The building is used as an accessory structure to the existing retail store on the property. The City of Ashland Planning Department previously approved the placement of a temporary storage container for accessory use; however, the applicant constructed a wood framed, single story structure without a building permit instead of placing the temporary storage container. This proposal is to remedy any building code deficiencies and for site design review in a commercial zone. COMPREHENSIVE PLAN DESIGNATION: Commercial ZONING: C-1 MAP: 39 1F 15 AB; TAX LOT: 6600 The Community Development Director's decision becomes final and is effective on the 12' day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. The property is located along the south side of Ashland Street, east of Walker Street, near the Ashland Shopping Center. Background On November 10, 2022, the City of Ashland Community Development received a zoning permit (PA -A-0200.00226) from the applicant requesting to place a temporary shipping container on the subject property. Placement of the temporary shipping container was approved by the Planning Department on January 13, 2023. However, instead of placing the temporary shipping container, the applicant constructed a 420 square foot wood framed accessory structure without a building permit. This was discovered through the submission of an electrical permit (ELEC-2023-01085) submitted by the applicant on March 28, 2023. Through this land use action, the Planning Department will review the placement and construction of the new accessory structure and require that the applicant obtain a building permit and correct any building code deficiencies, as required. A building permit (BD -NR -2023-00242) was submitted on July 31, 2023 and is under review. PA -T1-2023-00213 1618 Ashland Stljnc Page i The property and surrounding lots are zoned Commercial (C-1). The subject property is rectangular, with 90 feet of frontage along Ashland Street and a depth of 100 feet. Per Jackson County assessment records, the 0.21 acre property is currently developed with a 2,600 square foot commercial building that was previously a painting and decorating retail store. The building is currently a retail store in good condition. The new 420 square foot accessory structure is proposed to support the existing retail store, by providing storage and working space. The property is located in the Detail Site Review, Transit Triangle, and Wildfire overlays. Per Ashland Municipal Code (AMC), the proposal complies with all applicable provisions of the underlying zone in Chapter 18.2 and the Transit Triangle overlay in Chapter 18.3. New structures are an allowed use in the C-1 zone subject to Site Design Review per AMC Chapter 18.5.2.020. In addition, the property would be reviewed under the Ashland Boulevard Corridor Standards; however, given that the project is not of a scale to require street frontage improvements, the Ashland Boulevard Corridor Standards do not apply. Per review of aerial images of the subject property, sometime between June 21, 2022, and June 15, 2023, the lone parking lot tree and associated planter were removed from the parking lot without Site Design Review approval. This resulted in an additional parking space. Per Chapter 18.5.2.020 any changes to commercial business parking spaces requires Site Design Review. See Figures 1 and 2 for reference. PA -T1-2023-00213 1618 Ashland StJjnc Page 2 Site Design Review As noted in AMC 18.5.2.020.A., any addition in the C-1 zone requires Site Design Review approval and is subject to review under the approval criteria in AMC 18.5.2.050 and applicable Site Development and Design Standards under part 18.4. The Land Use Ordinance regulates the placement, orientation, and designs of buildings per AMC Chapter 18.4.2. The development is currently considered to be non -conforming with regard to site and parking lot landscaping, frontage improvements and floor area ratio. Per Chapter 18.4.2.040.B.6, expansions of non- conforming developments require that when an existing nonconforming development is expanded then an equal percentage of the site must be made to comply with the Site Design Review Standards as the percentage of building expansion. In this case, the new structure of 420 square feet is adding to the existing 2,600 square feet of building and 1,000 square feet of plaza area which results in about 44% of developed area. The new structure adds about 5% increase in development. The purpose of Site Design Review is to ensure that the proposed improvements meet the standards of the code. Improvements to the streetscape and/or landscape could be proposed to bring the nonconformity proportionally into conformance with standards and to correct the removal of the parking lot tree and planter in the parking lot. The following paragraphs provide details of these improvements as conditioned: Per AMC 18.4.2.040.B.2, streetscape improvements require that one tree chosen fiom the street tree list (see attached) shall be placed for each 30 feet of frontage. The property has 90 feet of frontage; therefore, three street trees would be required under Basic Site Review standards. However, due to the lack of existing park row and the location and size of the proposed structure, staff have not required frontage improvements. Instead, as a condition of approval one parking lot tree shall be planted to replace the recently removed parking lot tree and planter to bring the site back into conformance with AMC 18.4.4.030.F, which requires at least one parking lot tree per seven parking spaces. The purpose of replanting a tree shall be to provide shade for the parking lot. The tree may be replaced in the same location or in a new location. The applicant must submit a landscape and/or tree replacement and maintenance plan to be approved by the Planning Department prior to the issuance of building permit Certificate of Occupancy. Note that flammable vegetation/trees shall be avoided per the Wildfire overlay. (See the Recommended Street Tree Guide which speaks to proper tree planting and the selection of appropriate parking lot trees, and the Prohibited Flammable Plant List in Resolution #2018-28). In a previous Site Design Review for this property (PA #2007-00961), two covered bicycle parking spaces were proposed to be added to the proposal to satisfy the Site Review Standards but were never installed. A condition has been added to require the installation of two bicycle parking spaces. Note that inverted u -rack bike stands must be installed as part of this condition and may be purchased through the City of Ashland Public Works Department. AMC Chapter 18.4.2.040.0 states that developments shall have a minimum Floor Area Ratio (FAR) of 0.50. FAR is the total square footage of the buildings, plazas, and pedestrian areas divided by the lot area. The subject property is approximately 9,148 square feet so the FAR PA -TI -2023-002I3 1618 Ashland St/jnc Page 3 requirement would be 4,574 square feet of building area. The existing development of approximately 2,600 square feet and 1,000 square feet of plaza area does not meet the FAR requirement and thus is considered a nonconforming development. The new accessory structure of 420 square feet does not render the development fully conforming but does bring the development closer to conformance. The new accessory structure meets the intent of the AMC Detailed Site Review Standards in Chapter 18.4.2.040.C.e as the structure was placed in the existing paved area directly behind the main building and parking lot and is not visible from the public right -of way. None of the other standards in Chapter 18.4.2.040.0 apply to this project. Public Comment In accordance with the Land Use Ordinance public notice was mailed to all surrounding properties within 200' of the subject property as well as a physical notice posted along the frontage. During the public comment period no letters were received either in favor or against. Burden of Proof The applicant has submitted materials to the Planning Department to demonstrate compliance with the applicable approval standards for the approvals requested and by their reference are incorporated as if set out in full. The criteria for Site Review approval are described in AMC Chapter 18.5.2.050 as follows: An application for Site Design Review shall be approved if the proposal meets the criteria in subsections A, E3, C, and D below. The approval authority may, in approving the application, impose conditions of approval, consistent with the applicable criteria. A. Underlying Zone. The proposal complies with all of the applicable provisions of the underlying zone (part 18.2), including but not limited to: building and yard setbacks, lot area and dimensions, density and floor area, lot coverage, building height, building orientation, architecture, and other applicable standards. B. Overlay Zones. The proposal complies with applicable overlay zone requirements (part 18.3). C. Site Development and Design Standards. The proposal complies with the applicable Site Development and Design Standards of part 18.4, except as provided by subsection E, below. D. City facilities. The proposal complies with the applicable standards in section 18.4.6 Public Facilities, and that adequate capacity of City facilities for water, sewer, electricity, urban storm drainage, paved access to and throughout the property, and adequate transportation can and will be provided to the subject property. E. Exception to the Site Development and Design Standards. The approval authority may approve exceptions to the Site Development and Design Standards of part 18.4 if the circumstances in either subsection 1, 2, or 3, below, are found to exist. 1. There is a demonstrable difficulty meeting the specific requirements of the Site Development and Design Standards due to a unique or unusual aspect of an existing structure or the proposed use of a site; and approval of the exception will not substantially negatively impact adjacent properties; and approval of the exception is consistent with the stated purpose of the Site Development and Design; and the exception requested is the PA -T1-2023-00213 1618 Asb1and Stljne Page 4 minimum which would alleviate the difficulty; or 2. There is no demonstrable difficulty in meeting the specific requirements, but granting the exception will result in a design that equally or better achieves the stated purpose of the Site Development and Design Standards; or 3. There is no demonstrable difficulty in meeting the specific requirements for a cottage housing development, but granting the exception will result in a design that equally or better achieves the stated purpose of section 18.2.3.090. Conclusion In staff s assessment, the application with the attached conditions complies with applicable ordinances and meets all required criteria. Planning Action #TI -2023-00213 is approved with the following conditions. Further, if any one or more of the following conditions are found to be invalid for any reason whatsoever, then Planning Action #TI -2023-00213 is denied.. The following are the conditions and they are attached to the approval: 1) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein. 2) That any changes to the exterior of the buildings, additions, or new structures, or changes to the site layout and landscaping shall require a Site Review approval. 3) That the plans submitted for the building permit shall be in substantial conformance with those approved as part of this application. If the plans submitted for the building permit are not in substantial conformance with those approved as part of this application, an application to modify this Site Review approval shall be submitted and approved prior to issuance of a building permit. 4) That exterior building materials and paint colors shall be compatible with the surrounding area, and sample exterior building colors shall be provided with the building permit submittals for review and approval of the Staff Advisor. Very bright or neon paint colors shall not be used in accordance with II -B -6a) of the Multi -Family Site Design and Use Standards 5) That the application shall provide an updated site plan showing the area for the required two bicycle spaces. The bicycle parking shall be located onsite within 50 feet of a well - used entrance and not farther from the entrance than the closest motor vehicle parking space. 6) That the inverted a -racks shall be used for the bicycle parking. All bicycle parking shall be installed in accordance with design and rack standards in 18.4.3.070.1 and J prior to the issuance of the certificate of occupancy. The building permit submittals shall verify that the bicycle parking spacing and coverage requirements are net in accordance with 18.4.3.070.1 7) That the applicant shall plant a replacement tree and provide an updated site plan showing landscaping and irrigation plans for the required tree.
