CxAcomm-&vlplatutingWorms & HandontsSZoning Pent it Application.&c ROGUE PLANNING G DEVELOPMENT SERVICES, LLC February 15, 2022 City of Ashland Planning Division 20 E Main Street Ashland, OR RE: 265 Skycrest (39 1E 08AB: 207) Request for Extension of Planning Action 2020-00100, A request for a Physical and Environmental (P&E) Constraints Review Permit and a Solar Setback Exception to allow the construction of a new Single -Family Residence on Hillside Lands with Severe Constraints for the property at 265 Skycrest Drive. The requested Solar Setback Exception would allow shading of the property to the north at 390 Orchard Street greater than the shadow that would be cast by a six-foot fence along the property line; the neighbors at 390 Orchard Street have consented to the proposed shading. The application also includes requests for Exceptions to the Development Standards for Hillside Development Standards (AMC 18.3.10.090.E.2.c & E.2.d) to allow vertical walls up to 25 -feet on a downhill elevation where the standard limits walls to 20 -feet and to allow a continuous horizontal building plane longer than 36 feet without a six- foot offset (the wall proposed is 36' 8" with a two foot offset), and an Exception to Street Standards to allow curbside sidewalks to be installed along the subject property's frontage. Findings addressing the criteria for Permit Extension found in 18.1.6.040. The Staff Advisor shall grant a timetable extension of any zoning permit or planning action approval under demonstrated compliance with all of the following conditions: A. One-time extension no longer than 24 months is allowed. Applicant's Finding: The request is to extend PA2020-00100, 24 months. The application was approved by the Ashland Planning Director on August 24, 2020. The decision of the Planning Director is valid until March 8, 2022. The request would extend the approved minor land partition decision until April 8, 2024. B. The Staff Advisor shall find that a change of conditions for which the applicant was not responsible prevented the applicant from completing the development within the original time limitation. Applicant's Finding: Page 1 of 2 0 ROGUE PLANNING li DEVELOPMENT SERVICES, LLC The year 2020 and 2021 will forever be marked as one of the most challenging not only locally following the Almeda Fire disaster, but the severe impacts to construction material supply, shipping, extreme costs and numerous other factors that prevented the finalization of the final building permit plans and supply chains and costs made the construction costs of the new residence prohibitive. C. Land Use Ordinance requirements applicable to the development have not changed since the original approval. An extension may be granted, however, if requirements have changed and there is no material effect upon the original approval, and the applicant agrees to comply with any new requirements, as a condition of the extension. Applicant's Finding To the applicant's knowledge in reviewing the decision that approved PA2020-00100, Land Use Ordinance requirements applicable to the development have not changed that would have a measurable effect on the proposal since the original approval.
