The review finds: 1) The proposed property line adjustment does not create any non - conformities with regard to the Land Use Ordinance including lot coverage, setbacks, parking and lot size. 2) That all proposals of the applicant shall be conditions of approval unless otherwise modified herein. 3) This approval is valid for 18 months from the date of this letter, and a final survey plat shall be submitted within that time period. Property line adjustments do not become final until a final plat is signed by all affected parties, approved and signed by the Community Development Director, and recorded at the Jackson County Assessor's office. BACKGROUND INFORMATION As shown on the accompanying Site Plan, the subject properties are located at 2210 and 2268 Ashland Street (being commonly known as Jackson County Assessor's Map Number 39 IE 14AB, Tax Lots 1800 (Tract 1) and 1500 (Tract 2), respectively). The land consists of a total of 5.09 acres (2.47 acres within Tax Lot 1800 and 2.62 acres within Tax Lot 1500) and is located in the Commercial (C-1) zoning district, and within the Ashland Street Corridor. Both properties are vested under the same ownership. The proposed remaining portion of Tract 1 contains improvements related to commercial uses for a vehicle service shop known as Oil Stop, and the area proposed to be adjusted for inclusion in Tract 2 is currently underdeveloped vacant land. Tract 2 contains improvements related to commercial uses for a grocery shopping center known as Shop'n Kart. B. SCOPE, PURPOSE, AND OVERVIEW OF THE PROPOSED APPLICATION The intended purpose of the proposed application is to adjust the property line common to said tax lots by reconfiguring the boundary of Tract 1 to be specific to the existing commercial use, while increasing the size of Tract 2 to maximize potential future expansion of commercial uses. Other than the property line adjustment, there is no other development being proposed at this time and existing infrastructure will not be impacted by the proposed adjustment. The proposed adjustment will not create a new parcel; two legal tracts exist prior to and after the adjustment. The proposed adjustment will not conflict with legally established easements or access within or adjacent to the subject properties. This pre -application conference is intended to ensure that the Applicant is able to adequately address all applicable elements of the Comprehensive Plan, as well as verify whether the proposed adjustment qualifies for any consolidated review procedures related to the required Partition Plat process. C. ADDITIONAL INFORMATION RELATIVE TO THE SITE PLAN Based on our preliminary boundary survey of both properties, we found Tract 1 to be approximately 2.47 acres in size and Tract 2 to be approximately 2.62 acres in size. Subsequent to the proposed property line adjustment, Tract 1 will be approximately 0.43 acres in size and Tract 2 will be approximately 4.65 acres in size. Improvements related to Tract 1: As shown on the Site Plan depicting site improvements and accompanying aerial photo, the improved area contains a single one-story stucco commercial structure and paved improvements containing five (5) standard parking spaces and one (1) handicapped parking space, with a small landscaping buffer between parking and the vehicular egress area. The remainder of Tract 1 (and entirety of area proposed for adjustment into Tract 2) is vacant land. The paved 2 -lane access provides ingress and egress for the existing Oil Stop facility, as well as egress for the adjacent Shermin-Williams commercial business (circulation for this area is shown on the Site Plan). Circulation is designed to provide two interior lanes for vehicles to enter one of two bays for service, with a single lane providing egress as described above. Improvements related to Tract 2: Improved area contains a single one-story commercial structure shared between Tax Lot 1500 and Tax Lot 1300, constructed of masonry block and containing a total of 57,820 square feet. The improved area provides ingress and egress for both the existing Shop'n Kart and Bi -Mart shopping stores. Circulation is designed to provide an interior lame for vehicles going both directions to circulate through the series of parking areas and along frontage of the stores, as well as along the back of both stores for product delivery and emergency services. Tract 2 (and its respective commercial grocery store use) contains seventy-six (76) standard parking spaces and three (3) handicapped parking spaces, as well as four (4) speed bumps and eight (8) small, landscaped buffer areas at the ends of each series of parking areas.
