Many of the proposed changes and improvements to the fagade were previously approved under a commercial building which was exempt from a Planning Action. This application completes the remainder of the proposed improvements to the landscape and architectural improvements to the exterior including a new exterior stairway, architectural awnings, and a secondary entry arbor. COMPREHENSIVE PLAN DESIGNATION: Employment; ZONING: E-1; MAP: 39 -IE - 09 -AB; TAX LOT: 6500. The Community Development Director's decision becomes final and is effective on the 12"' day after the Notice of Final Decision is nailed. Approval is valid for a period of 18 months and all conditions of approval identified on the attached Findings are required to be met prior to project completion. The application, all associated documents and evidence submitted, and the applicable criteria are available for review at the Ashland Community Development Department, located at 51 Winburn Way. Copies of file documents can be requested and are charged based on the City of Ashland copy fee schedule. Prior to the final decision date, anyone who was mailed this Notice of Final Decision may request a reconsideration of the action as set forth in the Ashland Land Use Ordinance (ALUO) 18.5.1.050( ) and/or file an appeal to the Ashland Planning Commission as provided in ALUO 18.5.1.050(G). Many of the proposed changes and irnprovements to the fagade were previously approved under a commercial building which was exempt fi-om a Planning Action. This application completes the remainder of the proposed improvements to the landscape and architectural improvements to the exterior including a new exterior stairway, architectural awnings, and a secondary entry arbor. The subject property is located on the southeast corner of the intersection of A Sheet and Fourth Street, within the Railroad Addition Historic District. The property is developed with a commercial building that is considered "compatible/non-historic/non-contributing" in the Railroad Addition Historic District inventory document. The building was originally built in 1984 as a single -story building. The historic inventory indicates that the 2"d story was added in 1989. The subject parcel is 0.16 acres and took its current form when it was partitioned in November of 2022 approved as PA -TI -2022-00180 and recorded as County Survey 423756. A Street is a Collector Street; and Fourth Street is a Neighborhood Street. Both are paved, with curbs and gutters in place, and sidewalks are curb -tight along the subject property's frontages. Utilities including water, sanitary sewer, storm drainage and electric are in place on the property and in the adjacent rights-of-way to serve the project. PA -Ti -2025-00259 500 A Stha Page i The application explains that "The existing asphalt parking lot, which is currently sloping to the building, will be removed and regraded to direct the water flow away from the buildings. The parking area will be replaced with an outdoor paved and decomposed granite courtyard, including new concrete seat walls, torten steel retaining walls, new plantings, trees, and paved spaces for gathering. A perimeter fence will be included in the design to secure the courtyard during closed hours and to provide a sense of privacy from the surrounding streetscape. New regulations adopted to comply with the state's Climate Friendly & Equitable Communities rules mean that the city can no long impose a minimum off-street parking requirement with land use actions, and the current proposal to create a landscaped pedestrian plaza from existing parking area is just the sort of project the state r-rrles sought to encourage. The application also includes a request for a single tree removal for an 18 -inch cedar that is directly adjacent to the parking area. The application explains "This is a `volunteer' tree and it lies within the footprint of the new grading and walls. Several new site trees erre proposed and graphically represented per the landscape plans inchided in this submittal." The Tree Management Advisory Committee (Tree MAC) reviewed the application at their March meeting, and based on the location of the free and the proposed improvements felt the removal was consistent with the approval criteria for a Tree that is not a hazard. The Tree MAC felt that the entire application is an improvement of the property and felt that the new landscaping as proposed provides sufficient mitigation. The Tree MAC also noted that the new street trees along Fourth Street will bring the property into compliance with Street Tree standards. Historic Review The Historic Conunission considered the request at their March 5, 2025 meeting. The HPAC discussed that the work already done as exempt from site design review and the work proposed here both represent significant improvements over the existing condition. HPAC discussed the rooftop deck use, which they would typically discourage, but felt that in this case it was appropriate given the location away from the primary strectscape and that it was very well -executed in the proposed design. HPAC unanimously recommended approval as presented. Public Input Notice of the planning action was mailed to all properties within 200 feet of the subject property as well as a physical notice posted along the frontage of the property. The notice included a staff contact name and number. In accordance with AMC 18.5.1.050, a Type I procedure for planning applications allows a 14 -day period for the submission of written conunents, starting from the date of mailing. Subsequent to the mailing of a Notice of Complete application no written comments were received either in support or opposition to the application. The criteria for Site Design Review approval are described in AMC Section 18.5.2.050 as follows: A. Underlying Zone: The proposal complies with all of the applicable provisions of the underlying zone (part 18.2), including but not limited to: building and yard setbacks, lot area and dimensions, PA -T1-2025-00259 500 A St./aa Page 2 density and floor area, lot coverage, building height, building orientation, architecture, and other applicable standards. B. Overlay Zones: The proposal complies with applicable overlay zone requirements (part 18.3). C. Site Development and Design Standards: The proposal complies with the applicable Site Development and Design Standards of part 18.4, except as provided by subsection E, below. D. City Facilities: The proposal complies with the applicable standards in section 18.4.6 Public Facilities and that adequate capacity of City facilities for water, sewer, electricity, urban storm drainage, paved access to and throughout the property and adequate transportation can and will be provided to the subject property. E. Exception to the Site Development and Design Standards. The approval authority may approve exceptions to the Site Development and Design Standards of part 18,4 if the circumstances in either subsection 1 or 2, below, are found to exist. There is a demonstrable difficulty meeting the specific requirements of the Site Development and Design Standards due to a unique or unusual aspect of an existing structure or the proposed use of a site; and approval of the exception will not substantially negatively impact adjacent properties; and approval of the exception is consistent with the stated purpose of the Site Development and Design; and the exception requested is the minimum which would alleviate the difficulty.; or There is no demonstrable difficulty in meeting the specific requirements, but granting the exception will result in a design that equally or better achieves the stated purpose of the Site Development and Design Standards. The criteria for a Tree Removal Permit are described in AMC Section 18.5.7.040.8.2 as follows: 2. Tree That is Not a Hazard. A Tree Removal Permit for a tree that is not a hazard shall be granted if the approval authority finds that the application meets all of the following criteria, or can be made to conform through the imposition of conditions. a. The tree is proposed for removal in order to permit the application to be consistent with other applicable land Use Ordinance requirements and standards, including but not limited to applicable Site Development and Design Standards in part 18.4 and Physical and Environmental Constraints in part 18.3.10. b. Removal of the tree will not have a significant negative impact on erosion, soil stability, flow of surface waters, protection of adjacent trees, or existing windbreaks. c. Removal of the tree will not have a significant negative impact on the tree densities, sizes, canopies, and species diversity within 200 feet of the subject property. The City shall grant an exception to this criterion when alternatives to the tree removal have been considered and no reasonable alternative exists to allow the property to be used as permitted in the zone. d. Nothing in this section shall require that the residential density to be reduced below the permitted density allowed by the zone, In making this determination, the City may consider alternative site plans or placement of structures of alternate landscaping designs that would lessen the impact on trees, so long as the alternatives continue to comply with the other provisions of this ordinance. e. The City shall require the applicant to mitigate for the removal of each tree granted approval pursuant to section 18.5.7.050, Such mitigation requirements shall be a condition of approval of the permit. PA -TI -2025-00259 500 A St./aa Page 3 Decision The applicants have submitted a complete set of Findings addressing their burden of proof to the Plamiing Department to demonstrate compliance with the applicable approval standards for the proposal and by their reference are incorporated as if set out in full. In staff's opinion, the criteria for Site Design Review are satisfied by the proposal with the conditions attached. Planning Action #PA -T1-2025-00259 is approved with the following conditions, Further, if any one or more of the following conditions are fouled to be invalid for any reason whatsoever, then Planning Action #PA -T1-2025-00259 is denied. The following are the conditions, and they are attached to the approval: I) That all proposals of the applicant shall be conditions of approval unless otherwise specifically modified herein. 2) That the plans submitted for the building permit shall be in substantial conformance with those approved as part of this application. if the plans submitted for the building permit are not in substantial confoiniance with those approved as part of this application, an application to modify the Site Design Review approval shall be submitted and approved prior to issuance of a building permit. 3) That storm water from all new impervious surfaces and runoff associated with peak rainfalls must be collected on site and channeled to the City storm water collection system (i.e., curb gutter at public street, public storm pipe or public drainage way) or through an approved alternative in accordance with Ashland Building Division policy BD -PP -0029. On-site collection systems shall be detailed on the building permit submittals. 4) That a sign permit shall be obtained prior to installation of any new signage. Signage shall meet the requirements of Chapter 18.4.7. 5) That the building permit submittals shall include: a. That exterior building materials and paint colors shall be consistent with those described in the application materials and compatible with the surrounding area, and sample exterior building colors shall be provided with the building permit submittals for review and approval of the Staff Advisor. No very bright or neon paint colors shall not be used in accordance with AMC 18.4,2.030.E. b. Details of the specific light fixture selection, placement, direction and/or shrouding to demonstrate that all exterior lighting shall be directed on the property to minimize direct illumination of adjacent residential properties as required in AMC 18.4.4.050.C.5. 6) That prior to the issuance of a Certificate of Occupancy: All landscaping and hardscaping shall be installed according to the approved plan, inspected and approved by the Staff Advisor.
