The ballot title has been prepared by the city Attorney and approved by the Ashland city Council calling a special election on November 8, 1994 in the city of Ashland and is as follows: CAPTION: QUESTION: EXPLANATION: STATE ETHICS CODE TO REPLACE CHARTER PROVISION CONCERNING INTERESTS CONFLICTS Shall State Code of Ethics for public officials replace City Charter provision prohibiting interest in city contracts by elected officials? The State of Oregon has imposed by law a Code of Ethics on all elected officials. This Code of Ethics prohibits all public officials from action which will result in financial gain for themselves or members of their household. Penalties for violation of the Code of Ethics are set forth in state law. The Ashland Charter prohibits elected officials from having an interest in city contracts. No penalty is set forth in the charter for a violation of this provision. A "Yes" vote replaces the charter provision with the State Code of Ethics. Any elector dissatisfied with the ballot title, may petition the Circuit Court seeking a different title and stating the reasons the title filed is insufficient, not concise or unfair. Petition must be filed not later than the seventh business day after the title was filed with the City elections officer. (ORS 250.296) Must be filed by 5:00 P.M., September 15, 1994. Nan E. STATE ETHICS CODE TO REPLACE INTERESTS CONFLICTS. CHARTER PROVISION CONCERNING EXPLANATORY STATEMENT This measure amends the Ashland City Charter by replacing Article I!1, Section 6 with the State of Oregon Code of Ethics. Article III, Section 6 now provides: 'Interest in City Contracts. During the term of his/her office, no elective officer shall have interest in any contract with the city.' No definitions are provided in the charter for this section and the words "contract" and "interest" are subject to numerous and conflicting interpretations. No penalty is provided in the charter for violation of this section. A court would have to determine if the remedy for the violation is forfeiture of the elected official's office, cancellation of the contract or some other remedy. This provision has been in the charter since at least 1917. The Oregon State Code of Ethics is a law imposed on all elected officials in the state since 1977. The Code of Ethics is set forth in Oregon Revised Statutes 244.040. This code prohibits elected officials from using. their official positions for financial gain; from soliciting or receiving gifts from persons who may be interested in influencing the officials' votes or decisions; from soliciting or receiving pledges or promises of future employment if the officials' actions or judgments would be influenced thereby; and from furthering their personal gain through the use of confidential information obtained in the course of their official activities.
