Second Street Applicant; Kim Blackwolf for Trinity Parish Church Description: A request for removal of one Norway maple tree about 18 feet tall and 8 inches in diameter at breast height to facilitate new solar panels on the roof of the Trinity Church Hall building. The solar project is proposed to replace two of the five heating systems at Trinity Church. The applicant is proposing to replace the Norway maple with a dwarf Japanese maple to be planted onsite. COMPREHENSIVE PLAN DESIGNATION: Commercial Downtown; ZONING: C -1-D; MAP: 39 IE 09 BD; TAX LOT: 3600. The Community Development D'irector's decision becomes final and is effective on the 12th day after the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050(F) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). The property is 0.33 acres, zoned C -1-D. Because the tree is greater than 6 inches diameter at breast height (DBH) and the property is zoned C -1-D commercial downtown, tree removal is regulated and processed as a Type 1 permit. The approximately 18 foot tall, 8" diameter at breast height (dbh) tree is growing near the Parish Hall building. The church is requesting to remove the Norway maple tree to facilitate the installation and functions of a new solar panel system on the roof. According to the application, once permitted and installed the solar project is expected to replace at least two of the five heating systems at Trinity Church and remove over 9 tons of CO2 from their footprint. The applicant indicated that an arborist was consulted, and they are proposing to replace the Norway maple tree with a dwarf Japanese maple tree planted onsite to mitigate the loss of the Norway maple. The church is individually listed on the National Historic Register and is within the Ashland Historic Downtown District. The solar panel installation is exempt from Site Review per Ashland Municipal Code 18.5.2.020.C.4.d for C-1 zoned properties in the Historic District provided the following criteria are met: • The footprint of the structure is not increased, TREE -2024-00223 44 North Second Street Ijnc Page 1 • The solar installation will be parallel to the plane of the roof and will not extend above the peals or is not visible from public right-of-way. Staff notes that the panels will be partially visible to the right-of-way. The solar installation company provided an email on February 22, 2024, stating that the panels will be installed flush to the roof and will not extend above the peak or overhang the roof ridge. There is no increase to the footprint of the structure. In addition, two reports were provided showing the Total Solar Resource Fraction (TSRF): one with the tree remaining in place and one without the tree. The TSRF numbers are as follows: the TSRF is 52 percent with the tree and the TSRF is 72 percent without the tree. There would be a 10 percent increase in solar production if the tree is approved for removal. Other locations along the roof have been explored over the last few years for solar installation, but this location is the only viable position for solar access. Staff has reviewed the information provided by the applicant and has determined that the solar panels will be more efficient and productive in the proposed location with removal of one Norway maple tree as indicated on the site plans. The applicability for tree removal (per AMC 18.5.7.020) is that it shall be carried out in accordance with the requirements of AMC Chapter 18.5.7. The application included a narrative, site plan, and photos of the proposed tree to be removed. During the February 2024 regular meeting of the City of Ashland Tree Management Advisory Committee (Tree MAC), the recommendation to staff and the applicant was to provide more details stating why the tree needs to be removed to facilitate solar panel installation. Staff reached out to the applicant and solar company seeking information on behalf of the Tree MAC's recommendation (details are described above). Additional solar production reports and justification for the proposed tree removal were provided. The Notice of Complete Application (HOCA) was mailed to all properties within 200 feet of the subject property as well as a physical notice posted along the frontage of the property. The notice included staff contact information. In accordance with AMC 18.5.1.050, the Type I procedure for planning applications allows a 14 -day period for the submission of written comments, starting from the date of mailing. No written public comments were received. The applicant has submitted a burden of proof document showing that they meet the criteria of approval for a Tree Removal Permit. The document is incorporated herein by this reference. In the staff's assessment, the proposed removal of one Norway maple tree is in conformance with the land use ordinance approval criteria as cited below. In summary, for a tree that is not a hazard tree, a tree removal permit shall be granted if the criteria outlined in 18.5.7.040.2 are met. Staff agrees that the tree proposed for removal will not have significant negative impact on erosion, soil stability, or have a significant impact on the tree densities within 200 feet of the property. One replacement tree is proposed to be planted to mitigate the loss of the Norway maple. The application materials state that the tree is proposed for removal to facilitate installation of roof -top solar panels. Based on the materials submitted by the applicant, staff finds the application has sufficiently demonstrated compliance with all approval criteria for tree removal. TREE -202400223 44 North Second Street /jnc Page 2 The criteria for Hazard Tree Removal are described in AMC Chapter 18.5.7.040.13 as follows: Tree That is Not a Hazard. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The tree is proposed for removal in order to permit the application to be consistent with other applicable Land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part F18 -A and Physical and Environmental Constraints in part 18.3.10. b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone. In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050. Such mitigation requirements shall be a condition of approval of the permit. Staff funds that Planning Action TREE -2024-00223, a request to remove one hazard tree, complies with all applicable City ordinances with the implementation of conditions attached below. Therefore, Planning Action TREE -2024-00223 is approved. if any one or more of the following conditions are found to be invalid, for any reason whatsoever, then Planning Action TREE -2024- 00223 is denied. The following are conditions of approval: 1.) That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2) That one replacement, mitigation tree of an appropriate species and stature shall be planted on site. 3) That the replacement, mitigation tree shall be planted during early spring or during fall following the removal year. 4) That the mitigation tree shall be a species that is native to this region and climate friendly; if a tree is replaced near the street an appropriate street tree shall be selected from the Recommended Street Tree Guide. 5) That replacement, mitigation tree shall be irrigated and maintained for at least the first three to five growing seasons to promote survival. Tree to be removed, Trinity Episcopal Church is requesting to remove the Acer Platanodes (Norway maple) closest to the Parish Hall to facilitate new solar panels on the roof. The solar project will replace at least two of the five heating systems at Trinity Church and remove over 9 tons of CO2 from the churches footprint. For more than a decade TEC has periodically explored putting solar panels on the parish hall roof. Each time we have been asking about the long side of the building next to US Bank. Each time we were told that US Bank blocked our solar access. We probably have explored this issue at least six times. I personally explored this twice, six and eight years ago. Not until this year did a solar company bring up putting the solar panels on the short part of the "L" shaped building facing East -West. This is our only possible placement for solar panels and the tree is in the way. TEC has a large financial and environmental energy burden. This installation of solar equipment will change that burden significantly, allowing us to replace at least two HVAC system and perhaps three (of five) with highly efficient heat pumps. We will replace the tree on some other part of the property. I don't think we should have to wait for another month. I have the staff decision (recommending approval) ready to go. I just need to add in the supportive information regarding necessary removal of the tree either from your certified arborist or from the report the solar company may have provided. Thanks!
