HomeMy WebLinkAbout3276 Relating to the Vacation of a Portion of Fern Street ORDINANCE NO. 3276 AN ORDINANCE RELATING TO THE VACATION OF A PORTION OF FERN STREET Annotated to show deletions and additions to the Ashland Municipal Code sections being modified. Deletions are bold lined , and additions are bold underlined. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: WHEREAS, The City of Ashland City Council initiated the vacation process as allowed by Oregon Revised Statutes(ORS) 271.130; and WHEREAS, the Planning Commission of the City of Ashland has recommended that said portion of the roadway be vacated; and WHEREAS, due notice of said petition for vacation has been given on September 20, 2025 in the manner and form required by law, and a hearing has been held thereon; and it appearing to the City Council of the City of Ashland that the public convenience and welfare will be served thereby and that this vacation is in the public interest. THE PEOPLE OF THE CITY OF ASHLAND DO ORDAIN AS FOLLOWS: SECTION 1. That the certain section of Fern Street located in the City of Ashland described as follows: A Public Street Vacation of that portion of Fern Street between Roca Street and the easterly boundary of The Galey Addition to the City of Ashland, adjacent to those tracts of lands described as Lots 23, 24& 25 within The Galey Addition to The City of Ashland laying situate within the Northwest Quarter of Section 15 in Township 39 South, Range 1 East of the Willamette Meridian in the City of Ashland, Jackson County, Oregon, being more particularly described and bounded as follows, to wit; Commencing at a 1/2 inch iron pipe at the southeast corner of Roca Park Subdivision, recorded in Volume 18, Page 10 in the Plat Records of Jackson County, Oregon, situated on the east line of Lot 24 of the Galey Addition to the City of Ashland, recorded in Volume 3, Page 80 of said Plat Records; thence South 00°16'49" West, along said described east line, a distance of 59.94 feet to the southeast corner thereof, from which a 3/4 inch iron pipe bears North 89143' 11" West, 1.15 feet therefrom, the POINT OF BEGINNING; thence South 00°16'49" West along the east line of Fern Street, a distance of 60.00 feet to intersect the south line of said street; thence North 89140'30" West, along said south line, 329.97 feet to a point from which a 3/4 inch iron pipe bears North 68°38'31" West, 0.43 feet; thence North 00°16' 18" East, along the east line of Roca Street, 30.00 feet to the center line Fern Street; thence North 00°22'00" East continuing along the said east line, 30.00 feet to the southwest ORDINANCE NO. 3276 Page 1 of 3 corner of Lot 23 of said plat; thence South 89140'30" East, along the north line of said described Fern Street, being 30.00 feet north of, parallel with and adjacent to the former centerline of Fern Street, a distance of 329.92 feet to the POINT OF BEGINNING. Containing 0.45 acres or 19,797 square feet, more or less SECTION 2. The City Recorder is hereby directed to deliver a certified copy of this Ordinance No. 3276 to the County Clerk, County Assessor, and County Surveyor of Jackson County, Oregon. SECTION 3. Codification. In preparing this ordinance for publication and distribution, the City Recorder shall not alter the sense, meaning, effect, or substance of the ordinance, but within such limitations, may: (a) Renumber sections and parts of sections of the ordinance; (b) Rearrange sections; (c) Change reference numbers to agree with renumbered chapters, sections or other parts; (d) Delete references to repealed sections; (e) Substitute the proper subsection, section, or chapter numbers; (1) Change capitalization and spelling for the purpose of uniformity; (g) Add headings for purposes of grouping like sections together for ease of reference; and (h) Correct manifest clerical, grammatical, or typographical errors. SECTION 4. Severability. Each section of this ordinance, and any part thereof, is severable, and if any part of this ordinance is held invalid by a court of competent jurisdiction, the remainder of this ordinance shall remain in full force and effect.
