Notice of Final Decision
On April 28, 2022, the Cormininity Development Director approved the request for the
following:
Planning Action: PA -TREE -2022-00183
Subject Property: 373 Wightman Street
Applicant: Brittany Hurst and Rainbow Willis
Description: A request to remove six black locust trees in poor condition at the
property located at 373 Wightman St. One of these trees is a large, split -trunk tree. The
remaining trees are estimated to be 18, 14, 15, 12, and 15 inches DBII. The trees have several
broken branches that have done damage to the property at 373 Wightman St. The application
includes a letter from Earth Stewards Tree Care, LLC stating that the trees are hazards with a
high likelihood of failure, and that the tree species is invasive to the state of Oregon.

conditions of approval identified on the attached Findings are required to be rnet prior to project
completion.

available for review at the Ashland Community Development. Department, located at 51
Winbum Way, Copies of file documents can be requested and are charged based on the City of
Ashland copy fee schedule.
Prior to the final decision date, anyone who was mailed this Notice of Final Decision may
request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO)
18.5.1,050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO
18,5.1..050( ). The ALUO sections covering reconsideration and appeal procedures are attached.
The appeal may not be made directly to the Oregon Land Use Board of Appeals,

SECTION 18.5.1.050 Type I Procedure (Administrative Decision with Notice)
E. Effective Date of Decision. Unless the conditions of approval specify otherwise or the decision is appealed pursuant to
subsection. 18,51,050.G, a Type I decision becomes effective 12 days after the City rnaiIs, the notice of decision,
F. Reconsideration, The Staff Advisor may reconsider aType I decision as set forth below.
1. Any party entitled to notice of the planning action, or any City department may request reconsideration of the action
after the decision has been made by providing evidence to the Staff Advisor that a factual error occurred through no
fault of the party asking for reconsideration, which in the opinion of the Staff Advisor, might affect the decision.
Reconsideration requests are limited to factual errors and not the failure of an issue to be raised by letter or evidence
during the opportunity to provide public input on the application sufficient to afford the Staff Advisor an opportunity
to respond to the issue prior to making a decision.
1 Reconsideration requests shall be received within five days of mailing the notice of decision. The Staff Advisor shall
decide within three days whether to reconsider the matter.
1 If the Staff Advisor is satisfied that an error occurred crucial to the decision, the Staff Advisor shall withdraw the
decision for purposes of reconsideration. The Staff Advisor shall decide within ten days to affirm, modify, or reverse
the original decision. The City shall send notice of the reconsideration decision to affirm, modify, or reverse to any
party entitled to notice of the planning action.
4. If the Staff Advisor is not satisfied that an error occurred crucial to the decision, the Staff Advisor shall deny the
reconsideration request. Notice of denial shall be sent to those parties that requested reconsideration.
G. Appeal ofType I Decision. A Type I decision may be appealed to the Planning Commission, pursuant to the following:
I. Who May Appeal. The following persons have standing to appeal aType l decision.
a. The applicant or owner of the sub ' ject property,
b. Any person who is entitled to written notice of theType I decision pursuant to subsection
18.5.1.050.13.
c. Any other person who participated in the proceeding by submitting written comments on the application to the
City by the specified deadline.
2, Appeal Filing Procedure.
a, Notice of Appeal. Any person with standing to appeal, as provided in subsection 18.5.1.050.6.1, above, may
appeal a Type I decision by filing a notice of appeal and paying the appeal fee according to the procedures of this
Subsection. The fee required in this section shall not apply to appeals made by neighborhood or community
organizations recognized by the City and whose boundaries include the site. If an appellant prevails at the hearing
or upon subsequent appeal, the fee for the initial hearing shall be refunded.
b. Tilnefbi- Filing. A notice of appeal shall be filed with the Staff Advisor within 12 days of the date the notice of
decision is mailed.
c. Content ofNotice ol'Appeat The notice of appeal shall be accompanied by the required filing fee and shall contain.
L An identification of the decision being appealed, including the, date of the decision.
ii. A statement demonstrating the person filing the notice of appeal has standing to appeal.
iii. A statement explaining the specific issues being raised oil appeal.
iv. A statement demonstrating that the appeal iSSLICS were raised during the public, comment period,

Jurisdictional defect and will not be heard or considered,
1 Scope of Appeal. Appeal hearings on Type I decisions rnade by the Staff Advisor shall be de novo hearings before the
Planning Commission. The appeal shall not be limited to the application materials, evidence and other documentation,
and specific issues raised in the review leading tip to the Type 1 decision, but may include other relevant evidence and
arguments, The Commission may allow additional evidence, testimony, or argument concerning any relevant
ordinance provision.
4. Appeal Hearing Procedure, Hearings on appeals of Type I decisions follow the Type 11 public hearing procedures,
pursuant to section 18.5.1,060, subsections A — E, except that the decision of the Planning Connn ission is the final
decision of the City on an appeal of a Type I decision. A decision on an appeal is final the date the City mails the
adopted and signed decision. Appeals of Commission decisions must be filed with the State Land Use Board of
Appeals, pursuant to ORS 197,805 - 197.860.

DECISION
This proposal is to remove six trees from the property that is located at 373 Wightman Street.
The property is zoned R-2 and is developed with a single-family home. It is located on the west
side of Wightman St, between Lee St and Iowa St. 373 Wightman St is neighbored to the north,
west, and south by properties zoned R-2 and R-3 that are developed with single and multi -family
housing. Southern Oregon University neighbors this property on the east side of Wightman St.
The property is 0.27 acres. Due to the size of the lot and the maximum density allowed on R-2
land, the standard exemption for single-family homes on lots that can not be further developed
does not apply.
The trees proposed for removal are black locust trees located in the back yard. four of these trees
are located in a cluster on the north side of the property. They measure 14", 15", 12", and 15"
DBH. The remaining two trees are larger black locust trees that are located further south on the
property. One of these trees measures 18" DBH, and the second tree is a large, split -trunk tree.
The two larger trees have a number of broken branches which have done damage to the
applicant's property. The application includes a letter from Earth Stewards, LLC stating that the
trees are in poor condition with included bark failures, canker disease, and other open and
decaying wounds from previous storm damage. Additionally, the black locust tree is listed
among the invasive species list in the state of Oregon. The arborist suggests removal of the trees
to mitigate hazard.
In accordance with the Land Use Ordinance, Notice of Complete Application (HOCA) was

mailed to all surrounding properties within 200' of the subject property as well as a physical
notice posted along the frontage. No public comment was received either in favor or against.
At the April 2022 meeting of the Tree Commission the application was reviewed. Staff briefly
presented the application material. The Tree Commission discussed the health and hazard level
of these specimen. After deliberation, the Tree Commission voted unanimously to approve the
application as submitted with the requirement that three large stature trees be planted as
mitigation, and a suggestion to include native black oak in mitigation plantings.
To be deemed a "hazard tree" the condition or location of the tree must clearly present a public
safety hazard. Or, that there is a foreseeable danger of property damage to an existing structure
or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment,
relocation or pruning. Based on the materials provided by the applicant, it is reasonable to
conclude that the subject trees are indeed posing a hazard to the property and therefore ought to
be removed. Staff finds that the trees, due to their current condition and likelihood of failure,
pose an unacceptable hazard to the property that cannot be reasonably alleviated by means other
than removal and replacement. Staff finds the application has sufficiently demonstrated
compliance with all applicable approval criteria.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.8 as
follows:
9. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds
that the application meets all of the following criteria, or can be made to conform through the
imposition of conditions.
a. The applicant must demonstrate that the condition or location of the tree presents a clear
public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable
danger of property damage to an existing structure or facility, and such hazard or danger
cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of
hazard tree in part 18.5.
b. The City may require the applicant to mitigate for the removal of each hazard tree
pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of
approval of the permit.
Staff finds that Planning Action #TREE -2022-00183, a request to remove six hazard trees,
complies with all applicable city ordinances with the imposition of the conditions attached
below. Therefore, Planning Action #TREE -2022-00183 is approved. if any one or more of the
following conditions are found to be invalid, for any reason whatsoever, then Planning Action
#TREE -2022-00183 is denied. The following are the conditions and they are attached to the
approval:
1. That all proposals of the applicant shall be conditions of approval unless otherwise
specifically modified herein.
2. That three (3) large stature mitigation trees shall be planted on site within one (1) year of
issuance of this decision, with the suggestion to include native black oak in mitigation
plantings.

findings of fact and supported by evidence. List the findings criteria and the evidence that supports it. Include
information necessary to address all issues detailed in the Pre -Application Comment document.
❑ 2 SETS OF SCALED PLANS no larger than 11"x17". Include site plan, building elevations, parking and landscape
details. (Optional —1 additional large set of plans, 2'x3% to use in meetings)

❑ LEED® CERTIFICATION (optional) — Applicant's wishing to receive priority planning action processing shall
provide the following documentation with the application demonstrating the completion of the following steps:

Species: Multiple Black Locust (Robinia pseudoacacia)
Reason for Concern: Hazard trees with a high likelihood of failure.
Condition: Trees are in poor condition with included bark failures, canker disease, and other open and
decaying wounds from previous storm damage. This species of tree is listed among the invasive species
list for our state and the state of California. Suggested removal of trees to mitigate hazard.
