The adjacent property to the west is in the ownership of Southern Oregon University and is the location of the U.S. Fish and Wildlife Service (USP'&WS) Forensic Laboratory and the Oregon State National Guard Armory. To the south are the SOU Center for Sustainability and associated farm fields, railroad tracks, athletic fields and SOU Student / Family Housing complexes. The properties across East Main are outside of City limits and are zoned Exclusive Farm Use by Jackson County. Ashland Middle School is across Walker Avenue from the subject site. Science Works, the Forensics Laboratory and the National Guard Armory lease property frons Southern Oregon University. All three buildings are on one 20 -acre parcel, and the Science Works leased area is approximately I I acres in size. The existing Science Works building sits on the eastern -half of the property and is approximately 300 -feet from Fast Main Street and 35 -feet from Walker Avenue. There is an 88 space automobile parking lot with five bus parking spaces connected to Campus Way to the rear (south) of the Science Works building. The site is relatively flat with slopes of approximately 2'/2 percent to the north. There are a number of trees on the site. The majority of the site landscaping consists of native grass and weeds, the parking area at the rear of the building off of Campus Way has shrubs and small trees in the landscape buffers. There is a five-foot curbside sidewalk along Campus Way. Along the East Main Street and Walker Avenue frontages there is a five-foot parkrow with street trees and a five-foot sidewalk. Progosal The application here is a request for Site Design Review approval to allow the installation of two additional StrackeiQ pole -mounted solar trackers within the ScienceWorks Hands -On Museurn parking lot. These PA -TI -2023-00205 Solar Trackers at 1500 Hast Maim StrectAds Page 1 would be located on concrete islands already in place within the parking lot, and would not necessitate the disturbance of existing trees or landscaping. Per the applicant, with the six-inch height of the existing islands within the parking lot, this would place the lowest point of the solar trackers at least 14 feet above the surface of the parking lot. There are six previously -approved solar trackers already in place on the subject property, jest south of the parking lot. The application materials further note that the solar trackers will also provide a platform for a ScienceWorks-owned electric vehicle charging station (SVCS). The application indicates that the proposal will provide consistent solar electric power for the next 25.50 years, with an annual production from the project of over 56 MWln/yr. whichwill decrease the community's carbon footprint by 37 MTons/yr., which is equal to the sequestration of 43 acres of US forest each year. The application assents that the proposal will also provide a strong and irnpactftrl visual conrrnitnient to climate action and energy sustainability by both the University and Science -Works. Site Desian Review Approval AMC 18.5.2.020.A.9 requires Site Design Review approval for the, "Installation of mechanical equipment notfully enclosed in a.structure and not otherivise exempt fr�orrr.site design reWeii,persection 18.5.2.0.20. C." The exemptions referenced apply to: private, tion -commercial radio and television antennas; not more than three parabolic disc antennas, each under one nncter in diameter, on any lot or dwelling unit; roof -mounted solar collection devices under certain circumstances, and other mechanical equipment which is not visible from a public right-of-way. The first approval criterion for Site Design Review is that, "The proposal complies with all ofthe applicable provisions of the underlying zone (Dart 18,2), including hart not litnited to: building and yard setbacks, lot area and dimensions, density and floor area, lot coverage, building height, building orientation, architecture, and other applicable standards." In this instance, the proposal does not involve a typical building and is instead Hinited to pole-mountcd solar trackers to be installed within an existing parking lot. By code, solar installations are considered to be mechanical equipment. Accessory Structures and Mechanical Equipment are specifically address in AMC 18.2.4.020.13, which requires that: "Mechanical equipment shall not be located between the main structure on the site and anystreet adjacent to afrontorside yard, and every attempt shall be made to placesuch equlpmentso thatit is not visible from adjacent public streets. Mechanical equipment and associated enclosures, not taller than allowed fence heights, may be located within required interior side or rear yards, provided such installation and operation is consistent with other provisions of this ordinance or the Ashland Municipal Code, including but not limited to noise attenuation. Any installation of mechanical equipment shall require a building permit." In this instance, the placement is not between the ScienceWorks building and any adjacent street, and the placement -- while visible from nearby rights-of-way -W- has been planned to mitigate visual impacts for the degree possible with distance while maintaining solar access and providing the installation as an example of the technology in keeping with the mission of Science -Works. A condition has been included below to require that the applicant obtain applicable permits and inspections, comply with applicable codes and pay associated fees and charges. The second criterion for Site Design Review approval is that, "Tire proposal cotrrplies with applicable overlay zone requirements (Dart 18.3)," In this instance, the subjectproperty is within the Southern Oregon PA -Ti -2023-00205 Solar Trackers at 1500 past Mair Strcet.dds Page 2 University District and is subject to Chapter 18.3.6, and is not subject to other special districts or overlay zones. The chapter implements the Campus Master Plan Update for Southern Oregon University. The Master Plan recognizes the subject property, on the Mark 0. Hatfield Environmental Sciences Complex, as a satellite district of the campus consisting of the Oregon National Guard Armory, the USIt&WS Forensics Lab and the ScienceWorks Museum. These organizations are noted as leasing land from the University but "otheryi,ise generally acting independently." ScienceWorks' use of the site is permitted outright as it is indicated and located in conformance with the adopted SOU flan and is.greater than 50 feet from privately owned property, and the current request is for the installation of mechanical equipment accessory to that approved use. The third criterion is that, "The proposal complies ivith the applicable Site Development and Design Standards of part 18.4, except as provided by subsection E, beloiv." AMC 18.4.4A30.G.4 specifically requires screening of mechanical equipment "by placement of features at least equal in height to the equipinrenttohin?itvie tivfr�ompublicrights-of ivq)�, exceptalleys, aridcrdjaccrntr'esidentlftllyzoi?edpy,operty." For mechanical equipnncnt that is not roof -mounted, this section calls for screening to "in?chide features such cis a solid ivoodfence, masonr jt wall, or hedge screen." The applicant has requested exception fi•om the screening requirements, noting that they do not believe the standards were written with this type of installation in mind. They suggest that the tracker, while pole -mounted, is more in line with exempted rooftop solar iutbat screening will diminish or eliminate any benefit by block the solar power the tracker is being installed to harvest. The applicant further asserts that the installation is in large part screened by its placement, at a fair distance from the adjacent rights-of-way with existing foliage at the property perimeter providing screening. As noted hiprevious applications for solar tracker installation, ScienceWorks is in the process of transforming itself into an "Outrageous Innovation Center" and seeks to utilize and showcase these cutting-edge, locally -produced, innovative and educational solar trackers. The approval criteria provide for exceptions where, "There is a demonstrable difficulty rnreetin?g the specific regnh-einen?ts of the Site Development and Design? Standards dire to a unique or unusual aspect of circ existing structiwe or the proposed use of a site; and appi-oval of the exception? 3l,ill not substantially ?negatively hnpaet adjacent properties; and approval of the exception is consistent with the staled pinpose of the Site Development and Design; and the exception requested is the miniintun? which --t,ould alleviate the difficulty." 7n staff's assessment, the requested exception is based on the unique aspects of the proposed use, the exception will not substantially negatively impact adjacent properties given the placement and existing vegetation, is consistent with the underlying intent and is the minimum necessary to alleviate the difficulty. The site is a large one, and the placement is well away from public rights-of-way, generally interior to the properties, and perimeter vegetation provides some measure of screening; and the placement will have environmental and educational benefits with little adverse impact. As detailed in AMC 18.4.3.080.D.6, a driveway serving more than seven parking spaces .must be maintained to a minimum 20 -foot width to a height of 13%2 feet. The ScienceWorks parking lot is roughly 88 parking spaces, and the applicant here emphasizes that the trackers will not project over parking or circulation and will in any case maintain a minimum 13% foot clearance. A condition that this be demonstrated in the permit drawings has been included below. The fourth approval criterion is that, "The proposal complies ivith the applicable standards In section? 18.4.6 Public Tacilities and that adequate capacio; of Cite facilities for neater, setiver, electricity; urban storms drainage, paved access to and throughout the property and adequate transportation can and twill be provided to the subject property. " As proposed, the installation does not involve water, sewer, stornn drainage or public street alterations. The application emphasizes that the trackers are to maintain the PA -T]-2023--00205 Solar -Trackers at 1500 Past Main Street.dds Page 3 required vertical clearance over the parking and circulation areas of the site. Electric is to be routed on site from an existing transformer location by boring the wiring under the parking area, and the application emphasizes that Electric Department staff have been consulted in planning the installation. A condition of approval has been included below to require that a final electrical service plan be included with the permit submittals for the review aad approval of the Planning, Building and Electric Departments. Trees & Wetland Within the SOU zoning overlay, tree removal permits are limited to those trees that are deemed to be significant (i.e. a conifer laving a trunk 18 -inches or more in diameter at breast height or a deciduous tree having a trunk 12 -inches of more in diameter at breast height. The application does not propose any tree removal, and site disturbance is limited to the area within the already -paved parking lot where the solar trackers are to be installed and where utilities are to be tunneled. Givers that there are parking lot trees within the existing parking lot, and the area necessary to stage, store materials and complete the installation is not entirely clear relative to these, trees, a condition has been included below to require a tree protection plan addressing areas within 15 feet of the limits of disturbance, and that tree protection within that area be installed, inspected and approved prior to any sitework. The applicant is proposing to tunnel utilities (a.k.a, threctional boring) through the parking lot rather than trenching to avoid the impacts trenching would have on trees, and a condition to that effect has been included below. There is a possible wetland on the neighboring Southern Oregon University property. Based on the application materials, the installation proposed will be limited to the already -paved parking lot and well outside boundary of the wetland's protection zone. Approval Criteria The criteria for Site Design Review approval are described in AMC 18.5.2.050 as follows: A. Underlying ,Zone: The proposal complies with all of the applicable provisions of the underlying zone (part 98.2), including but not limited to: building and yard setbacks, lot area and dimensions, density and floor area, lot coverage, building height, building orientafion, architecture, and other applicable standards. B. Overlay Zones: The proposal complies with applicable overlay zone requirements (part 98.3). C. Site Development and Design Standards: The proposal complies with the applicable Site Development and Design Standards of pail 18.4, except as provided by subsection E, below. 0, City Facilities: The proposal complies with the applicable standards in section 18. d.6 Public Facilities and that adequate capacity of City facilities for water, sewer, electricity, urban storm drainage, paved access to and throughout theproperly and adequate transportation can and will be provided to the subject property. E. Exception to the Site Development and Design Standards. The approval authorily may approve exceptions to the Site Development and Design Standards of part 18.4 if the circumstances in either subsection 9 or Z below, are found to exist. I . There is a demonstrable difficulty meeting the specific requirements of the Site Development and Design Standards due to a unique or unusual aspect of an existing structure or the proposed use of a site; and approval of the exception will not substantially negatively Impact adjacent properties; and approval of Ute exception Is consistent with the stated purpose of the Site Development and Design; and the exception requested is the minimum Midi would alleviate the difficulty.; or 2. There is no demonstrable difficulty in meeting the specific requirements, but granting the exception will result in a design Ihat equally or better achieves the stated purpose of the Site Development and Design Standards. 1'A -T1-2023-00205 Solar Trackers at 1500 East Maid Street.dds Page 4 Conclusion. Decision & Conditions of Ap roval The request for Site Design Review approval to install two additional pole -mounted solar trackers within the ScienceWorks parking lot be found to meet all applicable criteria, In considering the request, the key issues for staff are in assuring that the proposed placement: 1) Does not adversely impact required parking or circulation for approved ruses already in place, including emergency vehicle access; 2) Does not adversely impact parking lot landscaping, existing trees or significant natural features; and 3) Is completed in compliance will all applicable fire/life/safety regulations of the applicable codes. The application materials provide assurances both that the tracker height is above that necessary to allow required clearances and as such not impede parking or circulation, including that for emergency vehicles. The installation will result in limited site disturbance, and the applicant has proposed to bore or tunnel rather than trenching to install electric infrastructure to minimize impacts to trees and the surrounding landscaping. Finally, the applicant has proposed to provide engineered drawings and to maintain liability insurance for the installation. With these points in mind and the conditions included below, staff finds that the request merits approval. In staff's final assessment, the application with the attached conditions complies with all applicable City ordinances, Plarming Action PA -T1-2023-000205 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, their Planning Action PA -T1-2023-00205 is denied. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein, including but not limited to: that the solar trackers shall have a non -reflective black finish; that the solar trackers' operations shall be nearly silent; that the applicant shall provide engineered drawings demonstrating that the installation will meet the rninirnurn design requirements in the current adopted State building codes; that the applicant shall maintain a minimum one million dollar liability insurance policy; and that electric service installation shall be accomplished by boring or tunneling under the parking lot rather than by trenching to avoid impact to the site's trees. 2) That the pole -mounted solar trackers (Strackers®) shall be installed so that they will maintain at least a 13'/2 -foot vertical clearance above the parking lot surface in all modes/positions, l 3 %z -foot vertical clearance is required for a driveway or parking area serving more than seven spaces per AMC 18.4.3.080.D.6. Vehicular circulation, including fire apparatus access, is not to be impeded by the installation. 3) There is to be no construction or construction -related disturbance within the protection zone of the existing wetland on the adjacent Southern Oregon University Center for Sustainability property, 4) That the applicant shall obtain all required building and/or electrical permits and pay all applicable fees and charges prior to the installation, and shall obtain all requisite inspection approvals prior to final project approval. The building peri -nit submittals shall demonstrate compliance with this approval and all applicable codes including but not limited to building, fire and electrical codes prior to issuance. The applicant shall provide a final electric service plan with the building permit submittals for the review and approval of the Planning, Building and Electric Departments, and as proposed by the applicant, permit submittals shall include engineered drawings demonstrating that the installation will meet the minimunn design requirements outlined in the current adopted State PA -11-2023-00205 Solar Trackers at 1500 East Main Slreel.dds Page 5 5) 6) 7) building codes. These engineered drawings will be reviewed and approved by the Building Official prior to any site work, The applicant shall demonstrate that the installation will follow all City of Ashland solar installation requirements, including those for disconnecting devices and metering, That the building permit submittals shall include a tree protection plan detailing protection for those trees within 15 feet of the area of disturbance for the solar tracker installation. Prior to the commencement of any site work including staging or storage of materials, the applicant shall obtain a Tree Verification iiispection to verify that trees to be removed are properly identified, that the limits of site disturbance coincide with those described herein, and that any necessary tree protection fencing has been properly installed according to the approved plans. That the applicant shall consult with the Fire Marshal with regard to General Fuel Modification Area and fuel reduction plan requirements in AMC 18.3.10.100.13 prior to bringing any combustible materials onto the property, and any new landscaping proposed shall comply with applicable standards and planting rcquirements. All site work shall comply with applicable fire season restrictions. The solar tracker is much more in line with the already exempted rooftop solar, in that screening it would diminish or, eliminate any benefit by blocking the solar power it is being installed to harvest. Second, as shown in the attached pictures, the proposed installation will in large -part be screened from the adjacent properties by existing Strackers, trees and foliage. The installation will also be naturally screened from adjacent roadways by the ScienceWorks buildings, trees* and existing Strackers. Third, the proposed system shows a significant better ROI and generation capacity than any available (exempted) rooftop installation. Requiring adherence to a Code that was not written for this type of solar power harvester will place an undue hardship on the museum and Community Solar by preventing the most desirable and most efficient racking platform available". Finally, SOUis in support of this installation as part of planned projects, educational adjuncts and a source of Carbon Credits for the university. * Many of the people familiar with the Trackers liken them to works of art worthy of fall exposure (perhaps as expressions of technology, clean energy, and community development), **As our City has codified its intention to expand renewable power generation, and as distributed renewable power generation adds a measure of resiliency and security to the neighborhood as well as the producer, we suggest an exemption for solar trackers be implemented, similar to those for rooftop panels. Driveway Vertical Clearances (AMC 18.4.3.080.D.6): Driveways, aisles, turn -around areas and ramps shall have a minimurn vertical clearance of 13.5 feet for their entire length and width. Screening of Mechanical Equipment: The application would need to request all Exception to the screening requirements for mechanical equipment in AMC 18.4.4.030.G.,4 which require that mechanical equipment installed at ground level be screened to limit view from public rights-of-way and adjacent residentially -zoned property with a fence, masonry wall or hedge screen and least equal in height to the equipment. The application will need to explain the difficulty in meeting this requirement due to a unique or unusual aspect of an existing structure or the proposed use, that approval will not substantially negatively impact adjacent properties, and approval is the minimum necessary to alleviate the difficulty and consistent with the purpose and intent of the standards. Significant Natural Features: There is a wetland and a regulated creek near the installation proposed at ScienceWorks. The final applications would need to demonstrate that these areas are not proposed to be disturbed by the installation or any associated trenching. Second, as shown in the attached pictures, the proposed installation will in large -part be screened from the adjacent properties by existing Strackers, trees and foliage. The installation will also be naturally screened from adjacent roadways by the Science Works buildings, trees* and existing Strackers. Third, the proposed system shows a significant better ROI and generation capacity than any available (exempted) rooftop installation. Requiring adherence to a Code that was not written for this type of solar power harvester will place an undue, hardship on the museum and Community Solar by preventing the most desirable and most efficient racking platform available".
