CITY 01= H IN May 23, 2024 Notice of Final Decision On May 23, 2024, the Community Development Director approved the request for the following: Planning Action: PA -TREE -2024-00230 Subject Property: 677 Oak Street Applicant: Derek Sherrell / Canopy LLC Description: A request for approval to remove three (3) regulated trees from the property located at 677 Oak Street. The trees to be removed are located within the footprint of the proposed residences of the partitioned lots. Trees range in size from 8 inches to 24 inches DBH. One additional un -regulated tree is also proposed to be removed. COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-1-5; MAP: 39 1E 04 CA; TAX LOT: 2000 The Community Development Director's decision becomes final and is effective on the 12' day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). COMPREHENSIVE PLAN DESIGNATION: Single Family Residential; ZONING: R-1-5; MAP: 39 lE 04 CA; TAX LOT: 2000 SUBMITTAL DATE: May 2, 2024 DEEMED COMPLETE DATE: May 6, 2024 STAFF APPROVAL DATE: May 23, 2024 DEADLINE TO APPEAL (4:30 p.m.): June 4, 2024 FINAL DECISION DATE: June 5, 2024 APPROVAL EXPIRATION DATE: December 5, 2025 DECISION The application requests a Tree Removal Permit to remove 2 Oaks and 1 fruitless Mulberry from the property at 677 Oak Street. The lot and surrounding area are zoned R-1-5. Because the trees are larger than 6" DBH, not hazardous, dead or dying, and are being removed to accommodate for development, tree removal is regulated and is processed as a Type 1 permit. The application and conversations with the applicant state that the placement of the proposed dwelling unit is to accommodate 2 units on the parcel after it is partitioned. The partition has been approved by the city (PA -T1-2024-00222) and is in the final plat/mylars stage. Once the lot is partitioned, state law requires that two residential units be permitted per lot. Due to the location of the proposed footprints of the two residential units for minimal impact, tree removals are necessary. The dwelling unit cannot be accommodated in its proposed location without removal of the tree, minimizing impact on all other trees in the vicinity, which are intended to remain. This is discussed in more detail during the TMAC May meeting, outlined below. Staff received no input from the public during the public comment period. At the May regular meeting of the Tree Management Advisory Committee (TMAC) staff presented the application. TMAC member Christpher John recused himself from discussion as his company, Canopy LLC, was the arborist of record for the application. There was discussion between the arborist, remaining committee members, and the applicant regarding the application. Committee members expressed concern over removing the large multi -stemmed Oak tree unnecessarily and inquired about the possibilities of shifting the building envelope to accommodate protecting the tree. The arborist stated that the tree would probably receive harm TREE -2024-00230 677 Oak Street 1 VA Page 1 over about 30-40% of its root system and already has significant dieback. The applicant stated that even if the building envelope were to be shifted to accommodate the tree, insurance would not be able to cover the house due to the tree being located within 10 feet of the roof structure. Additionally, the applicant and the arborist indicated that even if the structure was shifted over enough to meet minimum separation requirements between buildings, the tree would still be within the 10' of the structure that insurance would not cover, and the tree may still receive damage to its roots system. Following the discussion, committee members had the following thoughts: TMAC Parks liaison and Parks Department arborist Peter Baughman said that he did not believe that development of the property was feasible without removal of the tree. TMAC members Gould and Cates discussed whether development could move forward trying to protect the tree and remove it only if absolutely necessary and plant a mitigation tree if removed. It was noted that of the four trees proposed for removal, only three are regulated trees and as such the unregulated tree does not require permit approval. For the remaining three regulated trees, the Tree Management Advisory Committee voted unanimously to recommend approval. The criteria for a Tree Removal Permit (Not a hazard) are described in AMC Chapter 18.5.7.040.13 as follows: 2. Tree That is Not a Hazard. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints in part 18.3.10. b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff finds that Planning Action #TREE -2024-00230, a request to remove three trees that are not hazards in order to accommodate the development of the site as envisioned by its zoning, complies with all applicable city ordinances with the imposition of the conditions attached below. Therefore, Planning Action #TREE -2024-00230 is approved. The following are the conditions, and they are attached to the approval: 1. That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2. A mitigation plan shall be provided prior to the removal, and the plan shall be implemented, inspected and approved within one year of the tree removals. The following statements support recommendations for removal in relation to the proposed building plan. The relevant trees are listed below, as well as on the attached tree inventory spreadsheet: • Tree #1537: California black oak, Quercus kelloggii, 24" DBH, moderate to poor health • Tree #1547: California black oak, Quercus kelloggii, 14" DBH, moderate health • Tree #1549: Fruitless mulberry, Morus alba, 8" DBH, good health Tree #1537 Species: Quercus kelloggii DBH: 24" Notes: three individual stems Recommendation: Removal This triple -stemmed oak is located just outside of the proposed building footprint and the excavation and construction process, if carried out as planned, would damage or destroy about 40% of the root zone. This would likely lead to the decline or death of the tree. A significant portion of the canopy has already died back due to stress factors unrelated to construction, leaving the canopy thin and somewhat unbalanced as it is now. Tree #1547 Species: Quercus kelloggii DBH: 14" Notes: single stem, basal decay present Recommendation: Removal This oak is located between the building footprints of two planned accessory dwelling units. Once completed, the two structures would conflict with the tree's canopy, necessitating heavy pruning in order to achieve adequate building clearance for fire safety. This would require removing nearly half of the tree's live canopy, most likely leading to significant stress and/or decline. In addition, decay is visible at the base of the tree, suggesting a higher likelihood of major failure in the future. If the tree were retained, it would be likely to damage the surrounding ADUs if this structural defect were to cause it to fail. Finally, the portion of the root zone that would be affected by the construction process is less than that of tree #1537, but this damage would exacerbate the stress to the tree that would be caused by the required pruning. Tree # 1549: Species: Morus Alba DBH: 8" Notes: single stem Recommendation: Removal This small mulberry appears relatively healthy and it would likely have the best chance of long-term survival out of the three trees listed. However, if the tree were retained, its proximity to the nearby ADU would likely become problematic as it matures in size. This tree would require significant and frequent pruning to be kept within building clearance and fire safety guidelines and its root system could eventually damage the foundation of the nearby structures. A smaller tree of a different species would be better suited to this planting location and would ideally be planted about 10' further from the buildings. Fortunately, most are located outside of the construction area and will be largely unaffected by the proposed work. However, the two trees located closest to the work site, an almond (tree #1561) and silver maple (tree #1560), could potentially be damaged by equipment and/or construction personnel unless steps are taken to protect them. The following is a list of recommendations intended to minimize the impact of construction on these trees and improve their chances of long-terrn survival. Tree Protection Zone: Establish a tree protection zone (TPZ) around the almond and silver maple. This zone should be established with temporary 6' tall fencing and remain in place through project completion. This protection zone should be established at least to the furthest extent of the dripline of each tree, though it is best to cover as much area as is feasible within the constraints of the construction project. Since the remaining live trees on the property are located outside of the immediate work zone, they may not require TPZ fences as long as workers and heavy equipment remain confined to the construction side of the property. 2. Soil Com al c� tion: Minimize soil compaction within the,tree protection zones. Heavy materials should not be stored, vehicles maneuvered or parked, grade changed, or paved surfaces constructed within the TPZs unless absolutely necessary. To mitigate potential damage caused by soil compaction (and to improve moisture retention), a 2"-3" layer of mulch should be applied beneath the canopy of each tree, starting about 4"-6" out from the trunk and extending at least to the drip line. It may be beneficial to both the almond and maple to extend the mulch circle over as much area as possible, potentially extending past the drip line/TPZ perimeter. The mulch layer within the drip line should be reduced to a depth of 3" upon project completion. 3. Mechanical damage and tree injury: If machinery must be operated within the TPZ, steps should be taken to protect the tree trunk from injury. if injury should occur to any tree during construction, it should be inspected by an arborist or landscape professional for evaluation and treatment recommendations. 4. Root protection: If excavation is necessary inside or near the tree protection area, avoid cutting roots over 2" diameter where possible. If larger roots are severed during the construction process, it is recommended that they be cut cleanly with a saw or bypass pruners at a 90 degree angle (as opposed to being left "torn" by machinery). If roots over 4" diameter are encountered in or near the TPZ, consultation with the landscape architect or arborist is advised before pruning cuts are made. Pruned roots should be covered with moist soil immediately after cuts are made and not be left exposed for extended periods of time. Based on the current building plans, it is unlikely that either tree will require significant root pruning. S. Water: Both the almond and silver maple will benefit greatly from proper watering. If construction is taking place during the summer months, each tree should be given a deep soak (water should penetrate the soil to a depth of about 12") every 2-4 weeks. As mentioned above, a layer of mulch can be of great benefit before, during, and after construction to aid in moisture retention. Consistent and thorough watering may be the most important factor in maintaining the health and long-term survival of these trees. Following these recommendations will greatly increase these trees' likelihood of surviving the construction process and maintaining good health going forward.
