ORDINANCE NO.3246
AN ORDINANCE ANNEXING PROPERTY AND WITHDRAWING AN ANNEXED
AREA FROM JACKSON COUNTY FIRE DISTRICT NO.5
(East Main Park — Planning Action #PA-T3-2024-00009)
WHEREAS, the owners of the property described in the attached Exhibit "A" have consented to
the annexation of this property into the City of Ashland. There are no electors residing in the
tract to be annexed; and
WHEREAS, The subject property is identified on the adopted 2024 Parks Tails and Open Space
neap as a park and has been in the design process with the Ashland Parks Conunission for several
years. The project received final approval fronn the Park Commission on November 08, 2023; and
WHEREAS, The Planning Commission, following proper public notice, held a public hearing
on July 9, 2024, on the questions of annexation and site design review approval. The Planning
Commission reconvened on August 13, 2024, and adopted findings addressing each of the
approval criteria; and
WHEREAS, pursuant to ORS 222.120 and ORS 222.524 a public bearing was held oil
September 17, 2024, on the questions of annexation and withdrawal of the property from Jackson
County Fire District No. 5.
THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are ftilly incorporated herein by this
reference.
SECTION 2. The land described in the attached Exhibit "A" and depicted in Exhibit "B" is
declared to be annexed to the City of Ashland.
SECTION 3. The land described in the attached Exhibit "A" and depicted in Exhibit "B" is
declared to be withdrawIn from Jackson County Fire District No 5, pursuant to the provisions of
ORS 222.111.
SECTION 4. Severability. Each section of this ordinance, and any part thereof, is severable,
and if any part of this ordinance is held invalid by a court of competent jurisdiction, the
remainder of this ordinance shall remain in fiill force and effect.
SECTION 5. CodiDcationn. Provisions of this Ordinance shall be incorporated in the City Code
and the word "ordinance" may be changed to "code", "article", "section", "chapter" or another
word, and the sections of this Ordinance may be renumbered, or re -lettered, provided however
that any Whereas clauses and boilerplate provisions (i.e. Sections 3-5) need not be codified and
the City Recorder is authorized to correct any cross-references and any typographical errors.

An Annexation of that tract of land described within Document No, 2018.037280, along
with the south one acre of that tract described within Document No. 2018-025387 of the
Official Records In Jackson County, Oregon, as welt as a 701.78 foot long and 60.00 fool
wide portion of East Main Street, lying situate within the Southwest Quarter of Section
11, Township 39 South, Range 1 East of the Willamette Meridian in the City of Ashland,
Jackson County, Oregon, being more particularly described and bounded as follows;
BEGINNING at an iron pin at the northeast comer of Bud's Dairy, a Planned Community
in the City of Ashland, Oregon, purportedly as also being the Southeast Corner of the
Northeast Quarter of the Northwest Quarter of the Southwest Quarter of Section 11 in
Township 39 South, Range I East of the Willamette Meridian in Jackson County,
Oregon.; thence North 00°06140" West, along the East line of said Northeast Quarter of
the Northwest Quarter of the Southwest Quarter, common with the west line of
Chautauqua Trace, Phase 3, a Planned Community in said City, a distance of 315.73 feet,
to arr iron pin along the east line of that tract of land described within Document No.
2018-025387 of the Official Records in said County; thenee North 89056'20" West,
