A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE DEEDS TO
EFFECTUATE A PROPERTY LINE ADJUSTMENT BETWEEN CITY -OWNED LAND
(IMPERATRICE PROPERTY) AND ADJACENT PROPERTY OWNED BY
JOSEPH AND KATHERINE IVERSON
WHEREAS, the City of Ashland owns certain real property located at 1925 Eagle Mill Road
(Tax Lot 200, Assessor's Map 38-1E-33), commonly referred to as the Imperatrice Property; and
WHEREAS, the adjacent property at 1720 North Mountain Avenue (Tax Lot 100, Assessor's
Map 38-1E-33) is owned by Joseph and Katherine Iverson; and
WHEREAS, a longstanding boundary fence jointly constructed and replaced by the City and
the Iversons in 1996—was later found to encroach onto City -owned land due to historical survey
inaccuracies; and
WHEREAS, Joseph and Katherine Iverson initiated a formal Property Line Adjustment (PLA)
application with Jackson County (File No. 439-24-00057-SUB), which was approved with
conditions on December 16, 2024, to transfer approximately 1.52 acres from the City's parcel to
the Iverson parcel; and
WHEREAS, a final map of survey has been completed by a licensed surveyor, and the County
Surveyor has confirmed that the survey and legal descriptions meet the requirements of ORS
Chapter 92; and
WHEREAS, the City has reviewed the proposed conveyance and determined that the affected
portion of land is not needed for public use and that the adjustment serves the public interest by
clarifying legal boundaries and resolving a longstanding encroachment; and
WHEREAS, ORS 271.310 authorizes a city to sell, exchange, or otherwise dispose of real
property not needed for public use, upon approval by resolution of the governing body; and
WHEREAS, ORS Chapter 93 sets forth the requirements for the execution, acknowledgment,
and recordation of conveyances of real property in Oregon;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ASHLAND, OREGON: I
SECTION 1. The City Council hereby declares that the portion of City -owned land to be
conveyed under the approved Property Line Adjustment is not needed for public use and may be
conveyed in accordance with ORS 271.310.
SECTION 2. The City Council authorizes the City Manager, or their designee, to execute deeds
and all necessary documents to complete the property line adjustment and conveyance to Joseph
Resolution No. 2025-03 Page 1 of 2
and Katherine Iverson, consistent with Jackson County's land use approval and the recorded
survey.
SECTION 3. The execution, acknowledgment, and recordation of said deeds shall comply with
the requirements of ORS Chapter 93 and applicable County procedures.
SECTION 4. This resolution is effective upon adoption.
