On April 26, 2024, the Community Development Director approved the request for the following:

compromised due to Verticillium wilt, a fungal disease. A mitigation tree of a smaller stature maple is

The Community Development Director's decision becomes final and is effective on the 121' day after
the Notice of Final Decision is mailed. Approval is valid for a period of 18 months and all conditions of
approval identified on the attached Findings are required to be met prior to project completion.
The application, all associated documents and evidence submitted, and the applicable criteria are
available for review at the Ashland Community Development Department, located at 51 Winburn Way
Copies of file documents can be requested and are charged based on the City of Ashland copy fee
schedule.
Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a
reconsideration of the action as set forth in the Ashland Land Use Ordinance {ALUO) 18.5.1.050(F)
and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). The
ALUO sections covering reconsideration and appeal procedures are attached. The appeal may not be
made directly to the Oregon Land Use Board of Appeals.

DECISION
The application requests a Tree Removal Permit to remove one hazardous Norway Maple tree from
the property at 44 N Second Street. The tree is greater than 6 inches diameter at breast height
(DBM and is interior to the property, and the property is zoned C -1-D Commercial Downtown
District. During a site visit, staff noted that the tree does appear to have an injury or illness near the
base of the trunk but is still producing new leaves in much of the canopy. Due to this, the tree does
not meet the definition for a "dead tree" — which would exempt it from permitting requirements -
and requires Type I land use approval for the regulated tree removal.
The maple tree is approximately 15 -feet tall and located inside the security fence on Second Street.
The application was prepared by a certified arborist and states that the tree "is infested with
verticillium wilt" and "half of the trunk is dead." The arborist recommends that the "tree be
removed and replaced with a smaller statured tree" more suited for the location. The applicability
for tree removal (per AMC 18.5.7.020) is that it shall be carried out in accordance with the
requirements of AMC Chapter 18.5.7. The application was reviewed during the regular April 2024
meeting of the City of Ashland Tree Management Advisory Committee (TMAC). Staff presented
the application and provided an overview of the request where the TMAC recommended removal of
the tree.
The Notice of Complete Application (HOCA) was mailed to all properties within 200 feet of the
subject property as well as a physical notice posted along the frontage of the property. The notice
included staff contact name and number. In accordance with AMC 18.5.1.050, the Type I procedure

for planning applications allows a 14 -day period for the submission of written comments, starting
from the date of mailing. No comment was received from the public.
The applicant has submitted a burden of proof document showing that they meet the criteria of
approval for a Tree Removal Permit. That document is incorporated herein by this reference. In
staff's assessment, the proposed removal of one tree is in conformance with the land use ordinance
approval criteria as cited below.
In summary, to be deemed a "hazard tree" the condition or location of the tree must clearly present
a public safety hazard (i.e., that the tree is likely to fall and injure persons or property), or that there
is a foreseeable danger of property damage to an existing structure or facility, and such hazard or
danger cannot reasonably be alleviated by treatment, relocation or pruning. Based on the materials
provided and site visits conducted, the tree appears to be nearing the end of its lifespan but does not
meet the requirements to be deemed a hazardous tree. Staff nonetheless finds that the application
has sufficiently demonstrated compliance with all approval criteria for tree removal for a tree that is
not a hazard.
The criteria for a Tree Removal Permit are described in AMC Chapter 18.5.7.040.13 as
follows
2. Tree That is Not a Hazard. A Tree Removal Permit for a tree that is not a hazard shall be
granted if the approval authority finds that the application meets all of the following criteria,
or can be made to conform through the imposition of conditions.
a. The tree is proposed for removal in order to permit the application to be consistent with
other applicable Land Use Ordinance requirements and standards, including but not
limited to applicable Site Development and Design Standards in part 18.4 and Physical
and Environmental Constraints in part 18.3.10.
b. Removal of the tree will not have a significant negative impact on erosion, soil stability,
flow of surface waters, protection of adjacent trees, or existing windbreaks.
c. Removal of the tree will not have a significant negative impact on the tree densities,
sizes, canopies, and species diversity within 200 feet of the subject property. The City
shall grant an exception to this criterion when alternatives to the tree removal have
been considered and no reasonable alternative exists to allow the property to be used
as permitted in the zone.
d. Nothing in this section shall require that the residential density to be reduced below the
permitted density allowed by the zone. In making this determination, the City may
consider alternative site plans or placement of structures of alternate landscaping
designs that would lessen the impact on trees, so long as the alternatives continue to
comply with the other provisions of this ordinance.
e. The City shall require the applicant to mitigate for the removal of each tree granted
approval pursuant to section 18.5.7.050. Such mitigation requirements shall be a
condition of approval of the permit.

Staff finds that Planning Action TREE -2024-00228, a request to remove one hazard tree, complies
with all applicable City ordinances with the implementation of conditions attached below.
Therefore, Planning Action TREE -2024-00228 is approved. If any one or more of the following
conditions are found to be invalid, for any reason whatsoever, then Planning Action TREE -2024-
00228 is denied. The following are conditions of approval:
1) That all proposals of the applicant shall be conditions of approval unless otherwise
specifically modified herein.
2) That one (1) appropriately sized mitigation tree be planted in the same location within one
(1) year of removal of the Norway Maple tree.

Any affected property owner or resident has a right to submit written comments within the 14 -day comment period to

Ashland Planning Division Staff determine if a land use application is complete within 30 days of submittal. Upon
determination of completeness, a notice is sent to surrounding properties within 200 feet of the property submitting the
application. After the comment period and not more than 45 days from the application being deemed complete, the Planning
Division Staff shall make a final decision on the application. A notice of decision is mailed to the same properties within 5
days of decision. An appeal to the Planning Commission of the Planning Division Staff's decision must be made in writing to
the Ashland Planning Division within 12 days from the date of the mailing of final decision. (AMC 18.5.1.050.G)
The ordinance criteria applicable to this application are attached to this notice. Oregon law states that failure to raise an
objection concerning this application, by letter, or failure to provide sufficient specificity to afford the decision maker an
opportunity to respond to the issue, precludes your right of appeal to the Land Use Board of Appeals (LUBA) on that issue.
Failure to specify which ordinance criterion the objection is based on also precludes your right of appeal to LUBA on that
criterion. Failure of the applicant to raise constitutional or other issues relating to proposed conditions of approval with
sufficient specificity to allow this Department to respond to the issue precludes an action for damages in circuit court.

TREE REMOVAL PERMIT (AMC 18.5.7.040.B)
Hazard Tree. A Hazard Tree Removal Permit shall be granted if the approval authority finds that the application meets all of the following criteria, or
can be made to conform through the imposition of conditions.
a The applicant must demonstrate that the condition or location of the tree presents a clear public safety hazard (i.e., likely to fall and injure
persons or property) or a foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot

b, The City may require the applicant to mitigate for the removal of each hazard tree pursuant to section 18.5.7.050. Such mitigation
requirements shall be a condition of approval of the permit.

A tree that Is located in any public street right-of-way or other public property may not be removed until a Sireet7ree Removal Permit has been
submitted according to the Application Submission Requirements, below, and reviewed and approved by the City of Ashland.
An application for street bee removal must demonstrate that the tree is an emergency, hazard, or dead tree as outlined below in the Application
Submission Requirements,
ApplicAlon Submission Requirements. An application for a street tree removal permit shall include all of the following information.
1. Application Form and Fee. The application must include the information requested on the Street Tree Removal Permit form provided by
the Cily of Ashland and the permit application fee. Only those property owners of a lot adjoining the street tree location or homeowners'
associations responsible for street trees In their development or subdivision may apply to remove an adjoining street tree. If a tree is
€ocated in front of more than one property, each property owner or homeowners' association official must sign the Street Tree Removal
Permif form.
2. Site Plan. A site plan of the property drawn to scale containing the following information. The scale of the site plan must be at least one
inch equals 50 feet or larger.
a. North arrow and scale.
b. Property boundaries including dimensions of all lot lines and driveway locations.
c. Location and width of all public streets, planting strips, and sidewalks adjoining the site.
d. Size, species, and location of the treo(s) proposed to be removed.
3. Written Statement. A written statement explaining how the proposed street tree removal satisfes one of the following approval criteria.
The Community Development director may require additional information to demonstrate that the proposed removal satisfies one of the
following approval criteria including: 1) a written statement le be prepared by an arborist licensed by the State of Oregon Landscape
Contractors Board of Construction Contractors Hoard and certified by the International Society of ArWoulture or American Society of
Consulting Arborists; and 2) an International Society of Arboriculture (ISA) Basic Tree Risk Assessment Form to be completed by an
arborist
Street Tree Removal Approval Criteria
a) Emercencv Tree Removal. The tree presents an immediate danger of collapse and represents a dear and present hazard to persons
or property. Immediate danger of collapse is defined as a tree that may already be leaning, with the surrounding soil heaving, and/or
there is a significant likelihood that the tree wilt topple or otherwise fail and rause damage before a tree removal permit could be
obtained through the non -emergency process.
h) Hazard Tree Removal. The tree presents a dear public safety hazard (Le., likely to fall and injure persons or property) or a
foreseeable danger of property damage to an existing structure or facility, and such hazard or danger cannot reasonably be alleviated
by treatment, relocation, or pruning. A hazard bee is a tree that is physically damaged to the degree that It Is dear the tree is likely to
fag and injure persons or property. A hazard tree may also include a tree that is located within a public right•of--way and is causing
damage to existing public or private facilities or services and such facilities or services cannot be relocated.
e) dead Tree. The tree is dead, A dead tree is lifeless- Such evidence of lifelessness may include unseasonable tack of foliage, brittle
dry branches, or lack of any growth during the growing season.
Replacement and Stump Removal, Applicants for approved Street Tree Removal Permits are required to remove any stumps and replace the tree.
Stump removal and replacements for approved street tree removals shall meet the following requirements,
1. Any street tree removed shall be removed at ground level or lower. If a tree is removed below ground level, the surface must be restored to
finish grade and any regrowth which occurs shall be promptly removed.
2. All street trees shag be an appropriate spedes selected from and planted according to the City of Ashland Recommended Street Tree List.

To whom it may concern. I examined a 14" dia. Norway maple located in the fenced courtyard at Trinity church. There
is a large dead portion of the stem on the west side of the tree extending from existing grade to 5' above grade that
encompasses 50% of the mainstem. It is my opinion that the tree be removed and replaced with a smaller
statured tree for replacement.

SECOND TREE REMOVAL REQUEST AT TRINITY CHURCH
Casey Roland came to Trinity Church March 19ch to remove the tree approved (for the solar
project). He noticed that the other Acer Platanoides had large pieces of bark coming off. Closer
inspection revealed the west side of the trunk is dead. The tree has Verticillium wilt, a serious
fungal disease that causes injury or death to many plants, including trees. This tree's issues are
advanced enough that cutting it down was recommended as the best answer to the problem. A
smaller maple such as Acer Seiryu can be replanted there after treating the soil for the fungus.
