022 APPROVAL EXPIRATION DATE: November 11, 2023 DECISION This proposal is to remove four trees from the property that is located at 101 A St. This is a modification to an existing Site Design Review (PA -T1-2021-00164) at the same location. The subject property is located on the north side of A St and the cast side of Oak St. The property is zoned E-1 with a Residential Overlay. It is neighbored by E-1 zoning to the north, east, and south, and R-2 zoning to the west. It is within the Historic Railroad District and is named the "Ashland Fruit & Produce Assoc. Building (Oak St Tank & Steel)" in the National Register of Historic Places (ID #149.0). The four trees to be removed are greater than six inches DBI -I and are located on the northeast corner of the property, between the historic building and the railroad tracks. The code is clear that a permit is required for the removal of trees greater than six inches DBH on private lands zoned E-1. These trees were previously identified to be preserved and protected in the plans proposed in the 2021 Site Design Review (PA -T1-2021-00164). Due to the finalization of the fire protection system design, the trees' preservation is no longer possible. Four new trees are proposed to mitigate these removals. In accordance with the Land Use Ordinance, Notice of Complete Application (HOCA) was mailed to all surrounding properties within 200' of the subject property as well as a physical notice posted along the fiontage. No public comment received either in favor or against. At the April 7"' meeting of the Tree Commission the application was reviewed. Staff began by TRP,R-2022-00184 101 A St/jt Page presenting an overview of the application before Ian Ellingson -White from Arkitek presented on the larger project occurring at 101 A St. The project involves a complete remodel of the site in two phases. Ellingson -White discussed the reasoning for locating the fire water connection in the proposed location. The Commission discussed the trees, in question and the appropriate species selection for mitigation plantings. Ellingson -White confirmed that the mitigation trees may be planted above the water line after construction as it is one of the few locations on the property where mitigation plantings could be located, The Tree Con-unission ultimately voted unanimously to approve the application as submitted, agreeing to leave the species selection to the project architect. Staff finds the application has sufficiently demonstrated compliance with all applicable approval criteria. The criteria for a Tree Removal Permit (Not a hazard) are described in AMC Chapter 18.5.7.040.13 as follows: 2, Tree That is Not a Hazard, A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints in part 18.3.10. b. Removal of the tree will not have a significant negative impact on erosion, sell stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in, the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall requ:ire, the applicant to mitigate for the removal of each tree granted approval pursuant to section 18,57,05 0. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action #TREE- 2022- 00184, a request to remove four anon -hazard trees, complies with all applicable city ordinances with the imposition of the conditions attached ,below, Therefore, Planning Action #'I'REE-2022-00184 is approved. If any one or n -tore of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action #TR -EE -2022-00184 is denied.
