The proposal moves the property line separating these properties 7.5' to the west transferring approximately 731 square feet from tax lot 7800 to tax lot 7700 in section 391E15BD. The review finds: 1) The proposed property line adjustment does not create any non -conformities with regard to the Land Use Ordinance including lot coverage, setbacks, and lot size. 2) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein. 3) This approval is valid for 18 months, and a final survey shall be submitted within that time period. Date 7/ Flora Belle Wallis Date City of Ashland Planning Department 51 Winburn Way Ashland, Oregon 97520 Re: Property Line Adjustment - Findings of Fact & Project Narrative Jessica Bates 11555 Windsor Street & 756 Frances Lane, Ashland Assessors Map No. 391E 15 BD, Tax Lots 7700 & 7800 A Property Line Adjustment (PLA) is being proposed between the subject properties to resolve an issue caused decades ago caused by a right-of-way discrepancy of Frances Lane, whereas an "engineers's street centerline" location mistakenly conflicted with the deeded right-of-way location. The curbs & street improvements for Frances Lane were built per the "engineers" centerline where the west curb line was constructed on the Frances Lane right-of-way line, leaving a significant 13.00 strip between the east curb and the deeded east right-of-way line. When the Frances Lane property was developed, the landowner apparently measured the depth of their lot based on the erroneous "engineer's" right-of-way line, leaving a 7.5 foot wide deed gap between the subject properties along an ancient board fence line. Last year while surveying the Bates property, the deed gap became apparent. Bates had a clear case of adverse possession but the adjacent landowner Wallis' agreed to a proposed PLA to resolve the issue. The two subject property configurations were created in the 1960`s. There are existing residences on both parcels, one taking access on Windsor Street and the other fronting on Frances Lane. Both residences and improvements are within the SO zoning district. Both properties will remain conforming to existing land use designations after the property line adjustment. Attached are copies of the Preliminary Property Line Adjustment Map, application form and fee along with this letter.
