The review finds: 1) The proposed property line adjustment does not create any non -conformities with regard to the Land Use Ordinance including lot coverage, setbacks, and lot size. 2) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein. 3) This approval is valid for 18 months, and a final survey shall be submitted within that time period. The properties are legal parcels of record that are part of a 1984s commercial property minor land partition that consolidated seven (7) previous tax lots into six (6) lots (Survey# 10103). Existing Parcel 1 is approximately 13.34 acres in area and contains the Ashland Hills Inn and the Suites Building which is becoming long term residential instead of hotel room lodging. The Ashland Hills Inn hotel structures, site improvements such as pool, tennis court, pathways, and parking area encompass approximately 7.7 acres of coverage. Existing Parcel 5 is .548 acres and is to the north of Parcel 1. This lot has a 40 -foot -wide access easement serving the adjacent Parcels 3 and 4 of Survey 10103. This parcel abuts East Main Street, and the majority of the lot is more than 25 percent slopes. The proposed property line adjustment enlarges Parcel #5 by 3.54 acres and encompasses the lower potion of Parcel #1 that is east of Knoll Crest and is largely vacant except the small compactor building and a portion of the pavement area of the east parking area and Knoll Crest Drive. The coverage of this Parcel is approximately 2.6 acres of the 4.09 acres proposed Parcel area. The resulting coverage of the reduced area of Parcel #1 is reduced by nearly two acres (1.9 acres) of the 9.86 -acre site. Both parcels comply with the allowed 85 percent coverage in the Commercial zone. Findings of fact addressing the criteria for a property line adjustment are provided on the following pages. The criteria from the Ashland Municipal Code, Land Use Ordinance are provided in Calibri font and the applicants findings in Times New Roman. Property Line Adjustment 2525 Ashland Street/ 30 Knoll Crest May 12, 2023 Page 2 of 4 Findings of Fact Ashland Municipal Code: 18.1.3.020 Criteria for approval: A lot of record is a plot of land that meets one or more of the following criteria, pursuant to ORS 92.010 to 92.190: A. The plot of land was lawfully created through a subdivision or partition plat in Jackson County prior to annexation to the City. Finding: Not applicable. B. The plot of land was created through a deed or land sales contract recorded with Jackson County prior to August 18, 1964 before the City adopted planning, zoning, subdivision or partition regulations (Ordinance 1361). Finding: Not applicable. C. The plot of land was created through a deed or land sales contract recorded with Jackson County prior to January 1, 2007 and the subject plot of land would have complied with the applicable planning, zoning, subdivision, or partition regulations in effect at the time it was created. Finding: The plot of land was partitioned via a property line adjustment and the Parcels were recorded in 1984 in their current configuration which complies with the applicable planning, zoning, and partition regulations in effect at the time. 18.5.3.120 Property Line Adjustments Criteria for Approval B. 1. Parcel Creation. No additional parcel or lot is created by the lot line adjustment. Finding: No additional parcel or lot is created with the property line adjustment. Except as allowed for nonconforming lots, pursuant to chapter 18.1.4, or as required by an overlay zone in part 18.3, all lots and parcels conform to the lot standards of the applicable zoning district, including lot area, dimensions, setbacks, and coverage, per part 18.2. If a lot does not conform to the lots standards of the applicable zoning district, it shall not be made less conforming by the property line adjustment. As applicable, all lots and parcels shall identify a buildable area free of building restrictions for physical constraints (i.e., flood plain, greater than 35 percent slope, water resource protection zones). Finding: The parcels conform to the lot standards of the applicable zoning district. There is no minimum lot area, dimensions, or setbacks in the commercial zoning district that are impacted by the property line adjustment. The proposed coverage areas of the parcels have less coverage than allowed in the zone. The current area of Parcel 5 has slopes identified that exceed 25 percent slopes. The proposed property line adjustment encompasses the less steep areas of Parcel 1 into Parcel 5 to create a developable tract. The coverage of the reduced area of Parcel #1 is approximately 5.1 acres of the 9.86 -acre site. The coverage of Parcel #5 is approximately 2.6 acres of the 4.09 acres proposed Parcel area. The standard in the zone is 85 percent and both parcels are substantially below the maximum coverage allowed. 3. Access Standards. All lots and parcels conform to the standards in section 18.4.3.080 Vehicle Area Design. Lots and parcels that do not conform to the access standards shall not be made less conforming by the property line adjustment. Finding: The property line adjustment will not cause any of the resulting parcels to become non -conforming with the access standards. The proposed property line adjustment does not modify any access standards and no lot becomes less conforming.
