RECITALS
A. The City and Contractor previously entered into a Public improvement Project effective Dine
25, 2024 (the "Agreement"), subsequently amended April 02, 2025,for the Community Center
and Pioneer Hall Rehabilitation.
B. The project is a historic site that is undergoing a significant overhaul to ensure safe Ilse.
During the process, it became apparent that the building condition was worse than anticipated.

Based on recommendations om engineers and onsite contractors, demolition was
considered. Afler an extended review, including multiple meetings of an advisory coinniittee,
the City Council decided to allocate additional funds to cover the discovered work and to
bring the building tip to modern code in some important areas (wiring, lighting) as fitting for a
building the community plans to use for an extended period into the fiiture. Consequently, this
has led to an increase in project costs for the additional work as well as the delay while the
decision on how to proceed was taken, resulting in Amendment 1 for $416,056.17 which was
approved April 02, 2025,
C. As work has progressed and more of the structure of the Community Center has been exposed
(primarily through the removal of lathe and plaster wall material), new concerns have
emerged. The largest impact has been the need to shore up the north side of the building to
safely allow new trusses and structural reinforcement to be installed. ($13,782.52)
D. Following completion of work at Pioneer and subsequent walkthrough with future customers
a request was made to add acoustical panels to the main hall to reduce echo and make the
space more useable. ($3,926.62)
E. The City and Provider now wish to amend the Agreement with this Amendment 2 to increase
the amount of compensation to be paid to Provider.
AGREEMENT
NOW THEREFORE, in consideration of the mutual benefits and obligations set forth
herein, the parties agree as follows:

I . Amend Section 4.1 of the Agreement as follows, with strikeout wording deleted and
underscored wording added:
2.1 City shall pay Contractor an amount not to exceed $ 2,156,255.31 A$4T72-1,00) as
provided herein as full compensation for the Work as specified iii file attached
SUPPORTING DOCUMENTS, which are incorporated herein. Contractor agrees to
complete this Amendment in accordance with the attached specifications and
requirements, including any change orders.
2.2 hi no event sliall Provider's total of all compensation and reimbursement ruder this
Agreement exceed the total stitil listed in Section 2.1 without the express, written
approval from the City official whose signature appears below, or such official's
successor in office. Provider expressly acknowledges that no other person has authority
to order or authorize additional Work which would cause this maximum suns to be
exceeded and that any authorization from the responsible official must be in writing.
Provider further acknowledges that any Work delivered, or expenses incurred without
authorization as provided herein is done at Provider's own risk and as a volunteer without
expectation ofcompensation or reimbursement.
2. This Amendment No. 2 is effective upon being signed by both parties.
3. Except as specifically modified by this Amendment No. 2, the terms and conditions of the
Agreement remain in full force and effect.

Installing CT Membrain (vapor barrier) under the rigid. This is fine, but not In my bid to you for
the rigid. It Is a bit redundant, as the rigid already has a vapor barrier facing, bust if we need to
put the Membraln LIP as Well, you'll need to add another $450.00

("Work") specifically set forth in the Agreement, This Addendum modifies the terms of ilia Agreement and its exhibits and
addenda. If any of Elie terms and conditions of this Addendum should conflict with any terms and conditions of tlieAgreement
this Addendum shall control. Those modifications are mutually agreed to by the parties and are sut ported by legnl
consideration. Cttstomci's acceptance slinll be evidenced by permitting Contractor to perform the 1'Vork.
2. Contractor agrees to incorporate by reference the scope ofwork and terms and conditions as set forth in Contrmctor's Proposal,
dated June 20, 2025, including all exclusions contained therein.
3. In performing work, Subcontractor is not inspecting or nssessing, and undertnkcs no responsibility to inspect or assess, the
Project site (or tiny component or system thereof) for nny purpose other thnn to perform the Work. The rights find obligations
between Contractor mid Customer concerning Work performed by Contractor shall be as expressly stetted in the Proposal.
4, Clistoluer acknowledges that the spray polyurethane products and the installation specifientions selected by lite Customer and
described in the Work are snl�iect to building codes and evaluation reports which contain express requirements and/or
recommendations which are outside ilia Work unless expressly enumerated in the Proposal. Such requirements find/or
re com mend tit ions may include, but nre not necessarily limited to; installing it Specified attic hutch; limiting entry to tile tittle or
crawl space only for service of utilities mud not permitting storage in the attic or crawl spnee; ensuring that (a) theta are no
interconnected attic, crawl space or bnscmcnt areas, (b) the air in the attic or orawl space is not circulated to other parts of the
building, (a) combustion air and attic ventilation is provided when required, (d) the attic assembly tins been properly
constructed and (c) n code official lilts provided the required inspections.
5. The Contractor bears no responsibility for the fnilirc of the Customer, developer, builder, owner or subsequent owner, to use
and maintain the attic space in strict accordance With the applicable building codes and evaluation reports.
6. Building codes may require, and evaluation reports nlny specify, It thermal barrier or ignition barrier be all flied to file spray
roam appplied insulation, A thermal barrier or ignition barrier is not included within the Work unless speciffically listed in the
Proposal.
