CIT ASF-ILAND April 7, 2023 Notice of Final Decision On April 6, 2023, the Community Development Director approved the request for the following: Planning Action: PA -TREE -2023-00203 Subject Property: 240.246 Grant St. Applicant: Hillview Condominium HOA Description: A request for removal of two Raywood ash trees, each approximately 25 feet tall with 20 -foot canopies. The application materials show that the locations of the two trees are too close to the multifamily residence and are causing damage to the concrete walkways and structure foundation. COMPREHENSIVE PLAN DESIGNATION: Multi Family Residential; ZONING: R-2 ASSESSOR'S MAP & TAX LOTS: 39 1E 05 AC Tax Lot #90000 The Community Development Director's decision becomes final and is effective on the 12th day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). The subject property is on the south side of Grant Street, and to the west of North Main Street. The property is 0.03 acres in size, zoned R-2, and developed with a multifamily quadplex. Because it is a multi -family development a tree removal permit is required. The two trees proposed for removal are: 1). Raywood ash (Fraxinus oxycarpa) approximately 25 feet tall and 10.5 -inch DBH with a canopy spread of approximately 20 feet. The tree is leaning 18 degrees away from the structure. There are numerous cracks and lifting or shifting in the surrounding walkway. 2). Raywood ash (Fraxinus oxycarpa) about 25 feet tall and 10 -inch DBH with a canopy spread of approximately 20 feet. One-sided pruning of the tree has resulted in the tree being heavy on the opposite side. In addition to visible surface roots on both sides of the walkway, there are numerous cracks and lifting of the walkway. The application includes an arborist report indicating that the two trees are still growing and have already caused damage to the walkways and are likely to cause future damage to the residential foundation. Removal of both trees is recommended to prevent greater damage to the primary dwellings. In accordance with the Land Use Ordinance, Notice of Complete Application (NOCA) was mailed to all surrounding properties within 200' of the subject property as well as a physical notice posted along the frontage. No public comment received either in favor or against. The application was reviewed during the Tree Management Advisory Committee (MAC) March TREE -2023-00203 240-246 Grant St. Page I meeting. Staff presented the application and provided an overview for the reason to request the removal. The Tree MAC determined that the trees are inappropriate species for the location and the potential risks associated with these trees consisted of a hazard to the multifamily structure. The Tree MAC voted unanimously to approve the application as submitted. To be deemed a "hazard tree" the condition or location of the tree must clearly present a public safety hazard. Or, that there is a foreseeable danger of property damage to an existing structure or facility, and, that such hazard or danger cannot reasonably be alleviated by treatment, relocation or pruning. Based on the materials provided by the applicant and a site visit by staff, it is reasonable to conclude that the subject trees are damaging the walkways and threatening to cause damage to the foundation of the building and therefore should be removed. Staff finds that the trees, due to their species, location and size, cause an unacceptable hazard to the property that cannot be reasonably alleviated by means other than removal and replacement. Staff finds the application has sufficiently demonstrated compliance with all applicable approval criteria. The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.6 as follows: 9. Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria or can be made to conform through the imposition of conditions. a. The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure persons or property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated by treatment, relocation, or pruning. See definition of hazard tree in part 18.6. b. The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action #TREE -2023-00203, a request to remove two hazard trees, complies with all applicable city ordinances with the imposition of the conditions attached below. Therefore, Planning Action #TREE -2023-00203 is approved. if any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action #TREE -2 02 3 - 00203 is denied. The following are conditions that are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. That a suitable mitigation tree be planted on the site at an appropriate location within twelve months of this approval. This tree was observed to have an estimated lean of 18° away from the structure. This imbalance amplified by pruning for building clearance will result in stimulated root growth towards the primary dwellings foundation in order to resist uprooting. There are numerous cracks and shifting/lifting of the surrounding walkways. The damage to the walkways is likely a precursor to future foundation damage. Tree #2: Raywood Ash (Fraxinus axycarpa) est 25' tall with a DBH of 10.0" and canopy spread of 20'. This tree was observed to be in close proximity to the primary dwellings. The majority of branches and foliage on the building side of the tree have been pruned off resulting in the tree being heavy in the other direction. There are numerous cracks and shifting/lifting of the surrounding walkways with surface roots visible on both sides of the walkway. The damage to the walkways is likely a precursor to future foundation damage. One of the main tops is broken likely due to wind or storm damage. The raywood ash tree is a commonly observed tree in the southern Oregon area. While I have on numerous occasions recommended planting of this species. I would never have recommended planting them in this location. These trees are still in their juvenile years and are already outgrowing their location. With a predicted average height of 40'+ (1 have personally seen some in the 80'-90' height range, with 4'-5' DBH trunks) the damages will only increase if allowed to continue growing. My recommendation would to be to remove these trees before they cause more damage to the primary dwellings. Trees should be replaced with a variety that will not outgrow the location like; dogwood, star magnolia, crape myrtle, dwarf trees, etc. 'Regards, ZACHARY G.
